4949 AN ACT
5050 RELATING TO CRIME; PROVIDING THAT EACH ANIMAL STOLEN BY A
5151 PERSON CONSTITUTES A SEPARATE OFFENSE OF LIVESTOCK LARCENY.
5252 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5353 SECTION 1. Section 30-16-1 NMSA 1978 (being Laws 1963,
5454 Chapter 303, Section 16-1, as amended) is amended to read:
5555 "30-16-1. LARCENY.--
5656 A. Larceny consists of the stealing of anything of
5757 value that belongs to another.
5858 B. Whoever commits larceny when the value of the
5959 property stolen is two hundred fifty dollars ($250) or less is
6060 guilty of a petty misdemeanor.
6161 C. Whoever commits larceny when the value of the
6262 property stolen is over two hundred fifty dollars ($250) but

9292 D. Whoever commits larceny when the value of the
9393 property stolen is over five hundred dollars ($500) but not
9494 more than two thousand five hundred dollars ($2,500) is guilty
9595 of a fourth degree felony.
9696 E. Whoever commits larceny when the value of the
9797 property stolen is over two thousand five hundred dollars
9898 ($2,500) but not more than twenty thousand dollars ($20,000) is
9999 guilty of a third degree felony.
100100 F. Whoever commits larceny when the value of the
101101 property stolen is over twenty thousand dollars ($20,000) is
102102 guilty of a second degree felony.
103103 G. Whoever commits larceny when the property of
104104 value stolen is livestock is guilty of a third degree felony
105105 regardless of its value; provided that the theft of multiple
106106 livestock shall constitute a separate offense for each
107107 individual animal stolen .
108108 H. Whoever commits larceny when the property of
109109 value stolen is a firearm is guilty of a fourth degree felony
110110 when its value is less than two thousand five hundred dollars
111111 ($2,500)."
