5757 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5858 SECTION 1. [NEW MATERIAL] SHORT TITLE.--This act may be
5959 cited as the "Meat Inspection Act".
6060 SECTION 2. [NEW MATERIAL] DEFINITIONS.--As used in the
6161 Meat Inspection Act:
6262 A. "board" means the New Mexico livestock board;
6363 B. "food additive" means a substance, the intended

9191 use of which results, or may reasonably be expected to result,
9292 directly or indirectly, in the substance becoming a component
9393 of or otherwise affecting the characteristics of food; provided
9494 that the substance is not generally recognized, among experts
9595 qualified by scientific training and experience to evaluate the
9696 substance's safety, as having been adequately shown through
9797 scientific procedures, or experience based on common use in
9898 food, to be safe under the conditions of its intended use; and
9999 further provided that "food additive" does not include:
100100 (1) a pesticide chemical residue in or on a
101101 raw agricultural commodity or processed food;
102102 (2) a pesticide chemical;
103103 (3) a color additive;
104104 (4) a substance used in accordance with a
105105 sanction or approval granted prior to the enactment of the
106106 federal Poultry Products Inspection Act or the federal Meat
107107 Inspection Act of 1907;
108108 (5) a new animal drug; or
109109 (6) an ingredient intended for use in a
110110 dietary supplement;
111111 C. "inspection director" means the director of the
112112 office of the meat and poultry inspection director;
113113 D. "livestock" means cattle, sheep, swine, goats,
114114 horses, mules or other equines, whether alive or dead;
115115 E. "livestock product" means a livestock carcass or

144144 part of a livestock carcass, meat or a livestock meat product;
145145 F. "meat" means the edible flesh of livestock,
146146 poultry, birds or animals as usually sold for human consumption
147147 and includes livestock and poultry products;
148148 G. "meat product" means a product capable of use as
149149 human food that is wholly or partially made from meat and is
150150 not specifically exempted by rules of the board;
151151 H. "official establishment" means an establishment
152152 granted state meat inspection services by the board where
153153 inspection of the slaughter of livestock or poultry or the
154154 preparation of meat products is maintained pursuant to the Meat
155155 Inspection Act;
156156 I. "pesticide chemical" has the same meaning as set
157157 forth in the Federal Food, Drug, and Cosmetic Act;
158158 J. "poultry" means a domesticated bird, whether
159159 alive or dead;
160160 K. "poultry product" means a poultry carcass or
161161 part of a poultry carcass or a product that is made wholly or
162162 in part from a poultry carcass or part of a poultry carcass and
163163 is not specifically exempted by rules of the board;
164164 L. "prepared" means slaughtered, canned, salted,
165165 stuffed, rendered, boned, cut up or otherwise manufactured or
166166 processed;
167167 M. "raw agricultural commodity" means food in its
168168 raw or natural state, including all fruits that are washed,

198198 prior to marketing; and
199199 N. "state meat inspection services" means
200200 inspection services granted by the board to a slaughtering
201201 establishment, meat processor or manufacturer of meat products.
202202 SECTION 3. [NEW MATERIAL] OFFICE CREATED--DUTIES--
203203 QUALIFICATIONS--COMPENSATION.--
204204 A. The "office of the meat and poultry inspection
205205 director" is created under the board, subject to the control
206206 and direction of the executive director of the board. The
207207 board shall appoint an inspection director who meets the
208208 requirements established by the board.
209209 B. The inspection director shall supervise the
210210 state meat inspection program and enforce and carry out the
211211 provisions of the Meat Inspection Act to assure the public that
212212 only pure, wholesome and unadulterated meat and meat products
213213 are offered for sale.
214214 C. Upon approval by the inspection director, the
215215 board shall appoint and fix salaries of veterinary meat
216216 inspectors and lay meat inspectors, subject to the provisions
217217 of the Personnel Act, who shall conduct ante-mortem and
218218 post-mortem inspections, enforce sanitary requirements, perform
219219 other duties necessary to conduct proper meat inspection and
220220 carry out the provisions of the Meat Inspection Act.

251251 establishment nor have a financial interest in the
252252 establishment.
253253 E. Each inspector shall take the oath of office.
254254 SECTION 4. [NEW MATERIAL] APPLICATION FOR STATE MEAT
255255 INSPECTION SERVICES--PERIODIC INSPECTIONS--INSPECTION STAMPS
256256 AND ESTABLISHMENT NUMBERS.--
257257 A. A slaughtering establishment, meat processor or
258258 manufacturer of meat products seeking state meat inspection
259259 services shall submit a written application to the board
260260 through a process established by the board.
261261 B. The board shall provide for periodic
262262 investigations of the sanitary conditions of each official
263263 establishment and withdraw or otherwise refuse to grant state
264264 meat inspection services and inspect those establishments where
265265 the sanitary conditions are such as to render adulterated meat
266266 prepared or handled therein.
267267 C. The office of the meat and poultry inspection
268268 director shall inspect the applicant's facilities to determine
269269 if they are clean and sanitary and meet the requirements of the
270270 Meat Inspection Act. Upon determination, the inspection
271271 director shall recommend approval or disapproval of the
272272 application to the board. The board may adopt the
273273 recommendation of the inspection director. If an application
274274 is approved, the board shall assign an official establishment

303303 number to the establishment to be used in accordance with the
304304 Meat Inspection Act.
305305 D. The board shall provide meat inspection stamps
306306 that contain the words "New Mexico Inspected and Passed" and
307307 "New Mexico Inspected and Condemned" and assign establishment
308308 numbers to:
309309 (1) slaughtering establishments that have been
310310 approved and granted state meat inspection services by the
311311 board; and
312312 (2) meat processors and manufacturers of meat
313313 products that have been approved in accordance with the
314314 requirements of the Meat Inspection Act.
315315 E. The board shall design inspection stamps so as
316316 not to be in conflict with the inspection stamps of the United
317317 States department of agriculture.
318318 F. An official establishment may use symbols of the
319319 inspection stamps on its processed meats and meat products
320320 offered for sale so long as they are in compliance with the
321321 provisions of the Meat Inspection Act.
322322 G. Meat inspection stamps shall at all times be
323323 under the immediate jurisdiction of the inspection director.
324324 SECTION 5. [NEW MATERIAL] ASSIGNMENT OF INSPECTORS.--
325325 A. A slaughtering establishment granted state meat
326326 inspection services shall notify the inspection director of its
327327 hours of slaughter, and the inspection director shall assign

356356 inspectors to the establishment. The inspection director may
357357 assign one inspector to conduct inspection at two or more
358358 slaughtering establishments that have state meat inspection
359359 services. The hours of the day and the days of the week shall
360360 be arranged with the slaughtering establishments to ensure that
361361 an inspector is present at each establishment during all
362362 periods of slaughter.
363363 B. A slaughtering establishment may slaughter in
364364 excess of eight hours in one day or slaughter on holidays or
365365 Sundays, and the inspection director shall assign an inspector
366366 to conduct meat inspection at those times. A slaughtering
367367 establishment shall pay overtime fees to the board when the
368368 board provides inspection services in excess of eight hours in
369369 one day or on holidays or Sundays. A slaughtering
370370 establishment that has state meat inspection services is not
371371 permitted to slaughter poultry, cattle, sheep, swine or goats
372372 unless there is an assigned inspector on the premises of the
373373 establishment during all periods of slaughter.
374374 SECTION 6. [NEW MATERIAL] ANTE- AND POST-MORTEM
375375 INSPECTION REQUIRED.--
376376 A. A slaughtering establishment that has state meat
377377 inspection services shall have an ante-mortem inspection. The
378378 inspector assigned to the slaughtering establishment shall
379379 examine each animal immediately prior to slaughter for the
380380 purpose of eliminating all unfit animals and segregating, for

410410 affected with a condition that might influence disposition on
411411 post-mortem inspection. The unfit animals shall not be
412412 permitted to enter the slaughtering department of the plant.
413413 The suspected animals that are permitted to be slaughtered
414414 after inspection shall be handled separately from the regular
415415 kill and given a special post-mortem examination.
416416 B. A slaughtering establishment that has state meat
417417 inspection services shall have a post-mortem inspection. The
418418 post-mortem examination shall be made at the time the animals
419419 are slaughtered. The inspector shall perform a thorough
420420 examination of the carcass and parts thereof in accordance with
421421 the rules promulgated by the board. The examination shall be
422422 conducted in the slaughtering department of the plant during
423423 the slaughtering operations.
424424 C. The inspection director or any of the inspection
425425 director's inspectors shall have the laboratory of the board or
426426 a laboratory designated by the board conduct pathogenic
427427 examination of animals or parts thereof for completion of
428428 ante-mortem or post-mortem inspection.
429429 SECTION 7. [NEW MATERIAL] OFFICIAL ESTABLISHMENT DUTIES--
430430 RECORDS--PLANS--REASSESSMENTS.--An official establishment
431431 shall:
432432 A. conduct ante-mortem and post-mortem inspections,
433433 quarantines, segregation and reinspections with respect to the

462462 slaughter of livestock and poultry and the preparation of
463463 livestock and poultry products;
464464 B. inspect livestock and poultry and mark and label
465465 meat products as "New Mexico Inspected and Condemned" if the
466466 products are found upon inspection to be adulterated and "New
467467 Mexico Inspected and Passed" if they are found upon inspection
468468 not to be adulterated;
469469 C. destroy meat products that have been marked "New
470470 Mexico Inspected and Condemned";
471471 D. maintain full and complete records of all
472472 transactions involving meat and make the records available on
473473 request to the inspection director or the inspection director's
474474 inspectors at any reasonable time;
475475 E. prepare and maintain current procedures for the
476476 recall of meat or meat products produced and shipped by the
477477 establishment;
478478 F. document each reassessment of the process
479479 control plans of the establishment; and
480480 G. upon request, make the procedures and reassessed
481481 process control plans available to inspectors appointed by the
482482 inspection director for review and copying.
483483 SECTION 8. [NEW MATERIAL] CONDEMNATION AND APPEAL.--The
484484 inspector at an official establishment shall condemn all
485485 diseased or otherwise unfit carcasses and parts of carcasses,
486486 including the viscera. The official establishment shall remove

515515 the condemned parts from the slaughtering department of the
516516 plant in equipment designated for that purpose and shall
517517 destroy the condemned parts for food purposes under the
518518 supervision of the inspector. If an official establishment
519519 wishes to appeal a decision of an inspector as to carcasses or
520520 parts of carcasses that have been condemned, the establishment
521521 may appeal the decision to the office of the meat and poultry
522522 inspection director. If the establishment is not satisfied and
523523 wishes to make a further appeal, it may submit an appeal to the
524524 board, whose decision shall be final unless the establishment
525525 aggrieved appeals to the district court pursuant to the
526526 provisions of Section 39-3-1.1 NMSA 1978.
527527 SECTION 9. [NEW MATERIAL] RULES.--
528528 A. The board, upon the recommendation of the
529529 inspection director, shall adopt rules that conform as far as
530530 possible to the requirements of the Federal Meat Inspection
531531 Act, the federal Poultry Products Inspection Act and the
532532 federal Humane Methods of Slaughter Act of 1978. The rules
533533 shall:
534534 (1) set standards for ingredients of meat;
535535 (2) set standards for labeling, marking or
536536 branding meat;
537537 (3) set standards for the weights or measures
538538 of meat;
539539 (4) set standards for the filling of

569569 (5) regulate misbranded, false or fraudulent
570570 advertising of meat; and
571571 (6) prescribe standards relating to sanitation
572572 for official establishments.
573573 B. The board, upon the recommendation of the
574574 inspection director, may:
575575 (1) adopt rules to exempt small meat packages,
576576 meat not in containers and other reasonable variations from
577577 labeling standards for weight, measure or numerical count; and
578578 (2) prescribe additional rules as necessary to
579579 carry out the purposes of the Meat Inspection Act.
580580 SECTION 10. [NEW MATERIAL] ADULTERATED MEAT--MISBRANDED
581581 MEAT AND MEAT PRODUCTS.--
582582 A. Meat or a meat product is adulterated if:
583583 (1) it bears or contains a poisonous or
584584 deleterious substance that may render it injurious to health;
585585 provided that a substance that is not added to meat is not
586586 considered adulterating if the quantity of the substance is
587587 insufficient to ordinarily render it injurious to health;
588588 (2) it bears or contains, by reason of
589589 administration of a substance to the meat, an added poisonous
590590 or added deleterious substance other than a color additive, a
591591 food additive or a pesticide chemical in or on a raw
592592 agricultural commodity, that may, in the board's judgment, make

621621 the meat or meat product unfit for human food;
622622 (3) it is, in whole or in part, a raw
623623 agricultural commodity and bears or contains a pesticide
624624 chemical that is unsafe within the meaning of the Federal Food,
625625 Drug, and Cosmetic Act;
626626 (4) it bears or contains a food additive that
627627 is unsafe within the meaning of the Federal Food, Drug, and
628628 Cosmetic Act;
629629 (5) it bears or contains a color additive that
630630 is unsafe within the meaning of the Federal Food, Drug, and
631631 Cosmetic Act; provided that the meat or meat product that is
632632 not otherwise deemed adulterated under Paragraph (3), (4) or
633633 (5) of this subsection shall be deemed adulterated if use of
634634 the pesticide chemical, food additive or color additive in or
635635 on the meat or meat product is prohibited by rules of the
636636 board;
637637 (6) it consists in whole or in part of a
638638 filthy, putrid or decomposed substance or is for any other
639639 reason unsound, unhealthful, unwholesome or otherwise unfit for
640640 human food;
641641 (7) it has been prepared, packed or held under
642642 unsanitary conditions whereby it may have become contaminated
643643 with filth or rendered injurious to health;
644644 (8) it is, in whole or in part, the product of
645645 an animal, including poultry, that has died otherwise than by

675675 (9) its container is composed, in whole or in
676676 part, of a poisonous or deleterious substance that may render
677677 the contents injurious to health;
678678 (10) it has been intentionally subjected to
679679 radiation, unless the use of the radiation was in conformity
680680 with a regulation or exemption in effect pursuant to the
681681 Federal Food, Drug, and Cosmetic Act; or
682682 (11) a valuable constituent has been, in whole
683683 or in part, omitted or abstracted; or if a substance has been
684684 substituted, wholly or in part; or if damage or inferiority has
685685 been concealed; or if a substance has been added, mixed or
686686 packed to increase its bulk or weight; or reduce its quality or
687687 strength; or make it appear better or of greater value.
688688 B. Meat or a meat product is misbranded:
689689 (1) if the labeling is false or misleading;
690690 (2) if it is offered for sale under the name
691691 of another food;
692692 (3) if it is an imitation of another food,
693693 unless its label bears, in type of uniform size and prominence,
694694 the word "imitation" and immediately after the name of the food
695695 being imitated;
696696 (4) if its container is made, formed or filled
697697 as to be misleading;
698698 (5) unless it bears a label showing:

727727 (a) the name and place of business of
728728 the manufacturer, packer or distributor; and
729729 (b) an accurate statement of the
730730 quantity of the product in terms of weight, measure or
731731 numerical count;
732732 (6) if a word, statement or other information
733733 required by or under the Meat Inspection Act to appear on the
734734 label or other labeling is not prominently placed thereon with
735735 such conspicuousness, as compared with other words, statements,
736736 designs or devices in the labeling, or is not stated in such
737737 terms as to render it likely to be read and understood by the
738738 ordinary individual under customary conditions of purchase and
739739 use;
740740 (7) if it purports to be or is represented as
741741 a food for which a definition and standard of identity or
742742 composition has been prescribed by the rules of the board,
743743 unless:
744744 (a) it conforms to the definition and
745745 standard; and
746746 (b) its label bears the name of the food
747747 specified in the definition and standard and, insofar as may be
748748 required by rule, the common names of optional ingredients,
749749 other than spices, flavoring and coloring, present in the food;
750750 (8) if it purports to be or is represented as
751751 a food for which a standard of fill of container has been

781781 standard, unless the label bears in a manner and form as the
782782 rules specify, a statement that it falls below the standard;
783783 (9) if it is not subject to the provisions of
784784 Paragraph (7) of this subsection and the label does not bear:
785785 (a) the common name of the food; and
786786 (b) in case it is fabricated from two or
787787 more ingredients, the common name of each ingredient; except
788788 that spices, flavorings and colorings may, when authorized by
789789 the board, be designated as spices, flavorings and colorings
790790 without naming each; provided that, to the extent that
791791 compliance with these requirements is impracticable or results
792792 in deception or unfair competition, exemptions shall be
793793 established by rules promulgated by the board;
794794 (10) if it purports to be or is represented
795795 for special dietary uses, unless its label bears information
796796 concerning its vitamin, mineral and other dietary properties,
797797 as the board, after consultation with the secretary of
798798 agriculture of the United States, determines and by rule
799799 prescribes as necessary to fully inform purchasers as to its
800800 value for those uses;
801801 (11) if it bears or contains an artificial
802802 flavoring, artificial coloring or chemical preservative, unless
803803 it bears labeling stating that fact; provided that, to the
804804 extent that compliance with these requirements is

835835 (12) if it fails to bear, directly thereon and
836836 on its containers, as the board may prescribe by rule, the
837837 official inspection legend and establishment number of the
838838 establishment where the product was prepared and other
839839 information as the board may require in rules to ensure that
840840 the meat or meat product does not have false or misleading
841841 labeling and that the public is informed of the manner of
842842 handling required to maintain the meat or meat product in a
843843 wholesome condition.
844844 SECTION 11. [NEW MATERIAL] PROHIBITED ACTS--PENALTY.--
845845 A. Except as provided by the Meat Inspection Act,
846846 it is a:
847847 (1) misdemeanor for a person to:
848848 (a) slaughter livestock or poultry or
849849 prepare livestock products or poultry products for human
850850 consumption in violation of the provisions of the Meat
851851 Inspection Act;
852852 (b) sell or transport adulterated,
853853 misbranded, condemned or uninspected meat;
854854 (c) falsely represent that meat or a
855855 meat product has been inspected and passed or is exempted under
856856 the Meat Inspection Act or board rules or knowingly make a
857857 false statement in a certificate required by board rules;

889889 (e) fail to keep records required by the
890890 Meat Inspection Act;
891891 (f) forge an official device, mark or
892892 certificate;
893893 (g) use, alter, deface, detach or
894894 destroy an official device, mark or certificate without
895895 authorization;
896896 (h) fail to use or fail to detach,
897897 deface or destroy an official device, mark or certificate
898898 contrary to rules prescribed by the board;
899899 (i) knowingly possess a counterfeit
900900 certificate, device or label or the carcass or parts of the
901901 carcass of an animal bearing a counterfeit or improperly
902902 altered official mark; or
903903 (j) buy, sell or transport livestock
904904 products or poultry products not intended for human food unless
905905 the products are naturally inedible by humans or are denatured
906906 or identified as required by rules of the board; and
907907 (2) a fourth degree felony for a person to:
908908 (a) engage in the business of buying,
909909 selling or transporting dead, dying, disabled or diseased
910910 animals or parts of the carcasses of animals that died

940940 dying, disabled or diseased livestock or poultry or the
941941 products of livestock or poultry that died otherwise than by
942942 slaughter unless in accordance with rules adopted by the board
943943 to ensure that the animals or the unwholesome parts or products
944944 of the animals are prevented from being used for human food
945945 purposes; or
946946 (b) engage in unfair trade practices,
947947 inaccurate or deceptive advertising, bait and switch selling or
948948 product misrepresentation or knowingly engage in price
949949 misrepresentation of meat.
950950 B. A person who violates a provision of Paragraph
951951 (1) of Subsection A of this section is guilty of a misdemeanor
952952 and shall be sentenced in accordance with the provisions of
953953 Section 31-19-1 NMSA 1978.
954954 C. A person who violates a provision of Paragraph
955955 (2) of Subsection A of this section is guilty of a fourth
956956 degree felony and shall be sentenced in accordance with the
957957 provisions of Section 31-18-15 NMSA 1978.
958958 SECTION 12. [NEW MATERIAL] EXEMPTIONS.--The following
959959 persons are exempt from the provisions and penalties of the
960960 Meat Inspection Act:
961961 A. a person who slaughters livestock or poultry for
962962 personal or household use or consumption;
963963 B. a person who prepares or processes livestock or

998998 SECTION 13. [NEW MATERIAL] INTERFERENCE WITH BOARD
999999 OFFICIALS AND PERSONNEL.--A person who forcibly assaults,
10001000 resists, opposes, impedes, harasses or intimidates a person
10011001 while engaged in or on account of the performance of official
10021002 duties under the Meat Inspection Act is guilty of a misdemeanor
10031003 and shall be sentenced in accordance with the provisions of
10041004 Section 31-19-1 NMSA 1978.
10051005 SECTION 14. [NEW MATERIAL] COOPERATION WITH THE
10061006 DEPARTMENT OF HEALTH, THE DEPARTMENT OF ENVIRONMENT AND OTHER
10071007 PUBLIC HEALTH AUTHORITIES.--
10081008 A. In carrying out the provisions of the Meat
10091009 Inspection Act, the board and the inspection director shall
10101010 request the advice from and consult with the appropriate
10111011 employees of the department of health, the department of
10121012 environment and state laboratories on matters relating to
10131013 potability of water, sewerage systems and other sanitary
10141014 conditions of slaughtering and meat processing establishments
10151015 that might endanger public health.
10161016 B. In carrying out the provisions of the Meat

10511051 premises. If a department of health or department of
10521052 environment inspector confirms that the official establishment
10531053 fails to meet the minimum requirements of the department of
10541054 health or the department of environment, the board shall notify
10551055 the official establishment that the grant for state meat
10561056 inspection services or assigned establishment number is
10571057 suspended.
10581058 SECTION 15. [NEW MATERIAL] SUSPENSION OR REVOCATION OF
10591059 INSPECTION SERVICES OR ESTABLISHMENT NUMBER--HEARING--APPEAL.--
10601060 A. The board may suspend or revoke a state meat
10611061 inspection services or establishment number for violation of or
10621062 noncompliance with:
10631063 (1) a provision of the Meat Inspection Act;
10641064 (2) a rule issued pursuant to the Meat
10651065 Inspection Act; or
10661066 (3) minimum requirements established by the
10671067 department of health or the department of environment for
10681068 sanitary conditions of slaughtering and meat processing
10691069 establishments.

11001100 hearing before the board upon reasonable notice. The board
11011101 shall provide notice to the official establishment by service
11021102 of the complaint by certified mail, return receipt requested.
11031103 C. A decision of the board is final in a matter
11041104 relating to renewal, suspension or revocation of state meat
11051105 inspection services or establishment numbers unless the person
11061106 aggrieved appeals to the district court pursuant to the
11071107 provisions of Section 39-3-1.1 NMSA 1978.
11081108 SECTION 16. [NEW MATERIAL] POWER TO ENJOIN VIOLATIONS OF
11091109 THE MEAT INSPECTION ACT.--In addition to remedies provided in
11101110 the Meat Inspection Act, the board may apply to the district
11111111 court for a temporary or permanent injunction restraining a
11121112 person from violating a provision of the Meat Inspection Act
11131113 irrespective of whether there exists an adequate remedy at law.
11141114 SECTION 17. [NEW MATERIAL] APPLICATION OF FEDERAL LAWS.--
11151115 The provisions of the Meat Inspection Act apply to persons,
11161116 establishments, animals, meat and meat products regulated under
11171117 the federal Meat Inspection Act, the federal Poultry Products
11181118 Inspection Act and the federal Humane Methods of Slaughter Act
11191119 of 1978 and only to the extent provided for in those acts.
11201120 SECTION 18. [NEW MATERIAL] NOTIFICATION.--An official
11211121 establishment subject to inspection under the Meat Inspection
11221122 Act that has knowledge, or has reason to have knowledge, that

11561156 SECTION 19. [NEW MATERIAL] HUMANE METHODS OF SLAUGHTER--
11571157 RELIGIOUS EXEMPTIONS.--
11581158 A. No method of slaughtering or handling in
11591159 connection with slaughtering shall be deemed to comply with the
11601160 public policy of the Meat Inspection Act unless it is humane.
11611161 The following two methods of slaughtering and handling are
11621162 humane:
11631163 (1) in the case of cattle, calves, sheep,
11641164 swine and other livestock, all animals are rendered insensible
11651165 to pain by a single blow or gunshot or electrical, chemical or
11661166 other means that is rapid and effective before being shackled,
11671167 hoisted, thrown, cast or cut; or
11681168 (2) by ritual slaughter.
11691169 B. Nothing in the Meat Inspection Act shall be
11701170 construed to prohibit, abridge or hinder the religious freedom
11711171 of an individual or group. To protect freedom of religion,
11721172 ritual slaughter and the handling or other preparation of
11731173 livestock for ritual slaughter are exempted from the provisions
11741174 of the Meat Inspection Act.
11751175 C. For the purposes of this section, "ritual
