4949 RELATING TO CHILDREN; REVISING THE PREFERRED PLACEMENT OF
5050 CHILDREN IN TEMPORARY CUSTODY.
5151 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5252 SECTION 1. Section 32A-4-8 NMSA 1978 (being Laws 1993,
5353 Chapter 77, Section 102, as amended) is amended to read:
5454 "32A-4-8. PLACE OF TEMPORARY CUSTODY.--
5555 A. Unless a child alleged to be neglected or abused
5656 is also alleged or adjudicated delinquent:
5757 (1) the child shall not be held in a jail or
5858 other facility intended or used for the incarceration of adults
5959 charged with criminal offenses or for the detention of children
6060 alleged to be delinquent children; and
6161 (2) there shall be a preference that the child
6262 be placed in the home of a relative of the child when a

9090 relative is available to provide foster care; provided that:
9191 (a) placement with a relative is in the
9292 best interest of the child;
9393 (b) the relative signs a sworn statement
9494 that the relative will not return the child to or allow
9595 unsupervised visits with the parent, guardian or custodian who
9696 is alleged to have committed the abuse or neglect, unless
9797 otherwise directed by the department or the court; and
9898 (c) within three days of accepting
9999 custody of the child, the relative completes an application
100100 form for licensure to operate a foster home pursuant to the
101101 Children's Code.
102102 B. The department shall make reasonable efforts to
103103 locate a relative of the child to provide foster care. If a
104104 relative is not available to provide foster care, [the child
105105 may be placed in:
106106 (1) a licensed foster home or any home
107107 authorized under the law for the provision of foster care or
108108 group care or use as a protective residence;
109109 (2) a facility operated by a licensed child
110110 welfare services agency; or
111111 (3) a facility provided for in the Children's
112112 Shelter Care Act] the child's preferred order of placement is:
113113 (1) fictive kin;
114114 (2) licensed family foster care;

143143 (3) therapeutic foster care;
144144 (4) a group home or congregate care setting;
145145 or
146146 (5) a residential treatment facility.
147147 C. Absent evidence to the contrary, a court may
148148 presume that continuation of the child's placement with the
149149 child's current caregivers is in the child's best interests.
150150 D. A foster parent or fictive kin caregiver with
151151 whom the child has resided for six months or more is a person
152152 who has a significant relationship with the child ."
