STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty Five

AN ACTrelative to hazardous waste accident fees.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1  Nonpayment Fees for Hazardous Materials Accidents.  RSA 154:8-a, II-a(h) is repealed and reenacted to read as follows:

(h)  A penalty of no greater than $1,000 per day shall be paid to the claimant for each day of nonpayment beyond 90 days.  The cumulative penalty imposed shall not exceed 25 percent of the cost established under subparagraph (a).  As long as the responsible party adheres to a payment plan that has been established between the claimant and the responsible party, no additional daily penalty shall be imposed.

2  Effective Date.  This act shall take effect January 1, 2026.

METHODOLOGY:

This bill changes the fee for nonpayment of hazardous materials or waste accident expenses to $1,000 per day after 90 days of nonpayment, with cumulative penalty not exceeding 100 percent of the cost established in RSA 154:8-a, II-a (a).

If a party liable for costs related to a hazardous materials or waste discharge or accident under RSA 154:8-a does not pay within 90 days, there may be addition fine revenue to a municipality in which the discharge occurred to reimburse the municipality for emergency response, mitigation and legal  costs.  The impact on local revenue is interminable as it is unknown how many of such accidents may occur and when the liable party will pay for the costs incurred.

The Department of Safety states this bill will have no impact on the Department.
