49	49	RELATING TO CANNABIS PRODUCT SAFETY; CLARIFYING CANNABIS
50	50	PACKAGING REQUIREMENTS PERTAINING TO CHILDREN'S SAFETY.
51	51	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
52	52	SECTION 1. Section 26-2C-17 NMSA 1978 (being Laws 2021
53	53	(1st S.S.), Chapter 4, Section 17) is amended to read:
54	54	"26-2C-17. CANNABIS PRODUCTS--PACKAGING AND
55	55	LABELING--DIVISION RULEMAKING.--
56	56	A. Cannabis or cannabis extract included in a
57	57	cannabis product that is manufactured in compliance with
58	58	applicable law is not considered to be an adulterant under
59	59	state law.
60	60	B. The division shall promulgate rules consistent
61	61	with industry standards for cannabis products that establish
62	62	labeling and packaging requirements, including that:

90	90	(1) packages shall be opaque , resealable,
91	91	child-resistant, compostable and recyclable or made from
92	92	recycled materials;
93	93	(2) packages and labels shall not be designed
94	94	to be appealing to a child and shall not mimic the brand,
95	95	design, name, logo or colorway of a non-cannabis consumer
96	96	product of the type that is safe for child consumption;
97	97	(3) packages and labels shall not use cartoons
98	98	or symbols or images, including celebrity or celebrity
99	99	likeness, that are commonly used to market to minors; and
100	100	[(3)] (4) labels shall include:
101	101	(a) for a package containing only
102	102	cannabis leaf or flower, the net weight of cannabis in the
103	103	package;
104	104	(b) identification of the licensee or
105	105	licensees that produced or manufactured the cannabis product,
106	106	the date on which the cannabis was harvested, the type of
107	107	cannabis product and the date on which the cannabis product was
108	108	manufactured and packaged;
109	109	(c) potency and pesticide use;
110	110	(d) a list of pharmacologically active
111	111	ingredients;
112	112	(e) for cannabis products containing
113	113	non-cannabis ingredients, a list of all ingredients and a
114	114	disclosure of nutritional information for the product or

143	143	cannabis extract disclosed in the same manner required under
144	144	federal law for nutritional labeling for food for human
145	145	consumption;
146	146	(f) a warning if nuts or other known
147	147	allergens are used in the item or in its manufacture;
148	148	(g) a logo designed by the division that
149	149	is distinctive in design, color, size and location such that
150	150	the logo notifies a reasonable person that the package contains
151	151	cannabis;
152	152	(h) a warning, including a pictorial
153	153	representation, that the cannabis product is not safe for child
154	154	consumption;
155	155	[(h)] (i) a warning of possible adverse
156	156	effects of consumption and the New Mexico poison and drug
157	157	information center phone number;
158	158	[(i)] (j) an expiration date; and
159	159	[(j)] (k) other information as required
160	160	by rules promulgated pursuant to the Cannabis Regulation Act."
161	161	SECTION 2. EFFECTIVE DATE.--The effective date of the
162	162	provisions of this act is August 1, 2023.
