SYNOPSIS

     Permits certain municipalities to impose stranded nuclear waste fee.

 An Act authorizing certain municipalities to impose a stranded nuclear waste fee and supplementing Title 40 of the Revised Statutes.        Be It Enacted by the Senate and General Assembly of the State of New Jersey:        1.  As used in P.L.     , c.     (C.        ) (pending before the Legislature as this bill):      "Decommissioned nuclear power plant" means a nuclear power plant that has ceased generating electricity and stores spent nuclear fuel onsite.      "Eligible municipality" means a municipality in which there is located a decommissioned nuclear power plant.      "Spent nuclear fuel" means fuel that has been withdrawn from a nuclear reactor following irradiation, the constituent elements of which have not been separated by reprocessing.        2.  a.  The governing body of an eligible municipality, by ordinance, may impose a stranded nuclear waste fee on the owner of a decommissioned nuclear power plant, calculated pursuant to the provisions of subsection b. of this section, for each calendar year.  The ordinance shall set the fee per kilogram of spent nuclear fuel to be charged pursuant to this section.  The fee shall not exceed $15.00 per kilogram.      b.  The amount of the annual fee shall be equal to the number of kilograms of spent nuclear fuel stored at the decommissioned nuclear power plant multiplied by the fee per kilogram established in the ordinance approved by the governing body of the eligible municipality pursuant to subsection a. of this section.      c.  The annual fee permitted to be imposed by this section shall be used by the eligible municipality solely to reduce the municipal property tax levy.        3.  This act shall take effect immediately     STATEMENT        This bill would permit the governing body of a municipality in which there is located a decommissioned nuclear power plant in which spent nuclear fuel is stored, by ordinance, to impose a stranded nuclear waste fee on the owner of the decommissioned nuclear power plant for every calendar year in which spent nuclear fuel is stored in the decommissioned nuclear power plant.      The amount of the annual fee would be equal to the number of kilograms of spent nuclear fuel stored at the decommissioned nuclear power plant multiplied by the fee per kilogram established in the ordinance.  The fee per kilogram could not exceed $15.      The use of the annual fee would be limited to reducing the municipal property tax levy.
