49	49	RELATING TO CHILDREN; REVISING THE PREFERRED PLACEMENT OF
50	50	CHILDREN IN TEMPORARY CUSTODY.
51	51	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
52	52	SECTION 1. Section 32A-4-8 NMSA 1978 (being Laws 1993,
53	53	Chapter 77, Section 102, as amended) is amended to read:
54	54	"32A-4-8. PLACE OF TEMPORARY CUSTODY.--
55	55	A. Unless a child alleged to be neglected or abused
56	56	is also alleged or adjudicated delinquent:
57	57	(1) the child shall not be held in a jail or
58	58	other facility intended or used for the incarceration of adults
59	59	charged with criminal offenses or for the detention of children
60	60	alleged to be delinquent children; and
61	61	(2) there shall be a preference that the child
62	62	be placed in the home of a relative of the child when a

90	90	relative is available to provide foster care; provided that:
91	91	(a) placement with a relative is in the
92	92	best interest of the child;
93	93	(b) the relative signs a sworn statement
94	94	that the relative will not return the child to or allow
95	95	unsupervised visits with the parent, guardian or custodian who
96	96	is alleged to have committed the abuse or neglect, unless
97	97	otherwise directed by the department or the court; and
98	98	(c) within three days of accepting
99	99	custody of the child, the relative completes an application
100	100	form for licensure to operate a foster home pursuant to the
101	101	Children's Code.
102	102	B. The department shall make reasonable efforts to
103	103	locate a relative of the child to provide foster care. If a
104	104	relative is not available to provide foster care, [the child
105	105	may be placed in:
106	106	(1) a licensed foster home or any home
107	107	authorized under the law for the provision of foster care or
108	108	group care or use as a protective residence;
109	109	(2) a facility operated by a licensed child
110	110	welfare services agency; or
111	111	(3) a facility provided for in the Children's
112	112	Shelter Care Act] the child's preferred order of placement is:
113	113	(1) fictive kin;
114	114	(2) licensed family foster care;

144	144	(4) a group home or congregate care setting;
145	145	or
146	146	(5) a residential treatment facility.
147	147	C. Absent evidence to the contrary, a court may
148	148	presume that continuation of the child's placement with the
149	149	child's current caregivers is in the child's best interests.
150	150	D. A foster parent or fictive kin caregiver with
151	151	whom the child has resided for six months or more is a person
152	152	who has a significant relationship with the child ."
