8	8	A BILL for an Act to create and enact a new chapter to title 15 of the North Dakota Century
9	9	Code, relating to the creation of the army forces reserve component scholarship program.
10	10	BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
11	11	SECTION 1. A new chapter to title 15 of the North Dakota Century Code is created and
12	12	enacted as follows:
13	13	Definitions.
14	14	For purposes of this chapter:
15	15	1."Active duty" means full-time service pursuant to an executive order of the president of
16	16	the United States or the governor or an act of the congress of the United States.
17	17	2."Institution of higher education" means an institution at which the applicant is enrolled
18	18	in:
19	19	a.A degree-granting program, whether the institution is under the control of the
20	20	state board of higher education or privately controlled;
21	21	b.An in - state nursing education program approved by the North Dakota board of
22	22	nursing; or
23	23	c.A program for a high - demand occupation identified under subsection 3 of section
24	24	15 - 10 - 38.1.
25	25	Army forces reserve component scholarship program - State board of higher
26	26	education.
27	27	1.The state board of higher education shall:
28	28	a.Administer the army forces reserve component scholarship program.
29	29	b.Approve all eligible applicants.
30	30	c.Process applications for the scholarship in the order received.
31	31	d.Provide scholarships regardless of the financial need of the applicant.

60	60	2.The board may not grant priority to an applicant based on sex, race, or religion.
61	61	Eligible applicant - Eligibility units.
62	62	1.An eligible applicant:
63	63	a.Is a member of a reserve component of the United States army, navy, marine
64	64	corps, air force, coast guard, or space force in the state;
65	65	b.Is enrolled as a full-time student at an institution of higher education;
66	66	c.Does not possess a baccalaureate degree; and
67	67	d.Has not received financial assistance under chapters 37 - 07.1 or 37 - 07.2.
68	68	2.An individual who is discharged from a branch of the armed forces under other than
69	69	honorable conditions is not eligible for a scholarship under this chapter.
70	70	3.A recipient of the scholarship may receive a scholarship for no more than forty-eight
71	71	eligibility units.
72	72	4.For purposes of this section, twelve or more credit hours in an academic term equals:
73	73	a.Twelve eligibility units, if the term is a semester.
74	74	b.Eight eligibility units, if the term is a quarter.
75	75	Scholarship amounts.
76	76	1.Subject to legislative appropriations, the state board of higher education shall pay on
77	77	behalf of an eligible applicant:
78	78	a.An amount equal to one hundred percent of the tuition charged by the institution,
79	79	if an eligible applicant is enrolled at an institution of higher education under the
80	80	control of the state board of higher education; or
81	81	b.The lesser of an amount equal to:
82	82	(1)One hundred percent of the tuition charged by the institution; or
83	83	(2)The average tuition of all institutions of higher education under the control of
84	84	the state board of higher education.
85	85	2.The state board of higher education may require:
86	86	a.An applicant to apply for federal educational financial assistance programs,
87	87	including programs offered by the United States department of defense, for which
88	88	an applicant is eligible based on the applicant's military service.

120	120	b.Other financial assistance received by a scholarship recipient be applied to
121	121	eligible expenses before scholarship funds awarded under this section may be
122	122	applied to the remaining eligible expenses of the recipient.
123	123	Active duty - Effects.
124	124	If an eligible applicant is called to active duty and as a result withdraws or otherwise fails to
125	125	complete courses for which scholarships have been awarded under this chapter:
126	126	1.The institution of higher education shall grant the individual a leave of absence from
127	127	the individual's education program and may not impose an academic penalty for
128	128	withdrawal or failure to complete courses.
129	129	2.If a scholarship for the courses has already been paid, the state board of higher
130	130	education:
131	131	(a)May not add the eligibility units for the term to the individual's accumulated
132	132	eligibility units, and the institution of higher education shall repay the scholarship
133	133	amount to the state; or
134	134	(b)Shall add the eligibility units for the term to the individual's accumulated eligibility
135	135	units as usual, if the institution of higher education agrees to allow the individual
136	136	to complete the remainder of the courses in which the individual was enrolled at
137	137	the time the individual was called to active duty.
138	138	State board of higher education - Rules.
139	139	The state board of higher education may adopt rules pursuant to chapter 28 - 32 necessary
140	140	to implement and administer this chapter.
