101 | 101 | | raw agricultural commodity or processed food; |

102 | 102 | | (2) a pesticide chemical; |
---|
103 | 103 | | (3) a color additive; |
---|
104 | 104 | | (4) a substance used in accordance with a |
---|
105 | 105 | | sanction or approval granted prior to the enactment of the |
---|
106 | 106 | | federal Poultry Products Inspection Act or the federal Meat |
---|
107 | 107 | | Inspection Act of 1907; |
---|
108 | 108 | | (5) a new animal drug; or |
---|
109 | 109 | | (6) an ingredient intended for use in a |
---|
110 | 110 | | dietary supplement; |
---|
111 | 111 | | C. "inspection director" means the director of the |
---|
112 | 112 | | office of the meat and poultry inspection director; |
---|
113 | 113 | | D. "livestock" means cattle, sheep, swine, goats, |
---|
114 | 114 | | horses, mules or other equines, whether alive or dead; |

152 | 152 | | granted state meat inspection services by the board where |
---|
153 | 153 | | inspection of the slaughter of livestock or poultry or the |
---|
154 | 154 | | preparation of meat products is maintained pursuant to the Meat |
---|
155 | 155 | | Inspection Act; |
---|
156 | 156 | | I. "pesticide chemical" has the same meaning as set |
---|
157 | 157 | | forth in the Federal Food, Drug, and Cosmetic Act; |
---|
158 | 158 | | J. "poultry" means a domesticated bird, whether |
---|
159 | 159 | | alive or dead; |
---|
160 | 160 | | K. "poultry product" means a poultry carcass or |
---|
161 | 161 | | part of a poultry carcass or a product that is made wholly or |
---|
162 | 162 | | in part from a poultry carcass or part of a poultry carcass and |

202 | 202 | | SECTION 3. [NEW MATERIAL] OFFICE CREATED--DUTIES-- |
---|
203 | 203 | | QUALIFICATIONS--COMPENSATION.-- |
---|
204 | 204 | | A. The "office of the meat and poultry inspection |
---|
205 | 205 | | director" is created under the board, subject to the control |
---|
206 | 206 | | and direction of the executive director of the board. The |
---|
207 | 207 | | board shall appoint an inspection director who meets the |
---|
208 | 208 | | requirements established by the board. |
---|
209 | 209 | | B. The inspection director shall supervise the |
---|
210 | 210 | | state meat inspection program and enforce and carry out the |
---|
211 | 211 | | provisions of the Meat Inspection Act to assure the public that |
---|
212 | 212 | | only pure, wholesome and unadulterated meat and meat products |
---|
213 | 213 | | are offered for sale. |
---|
214 | 214 | | C. Upon approval by the inspection director, the |
---|
215 | 215 | | board shall appoint and fix salaries of veterinary meat |
---|
216 | 216 | | inspectors and lay meat inspectors, subject to the provisions |
---|
217 | 217 | | of the Personnel Act, who shall conduct ante-mortem and |
---|
218 | 218 | | post-mortem inspections, enforce sanitary requirements, perform |
---|
219 | 219 | | other duties necessary to conduct proper meat inspection and |
---|
220 | 220 | | carry out the provisions of the Meat Inspection Act. |

254 | 254 | | SECTION 4. [NEW MATERIAL] APPLICATION FOR STATE MEAT |
---|
255 | 255 | | INSPECTION SERVICES--PERIODIC INSPECTIONS--INSPECTION STAMPS |
---|
256 | 256 | | AND ESTABLISHMENT NUMBERS.-- |
---|
257 | 257 | | A. A slaughtering establishment, meat processor or |
---|
258 | 258 | | manufacturer of meat products seeking state meat inspection |
---|
259 | 259 | | services shall submit a written application to the board |
---|
260 | 260 | | through a process established by the board. |
---|
261 | 261 | | B. The board shall provide for periodic |
---|
262 | 262 | | investigations of the sanitary conditions of each official |
---|
263 | 263 | | establishment and withdraw or otherwise refuse to grant state |
---|
264 | 264 | | meat inspection services and inspect those establishments where |
---|
265 | 265 | | the sanitary conditions are such as to render adulterated meat |
---|
266 | 266 | | prepared or handled therein. |
---|
267 | 267 | | C. The office of the meat and poultry inspection |
---|
268 | 268 | | director shall inspect the applicant's facilities to determine |
---|
269 | 269 | | if they are clean and sanitary and meet the requirements of the |
---|
270 | 270 | | Meat Inspection Act. Upon determination, the inspection |
---|
271 | 271 | | director shall recommend approval or disapproval of the |
---|
272 | 272 | | application to the board. The board may adopt the |
---|
273 | 273 | | recommendation of the inspection director. If an application |
---|

312 | 312 | | (2) meat processors and manufacturers of meat |

313 | 313 | | products that have been approved in accordance with the |
---|
314 | 314 | | requirements of the Meat Inspection Act. |
---|
315 | 315 | | E. The board shall design inspection stamps so as |
---|
316 | 316 | | not to be in conflict with the inspection stamps of the United |
---|
317 | 317 | | States department of agriculture. |
---|
318 | 318 | | F. An official establishment may use symbols of the |
---|
319 | 319 | | inspection stamps on its processed meats and meat products |
---|
320 | 320 | | offered for sale so long as they are in compliance with the |
---|
321 | 321 | | provisions of the Meat Inspection Act. |
---|
322 | 322 | | G. Meat inspection stamps shall at all times be |
---|
323 | 323 | | under the immediate jurisdiction of the inspection director. |
---|
324 | 324 | | SECTION 5. [NEW MATERIAL] ASSIGNMENT OF INSPECTORS.-- |

364 | 364 | | excess of eight hours in one day or slaughter on holidays or |

365 | 365 | | Sundays, and the inspection director shall assign an inspector |

366 | 366 | | to conduct meat inspection at those times. A slaughtering |
---|
367 | 367 | | establishment shall pay overtime fees to the board when the |
---|
368 | 368 | | board provides inspection services in excess of eight hours in |
---|
369 | 369 | | one day or on holidays or Sundays. A slaughtering |
---|
370 | 370 | | establishment that has state meat inspection services is not |
---|
371 | 371 | | permitted to slaughter poultry, cattle, sheep, swine or goats |
---|

418 | 418 | | post-mortem examination shall be made at the time the animals |
---|
419 | 419 | | are slaughtered. The inspector shall perform a thorough |
---|
420 | 420 | | examination of the carcass and parts thereof in accordance with |
---|
421 | 421 | | the rules promulgated by the board. The examination shall be |
---|
422 | 422 | | conducted in the slaughtering department of the plant during |
---|
423 | 423 | | the slaughtering operations. |
---|
424 | 424 | | C. The inspection director or any of the inspection |
---|
425 | 425 | | director's inspectors shall have the laboratory of the board or |
---|
426 | 426 | | a laboratory designated by the board conduct pathogenic |
---|
427 | 427 | | examination of animals or parts thereof for completion of |
---|
428 | 428 | | ante-mortem or post-mortem inspection. |
---|
429 | 429 | | SECTION 7. [NEW MATERIAL] OFFICIAL ESTABLISHMENT DUTIES-- |

1108 | 1108 | | SECTION 16. [NEW MATERIAL] POWER TO ENJOIN VIOLATIONS OF |
