4949 RELATING TO FIREARMS; PROHIBITING LARGE-CAPACITY MAGAZINES;
5050 PROHIBITING ASSAULT WEAPONS; PROVIDING PENALTIES.
5151 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5252 SECTION 1. A new section of Chapter 30, Article 7 NMSA
5353 1978 is enacted to read:
5454 "[NEW MATERIAL] RESTRICTIONS ON LARGE-CAPACITY
5555 MAGAZINES.--
5656 A. A person shall not possess, manufacture,
5757 purchase, sell or transfer any large-capacity ammunition
5858 feeding device regardless of whether the device is attached to
5959 a firearm. This section shall not apply to magazines
6060 originally designed to accept more than ten rounds of
6161 ammunition that have been modified to accept no more than ten
6262 rounds and that are not capable of being readily restored to a

9191 B. For the purposes of this section, "large-
9292 capacity ammunition feeding device" means a magazine, belt,
9393 drum, feed strip or similar device that has a capacity of, or
9494 that can be readily restored or converted to accept, more than
9595 ten rounds of ammunition. "Large-capacity ammunition feeding
9696 device" shall not include an attached tubular device designed
9797 to accept, and capable of operating only with, .22 caliber
9898 rimfire ammunition.
9999 C. Any person who may not lawfully possess a large-
100100 capacity magazine commencing July 1, 2023 shall, prior to July
101101 1, 2023:
102102 (1) remove the large-capacity magazine from
103103 the state;
104104 (2) sell the large-capacity magazine to a
105105 licensed firearms dealer; or
106106 (3) surrender the large-capacity magazine to a
107107 law enforcement agency for destruction.
108108 D. Any person who violates the provisions of this
109109 section is guilty of a fourth degree felony."
110110 SECTION 2. A new section of Chapter 30, Article 7 NMSA
111111 1978 is enacted to read:
112112 "[NEW MATERIAL] RESTRICTIONS ON ASSAULT WEAPONS.--
113113 A. As used in this section:
114114 (1) "assault weapon" means any:

143143 (a) semi-automatic rifle that has the
144144 capacity to accept a detachable magazine and has one or more of
145145 the following: 1) a pistol grip or thumbhole stock; 2) any
146146 feature capable of functioning as a protruding grip that can be
147147 held by the non-trigger hand; 3) a folding or telescoping
148148 stock; or 4) a shroud attached to the barrel, or that partially
149149 or completely encircles the barrel, allowing the bearer to hold
150150 the firearm with the non-trigger hand without being burned, but
151151 excluding a slide that encloses the barrel;
152152 (b) semi-automatic pistol or any semi-
153153 automatic, centerfire or rimfire rifle with a fixed magazine
154154 that has the capacity to accept more than ten rounds of
155155 ammunition;
156156 (c) semi-automatic pistol that has the
157157 capacity to accept a detachable magazine and has one or more of
158158 the following: 1) any feature capable of functioning as a
159159 protruding grip that can be held by the non-trigger hand; 2) a
160160 folding, telescoping or thumbhole stock; 3) a shroud attached
161161 to the barrel, or that partially or completely encircles the
162162 barrel, allowing the bearer to hold the firearm with the non-
163163 trigger hand without being burned, but excluding a slide that
164164 encloses the barrel; or 4) the capacity to accept a detachable
165165 magazine at any location outside of the pistol grip;
166166 (d) semi-automatic shotgun that has one
167167 or more of the following: 1) a pistol grip or thumbhole stock;

196196 2) any feature capable of functioning as a protruding grip that
197197 can be held by the non-trigger hand; 3) a folding or
198198 telescoping stock; 4) a fixed magazine capacity in excess of
199199 five rounds; or 5) an ability to accept a detachable magazine;
200200 (e) shotgun with a revolving cylinder;
201201 or
202202 (f) conversion kit, part or combination
203203 of parts from which an assault weapon can be assembled if those
204204 parts are in the possession or under the control of the same
205205 person; and
206206 (2) "assault weapon" does not include any
207207 firearm that has been made permanently inoperable.
208208 B. A person shall not manufacture, import, possess,
209209 purchase, sell or transfer any assault weapon.
210210 C. Subsection B of this section shall not apply to:
211211 (1) any government officer, agent or employee,
212212 a member of the armed forces of the United States or a peace
213213 officer to the extent that such person is otherwise authorized
214214 to acquire or possess an assault weapon and does so while
215215 acting within the scope of that person's duties;
216216 (2) the manufacture of an assault weapon by a
217217 firearms manufacturer for the purpose of sale to any branch of
218218 the armed forces of the United States or to a law enforcement
219219 agency in the state for use by that agency or its employees;
220220 provided that the manufacturer is properly licensed under

250250 (3) the sale or transfer of an assault weapon
251251 by a dealer that is properly licensed under federal, state and
252252 local laws to any branch of the armed forces of the United
253253 States or to a law enforcement agency in the state for use by
254254 that agency or its employees for law enforcement purposes.
255255 D. Any person who may not lawfully possess an
256256 assault weapon commencing July 1, 2023 shall, prior to July 1,
257257 2023:
258258 (1) remove the assault weapon from the state;
259259 (2) render the assault weapon permanently
260260 inoperable; or
261261 (3) surrender the assault weapon to the
262262 appropriate law enforcement agency for destruction.
263263 E. Any person who violates the provisions of this
264264 section is guilty of a fourth degree felony."
