8	8	A BILL for an Act to amend and reenact section 43-58-08.1 of the North Dakota Century Code,
9	9	relating to eligibility requirements for endorsement to prescribe independently of naturopathic
10	10	doctors.
11	11	BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
12	12	SECTION 1. AMENDMENT. Section 43-58-08.1 of the North Dakota Century Code is
13	13	amended and reenacted as follows:
14	14	43-58-08.1. Endorsement for prescribing authority.
15	15	1.A naturopath may not prescribe, dispense, or administer a prescription medication
16	16	without first obtaining an endorsement for licensure.
17	17	2.The naturopath first must apply for a limited endorsement with the board in which the
18	18	naturopath enters a written collaborative agreement with a supervising physician
19	19	licensed under chapter 43-17, who will review the first one hundred prescriptions
20	20	issued by the naturopath or twelve months of prescribing, whichever occurs first. The
21	21	supervising physician shall possess an unencumbered license and have been
22	22	prescribing and administering prescription drugs without limitation for at least five
23	23	years in the state. The supervising physician shall evaluate the naturopath's ability to
24	24	safely prescribe and administer prescription drugs within the naturopath's scope of
25	25	practice and to comply with federal and state laws. The written collaborative
26	26	agreement must address the requirements of this subsection and be provided to the
27	27	board along with the application for endorsement. The board, by rule, further shall
28	28	define the terms of the supervising physician's role in reviewing the naturopath's
29	29	prescribing practices.
30	30	3.A naturopath who satisfies the requirements of subsection 2 shall notify the board in
31	31	writing with verification from the supervising physician that this requirement has been

60	60	met. Upon verification subsection 2 has been met, and the naturopath successfully
61	61	completed the pharmacology elective examination approved by the board, the board
62	62	shall issue the naturopath an endorsement to prescribe independently.The board shall
63	63	issue the naturopath an endorsement to prescribe independently upon verification that
64	64	subsection 2 has been met and the naturopath provides satisfactory proof of one of
65	65	the following options within one year from completion of subsection 2 unless otherwise
66	66	approved by the board for good cause shown:
67	67	a.Completion of the pharmacology elective examination approved by the board;
68	68	b.Completion of twelve months of clinical experience in naturopathic medicine in a
69	69	residency program recognized by the board and associated with an accredited
70	70	school or college of naturopathic medicine, and under the preceptorship of a
71	71	licensed naturopathic doctor or physician; or
72	72	c.Substantial experience in prescribing prescription medications for three years
73	73	without discipline in another jurisdiction as verified by a physician or facility.
74	74	4.The board may waive the requirements of subsection 2 and examination under
75	75	subsection 3subsections 2 and 3 if a naturopath shows the naturopath has substantial
76	76	experience in prescribing prescription medications under the laws of another
77	77	jurisdiction that has standards and qualifications for a naturopath to prescribe
78	78	prescription medications at least equal to those required under this chapter.
79	79	5.To maintain the endorsements provided under this section, the naturopath shall obtain
80	80	five hours of continuing education hours annually regarding pharmacology of
81	81	testosterone and legend drugs.
