LB7 makes the following amendments to the Foreign- owned Real Estate National Security Act :
- Adds definitions for f oreign government, Indian tribe, and person under the act ;
- Restricts foreign corporations or any nonresident alien from holding or operating lea ses for oil, gas, or other hydrocarbon
substance, and provides exemptions;
- Clarifies that restricted entities under the act do not include entities which have been determined by the Committee on Foreign
Investment in the United States that there are no unresolved national security concerns; and
- Requires the court to order the Attorney General or retained outside counsel to promptly notify the Governor and Leg islature of
real estate ordered to b e divested by the court under the act.
No fiscal impact.
Technical note: Sec . 8, 7(c) does not specify whom within the Legislature the Attorney General is to promptly notify. Our office assumes
a Committee of Jurisdiction or Clerk of the Legislature.
