The bill amends § 30-2602.02 to provide that an individual nominated for appointment as a guardian or conservator must allow the Nebraska State Patrol to perform a background check on the individual using the Federal Bureau of Investigation national background check system. The Nebraska State Patrol must then provide the State Court Administrator with a report containing the individual’s criminal history record. The applicant must pay the actual cost of the fingerprinting and background check. Current law provides that such nominated individual obtain a national criminal history record check through a process approved by the State Court Administrator and also obtain and file a report of the results. LB 453 also amends §§ 30-2626 and 30-2630.01 to harmonize changes made to § 30-2602.02. Existing law exempts temporary guardians and conservators from providing the background check and report required under § 30-2602.02.
