LB 323 as amended by AM554 would require the Nebraska Department of Transportation (NDOT) to:
1) Publish notices of upcoming bid solicitation opport unities both in an official county newspaper where the work wou ld be
performed and on an NDOT officially designated webpage;
2) Make known the bid solicitation notices on the webpage starting at least 20 days before the bidding deadline;
3) Advertise the bid s olicitation notices once a week for three consecutive weeks in the official county newspaper;
4) Ensure the location of the project is id entified in the publishe d notice;
5) Mandate the newspaper notices contain the NDOT officially designated webpage; and
6) Get the consent of the Legislature for building construction projects with an estimated cost greater than the adjusted dollar
amount established for capital construction projects in Nebraska §81-1114, while allowing NDOT to carry out projects under
this adjusted dollar amount wi thout Legislative consent.
NDOT has indicated no anti cipated fiscal impact.
There is no basis to disagree with NDOT ’s estimation.

Explanation of Estimate:
LB323 AM554 introduces a requirement for the Department of Transportation (NDOT) to publish notices for
sealed bids on an official webpage, in addition to a publication in the local newspaper . Additionally, the bill
also amends Neb. Rev. Stat. §39-1355 allowing NDOT the authority to construct buildings without legislative
approval, provided the estimated cost does not exceed the adjusted limit for capital construction projects as
specified in section 81-1114.
No fiscal impact is anticipated to the Department of Transportation.
