57	57	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
58	58	SECTION 1. [NEW MATERIAL] SHORT TITLE.--This act may be
59	59	cited as the "Meat Inspection Act".
60	60	SECTION 2. [NEW MATERIAL] DEFINITIONS.--As used in the
61	61	Meat Inspection Act:
62	62	A. "board" means the New Mexico livestock board;
63	63	B. "food additive" means a substance, the intended

92	92	directly or indirectly, in the substance becoming a component
93	93	of or otherwise affecting the characteristics of food; provided
94	94	that the substance is not generally recognized, among experts
95	95	qualified by scientific training and experience to evaluate the
96	96	substance's safety, as having been adequately shown through
97	97	scientific procedures, or experience based on common use in
98	98	food, to be safe under the conditions of its intended use; and
99	99	further provided that "food additive" does not include:
100	100	(1) a pesticide chemical residue in or on a
101	101	raw agricultural commodity or processed food;
102	102	(2) a pesticide chemical;
103	103	(3) a color additive;
104	104	(4) a substance used in accordance with a
105	105	sanction or approval granted prior to the enactment of the
106	106	federal Poultry Products Inspection Act or the federal Meat
107	107	Inspection Act of 1907;
108	108	(5) a new animal drug; or
109	109	(6) an ingredient intended for use in a
110	110	dietary supplement;
111	111	C. "inspection director" means the director of the
112	112	office of the meat and poultry inspection director;
113	113	D. "livestock" means cattle, sheep, swine, goats,
114	114	horses, mules or other equines, whether alive or dead;
115	115	E. "livestock product" means a livestock carcass or

145	145	F. "meat" means the edible flesh of livestock,
146	146	poultry, birds or animals as usually sold for human consumption
147	147	and includes livestock and poultry products;
148	148	G. "meat product" means a product capable of use as
149	149	human food that is wholly or partially made from meat and is
150	150	not specifically exempted by rules of the board;
151	151	H. "official establishment" means an establishment
152	152	granted state meat inspection services by the board where
153	153	inspection of the slaughter of livestock or poultry or the
154	154	preparation of meat products is maintained pursuant to the Meat
155	155	Inspection Act;
156	156	I. "pesticide chemical" has the same meaning as set
157	157	forth in the Federal Food, Drug, and Cosmetic Act;
158	158	J. "poultry" means a domesticated bird, whether
159	159	alive or dead;
160	160	K. "poultry product" means a poultry carcass or
161	161	part of a poultry carcass or a product that is made wholly or
162	162	in part from a poultry carcass or part of a poultry carcass and
163	163	is not specifically exempted by rules of the board;
164	164	L. "prepared" means slaughtered, canned, salted,
165	165	stuffed, rendered, boned, cut up or otherwise manufactured or
166	166	processed;
167	167	M. "raw agricultural commodity" means food in its
168	168	raw or natural state, including all fruits that are washed,

199	199	N. "state meat inspection services" means
200	200	inspection services granted by the board to a slaughtering
201	201	establishment, meat processor or manufacturer of meat products.
202	202	SECTION 3. [NEW MATERIAL] OFFICE CREATED--DUTIES--
203	203	QUALIFICATIONS--COMPENSATION.--
204	204	A. The "office of the meat and poultry inspection
205	205	director" is created under the board, subject to the control
206	206	and direction of the executive director of the board. The
207	207	board shall appoint an inspection director who meets the
208	208	requirements established by the board.
209	209	B. The inspection director shall supervise the
210	210	state meat inspection program and enforce and carry out the
211	211	provisions of the Meat Inspection Act to assure the public that
212	212	only pure, wholesome and unadulterated meat and meat products
213	213	are offered for sale.
214	214	C. Upon approval by the inspection director, the
215	215	board shall appoint and fix salaries of veterinary meat
216	216	inspectors and lay meat inspectors, subject to the provisions
217	217	of the Personnel Act, who shall conduct ante-mortem and
218	218	post-mortem inspections, enforce sanitary requirements, perform
219	219	other duties necessary to conduct proper meat inspection and
220	220	carry out the provisions of the Meat Inspection Act.

251	251	establishment nor have a financial interest in the
252	252	establishment.
253	253	E. Each inspector shall take the oath of office.
254	254	SECTION 4. [NEW MATERIAL] APPLICATION FOR STATE MEAT
255	255	INSPECTION SERVICES--PERIODIC INSPECTIONS--INSPECTION STAMPS
256	256	AND ESTABLISHMENT NUMBERS.--
257	257	A. A slaughtering establishment, meat processor or
258	258	manufacturer of meat products seeking state meat inspection
259	259	services shall submit a written application to the board
260	260	through a process established by the board.
261	261	B. The board shall provide for periodic
262	262	investigations of the sanitary conditions of each official
263	263	establishment and withdraw or otherwise refuse to grant state
264	264	meat inspection services and inspect those establishments where
265	265	the sanitary conditions are such as to render adulterated meat
266	266	prepared or handled therein.
267	267	C. The office of the meat and poultry inspection
268	268	director shall inspect the applicant's facilities to determine
269	269	if they are clean and sanitary and meet the requirements of the
270	270	Meat Inspection Act. Upon determination, the inspection
271	271	director shall recommend approval or disapproval of the
272	272	application to the board. The board may adopt the
273	273	recommendation of the inspection director. If an application
274	274	is approved, the board shall assign an official establishment

304	304	Meat Inspection Act.
305	305	D. The board shall provide meat inspection stamps
306	306	that contain the words "New Mexico Inspected and Passed" and
307	307	"New Mexico Inspected and Condemned" and assign establishment
308	308	numbers to:
309	309	(1) slaughtering establishments that have been
310	310	approved and granted state meat inspection services by the
311	311	board; and
312	312	(2) meat processors and manufacturers of meat
313	313	products that have been approved in accordance with the
314	314	requirements of the Meat Inspection Act.
315	315	E. The board shall design inspection stamps so as
316	316	not to be in conflict with the inspection stamps of the United
317	317	States department of agriculture.
318	318	F. An official establishment may use symbols of the
319	319	inspection stamps on its processed meats and meat products
320	320	offered for sale so long as they are in compliance with the
321	321	provisions of the Meat Inspection Act.
322	322	G. Meat inspection stamps shall at all times be
323	323	under the immediate jurisdiction of the inspection director.
324	324	SECTION 5. [NEW MATERIAL] ASSIGNMENT OF INSPECTORS.--
325	325	A. A slaughtering establishment granted state meat
326	326	inspection services shall notify the inspection director of its
327	327	hours of slaughter, and the inspection director shall assign

356	356	inspectors to the establishment. The inspection director may
357	357	assign one inspector to conduct inspection at two or more
358	358	slaughtering establishments that have state meat inspection
359	359	services. The hours of the day and the days of the week shall
360	360	be arranged with the slaughtering establishments to ensure that
361	361	an inspector is present at each establishment during all
362	362	periods of slaughter.
363	363	B. A slaughtering establishment may slaughter in
364	364	excess of eight hours in one day or slaughter on holidays or
365	365	Sundays, and the inspection director shall assign an inspector
366	366	to conduct meat inspection at those times. A slaughtering
367	367	establishment shall pay overtime fees to the board when the
368	368	board provides inspection services in excess of eight hours in
369	369	one day or on holidays or Sundays. A slaughtering
370	370	establishment that has state meat inspection services is not
371	371	permitted to slaughter poultry, cattle, sheep, swine or goats
372	372	unless there is an assigned inspector on the premises of the
373	373	establishment during all periods of slaughter.
374	374	SECTION 6. [NEW MATERIAL] ANTE- AND POST-MORTEM
375	375	INSPECTION REQUIRED.--
376	376	A. A slaughtering establishment that has state meat
377	377	inspection services shall have an ante-mortem inspection. The
378	378	inspector assigned to the slaughtering establishment shall
379	379	examine each animal immediately prior to slaughter for the
380	380	purpose of eliminating all unfit animals and segregating, for

410	410	affected with a condition that might influence disposition on
411	411	post-mortem inspection. The unfit animals shall not be
412	412	permitted to enter the slaughtering department of the plant.
413	413	The suspected animals that are permitted to be slaughtered
414	414	after inspection shall be handled separately from the regular
415	415	kill and given a special post-mortem examination.
416	416	B. A slaughtering establishment that has state meat
417	417	inspection services shall have a post-mortem inspection. The
418	418	post-mortem examination shall be made at the time the animals
419	419	are slaughtered. The inspector shall perform a thorough
420	420	examination of the carcass and parts thereof in accordance with
421	421	the rules promulgated by the board. The examination shall be
422	422	conducted in the slaughtering department of the plant during
423	423	the slaughtering operations.
424	424	C. The inspection director or any of the inspection
425	425	director's inspectors shall have the laboratory of the board or
426	426	a laboratory designated by the board conduct pathogenic
427	427	examination of animals or parts thereof for completion of
428	428	ante-mortem or post-mortem inspection.
429	429	SECTION 7. [NEW MATERIAL] OFFICIAL ESTABLISHMENT DUTIES--
430	430	RECORDS--PLANS--REASSESSMENTS.--An official establishment
431	431	shall:
432	432	A. conduct ante-mortem and post-mortem inspections,
433	433	quarantines, segregation and reinspections with respect to the

463	463	livestock and poultry products;
464	464	B. inspect livestock and poultry and mark and label
465	465	meat products as "New Mexico Inspected and Condemned" if the
466	466	products are found upon inspection to be adulterated and "New
467	467	Mexico Inspected and Passed" if they are found upon inspection
468	468	not to be adulterated;
469	469	C. destroy meat products that have been marked "New
470	470	Mexico Inspected and Condemned";
471	471	D. maintain full and complete records of all
472	472	transactions involving meat and make the records available on
473	473	request to the inspection director or the inspection director's
474	474	inspectors at any reasonable time;
475	475	E. prepare and maintain current procedures for the
476	476	recall of meat or meat products produced and shipped by the
477	477	establishment;
478	478	F. document each reassessment of the process
479	479	control plans of the establishment; and
480	480	G. upon request, make the procedures and reassessed
481	481	process control plans available to inspectors appointed by the
482	482	inspection director for review and copying.
483	483	SECTION 8. [NEW MATERIAL] CONDEMNATION AND APPEAL.--The
484	484	inspector at an official establishment shall condemn all
485	485	diseased or otherwise unfit carcasses and parts of carcasses,
486	486	including the viscera. The official establishment shall remove

516	516	plant in equipment designated for that purpose and shall
517	517	destroy the condemned parts for food purposes under the
518	518	supervision of the inspector. If an official establishment
519	519	wishes to appeal a decision of an inspector as to carcasses or
520	520	parts of carcasses that have been condemned, the establishment
521	521	may appeal the decision to the office of the meat and poultry
522	522	inspection director. If the establishment is not satisfied and
523	523	wishes to make a further appeal, it may submit an appeal to the
524	524	board, whose decision shall be final unless the establishment
525	525	aggrieved appeals to the district court pursuant to the
526	526	provisions of Section 39-3-1.1 NMSA 1978.
527	527	SECTION 9. [NEW MATERIAL] RULES.--
528	528	A. The board, upon the recommendation of the
529	529	inspection director, shall adopt rules that conform as far as
530	530	possible to the requirements of the Federal Meat Inspection
531	531	Act, the federal Poultry Products Inspection Act and the
532	532	federal Humane Methods of Slaughter Act of 1978. The rules
533	533	shall:
534	534	(1) set standards for ingredients of meat;
535	535	(2) set standards for labeling, marking or
536	536	branding meat;
537	537	(3) set standards for the weights or measures
538	538	of meat;
539	539	(4) set standards for the filling of

569	569	(5) regulate misbranded, false or fraudulent
570	570	advertising of meat; and
571	571	(6) prescribe standards relating to sanitation
572	572	for official establishments.
573	573	B. The board, upon the recommendation of the
574	574	inspection director, may:
575	575	(1) adopt rules to exempt small meat packages,
576	576	meat not in containers and other reasonable variations from
577	577	labeling standards for weight, measure or numerical count; and
578	578	(2) prescribe additional rules as necessary to
579	579	carry out the purposes of the Meat Inspection Act.
580	580	SECTION 10. [NEW MATERIAL] ADULTERATED MEAT--MISBRANDED
581	581	MEAT AND MEAT PRODUCTS.--
582	582	A. Meat or a meat product is adulterated if:
583	583	(1) it bears or contains a poisonous or
584	584	deleterious substance that may render it injurious to health;
585	585	provided that a substance that is not added to meat is not
586	586	considered adulterating if the quantity of the substance is
587	587	insufficient to ordinarily render it injurious to health;
588	588	(2) it bears or contains, by reason of
589	589	administration of a substance to the meat, an added poisonous
590	590	or added deleterious substance other than a color additive, a
591	591	food additive or a pesticide chemical in or on a raw
592	592	agricultural commodity, that may, in the board's judgment, make

622	622	(3) it is, in whole or in part, a raw
623	623	agricultural commodity and bears or contains a pesticide
624	624	chemical that is unsafe within the meaning of the Federal Food,
625	625	Drug, and Cosmetic Act;
626	626	(4) it bears or contains a food additive that
627	627	is unsafe within the meaning of the Federal Food, Drug, and
628	628	Cosmetic Act;
629	629	(5) it bears or contains a color additive that
630	630	is unsafe within the meaning of the Federal Food, Drug, and
631	631	Cosmetic Act; provided that the meat or meat product that is
632	632	not otherwise deemed adulterated under Paragraph (3), (4) or
633	633	(5) of this subsection shall be deemed adulterated if use of
634	634	the pesticide chemical, food additive or color additive in or
635	635	on the meat or meat product is prohibited by rules of the
636	636	board;
637	637	(6) it consists in whole or in part of a
638	638	filthy, putrid or decomposed substance or is for any other
639	639	reason unsound, unhealthful, unwholesome or otherwise unfit for
640	640	human food;
641	641	(7) it has been prepared, packed or held under
642	642	unsanitary conditions whereby it may have become contaminated
643	643	with filth or rendered injurious to health;
644	644	(8) it is, in whole or in part, the product of
645	645	an animal, including poultry, that has died otherwise than by

675	675	(9) its container is composed, in whole or in
676	676	part, of a poisonous or deleterious substance that may render
677	677	the contents injurious to health;
678	678	(10) it has been intentionally subjected to
679	679	radiation, unless the use of the radiation was in conformity
680	680	with a regulation or exemption in effect pursuant to the
681	681	Federal Food, Drug, and Cosmetic Act; or
682	682	(11) a valuable constituent has been, in whole
683	683	or in part, omitted or abstracted; or if a substance has been
684	684	substituted, wholly or in part; or if damage or inferiority has
685	685	been concealed; or if a substance has been added, mixed or
686	686	packed to increase its bulk or weight; or reduce its quality or
687	687	strength; or make it appear better or of greater value.
688	688	B. Meat or a meat product is misbranded:
689	689	(1) if the labeling is false or misleading;
690	690	(2) if it is offered for sale under the name
691	691	of another food;
692	692	(3) if it is an imitation of another food,
693	693	unless its label bears, in type of uniform size and prominence,
694	694	the word "imitation" and immediately after the name of the food
695	695	being imitated;
696	696	(4) if its container is made, formed or filled
697	697	as to be misleading;
698	698	(5) unless it bears a label showing:

732	732	(6) if a word, statement or other information
733	733	required by or under the Meat Inspection Act to appear on the
734	734	label or other labeling is not prominently placed thereon with
735	735	such conspicuousness, as compared with other words, statements,
736	736	designs or devices in the labeling, or is not stated in such
737	737	terms as to render it likely to be read and understood by the
738	738	ordinary individual under customary conditions of purchase and
739	739	use;
740	740	(7) if it purports to be or is represented as
741	741	a food for which a definition and standard of identity or
742	742	composition has been prescribed by the rules of the board,
743	743	unless:
744	744	(a) it conforms to the definition and
745	745	standard; and
746	746	(b) its label bears the name of the food
747	747	specified in the definition and standard and, insofar as may be
748	748	required by rule, the common names of optional ingredients,
749	749	other than spices, flavoring and coloring, present in the food;
750	750	(8) if it purports to be or is represented as
751	751	a food for which a standard of fill of container has been

788	788	that spices, flavorings and colorings may, when authorized by

790	790	without naming each; provided that, to the extent that
791	791	compliance with these requirements is impracticable or results
792	792	in deception or unfair competition, exemptions shall be
793	793	established by rules promulgated by the board;
794	794	(10) if it purports to be or is represented
795	795	for special dietary uses, unless its label bears information
796	796	concerning its vitamin, mineral and other dietary properties,
797	797	as the board, after consultation with the secretary of
798	798	agriculture of the United States, determines and by rule

841	841	labeling and that the public is informed of the manner of
842	842	handling required to maintain the meat or meat product in a
843	843	wholesome condition.
844	844	SECTION 11. [NEW MATERIAL] PROHIBITED ACTS--PENALTY.--
845	845	A. Except as provided by the Meat Inspection Act,
846	846	it is a:
847	847	(1) misdemeanor for a person to:
848	848	(a) slaughter livestock or poultry or
849	849	prepare livestock products or poultry products for human
850	850	consumption in violation of the provisions of the Meat
851	851	Inspection Act;
852	852	(b) sell or transport adulterated,
853	853	misbranded, condemned or uninspected meat;
854	854	(c) falsely represent that meat or a
855	855	meat product has been inspected and passed or is exempted under
856	856	the Meat Inspection Act or board rules or knowingly make a
857	857	false statement in a certificate required by board rules;

893	893	(g) use, alter, deface, detach or
894	894	destroy an official device, mark or certificate without
895	895	authorization;
896	896	(h) fail to use or fail to detach,
897	897	deface or destroy an official device, mark or certificate
898	898	contrary to rules prescribed by the board;
899	899	(i) knowingly possess a counterfeit
900	900	certificate, device or label or the carcass or parts of the
901	901	carcass of an animal bearing a counterfeit or improperly
902	902	altered official mark; or
903	903	(j) buy, sell or transport livestock
904	904	products or poultry products not intended for human food unless
905	905	the products are naturally inedible by humans or are denatured
906	906	or identified as required by rules of the board; and
907	907	(2) a fourth degree felony for a person to:
908	908	(a) engage in the business of buying,
909	909	selling or transporting dead, dying, disabled or diseased
910	910	animals or parts of the carcasses of animals that died

942	942	slaughter unless in accordance with rules adopted by the board
943	943	to ensure that the animals or the unwholesome parts or products
944	944	of the animals are prevented from being used for human food
945	945	purposes; or
946	946	(b) engage in unfair trade practices,
947	947	inaccurate or deceptive advertising, bait and switch selling or
948	948	product misrepresentation or knowingly engage in price
949	949	misrepresentation of meat.
950	950	B. A person who violates a provision of Paragraph
951	951	(1) of Subsection A of this section is guilty of a misdemeanor
952	952	and shall be sentenced in accordance with the provisions of
953	953	Section 31-19-1 NMSA 1978.
954	954	C. A person who violates a provision of Paragraph
955	955	(2) of Subsection A of this section is guilty of a fourth
956	956	degree felony and shall be sentenced in accordance with the
957	957	provisions of Section 31-18-15 NMSA 1978.
958	958	SECTION 12. [NEW MATERIAL] EXEMPTIONS.--The following
959	959	persons are exempt from the provisions and penalties of the
960	960	Meat Inspection Act:
961	961	A. a person who slaughters livestock or poultry for
962	962	personal or household use or consumption;
963	963	B. a person who prepares or processes livestock or

995	995	diseased animals or poultry for the purpose of treatment,
996	996	burial or disposal in a manner that would prevent the carcasses
997	997	from being used as human food.
998	998	SECTION 13. [NEW MATERIAL] INTERFERENCE WITH BOARD
999	999	OFFICIALS AND PERSONNEL.--A person who forcibly assaults,
1000	1000	resists, opposes, impedes, harasses or intimidates a person
1001	1001	while engaged in or on account of the performance of official
1002	1002	duties under the Meat Inspection Act is guilty of a misdemeanor
1003	1003	and shall be sentenced in accordance with the provisions of
1004	1004	Section 31-19-1 NMSA 1978.
1005	1005	SECTION 14. [NEW MATERIAL] COOPERATION WITH THE
1006	1006	DEPARTMENT OF HEALTH, THE DEPARTMENT OF ENVIRONMENT AND OTHER
1007	1007	PUBLIC HEALTH AUTHORITIES.--
1008	1008	A. In carrying out the provisions of the Meat
1009	1009	Inspection Act, the board and the inspection director shall
1010	1010	request the advice from and consult with the appropriate
1011	1011	employees of the department of health, the department of
1012	1012	environment and state laboratories on matters relating to
1013	1013	potability of water, sewerage systems and other sanitary
1014	1014	conditions of slaughtering and meat processing establishments
1015	1015	that might endanger public health.

1053	1053	fails to meet the minimum requirements of the department of
1054	1054	health or the department of environment, the board shall notify
1055	1055	the official establishment that the grant for state meat
1056	1056	inspection services or assigned establishment number is
1057	1057	suspended.
1058	1058	SECTION 15. [NEW MATERIAL] SUSPENSION OR REVOCATION OF
1059	1059	INSPECTION SERVICES OR ESTABLISHMENT NUMBER--HEARING--APPEAL.--
1060	1060	A. The board may suspend or revoke a state meat
1061	1061	inspection services or establishment number for violation of or
1062	1062	noncompliance with:
1063	1063	(1) a provision of the Meat Inspection Act;
1064	1064	(2) a rule issued pursuant to the Meat
1065	1065	Inspection Act; or
1066	1066	(3) minimum requirements established by the
1067	1067	department of health or the department of environment for
1068	1068	sanitary conditions of slaughtering and meat processing
1069	1069	establishments.

1100	1100	hearing before the board upon reasonable notice. The board
1101	1101	shall provide notice to the official establishment by service
1102	1102	of the complaint by certified mail, return receipt requested.
1103	1103	C. A decision of the board is final in a matter
1104	1104	relating to renewal, suspension or revocation of state meat
1105	1105	inspection services or establishment numbers unless the person
1106	1106	aggrieved appeals to the district court pursuant to the
1107	1107	provisions of Section 39-3-1.1 NMSA 1978.
1108	1108	SECTION 16. [NEW MATERIAL] POWER TO ENJOIN VIOLATIONS OF
1109	1109	THE MEAT INSPECTION ACT.--In addition to remedies provided in
1110	1110	the Meat Inspection Act, the board may apply to the district
1111	1111	court for a temporary or permanent injunction restraining a
1112	1112	person from violating a provision of the Meat Inspection Act
1113	1113	irrespective of whether there exists an adequate remedy at law.
1114	1114	SECTION 17. [NEW MATERIAL] APPLICATION OF FEDERAL LAWS.--
1115	1115	The provisions of the Meat Inspection Act apply to persons,
1116	1116	establishments, animals, meat and meat products regulated under
1117	1117	the federal Meat Inspection Act, the federal Poultry Products
1118	1118	Inspection Act and the federal Humane Methods of Slaughter Act
1119	1119	of 1978 and only to the extent provided for in those acts.
1120	1120	SECTION 18. [NEW MATERIAL] NOTIFICATION.--An official
1121	1121	establishment subject to inspection under the Meat Inspection
1122	1122	Act that has knowledge, or has reason to have knowledge, that

1156	1156	SECTION 19. [NEW MATERIAL] HUMANE METHODS OF SLAUGHTER--
1157	1157	RELIGIOUS EXEMPTIONS.--
1158	1158	A. No method of slaughtering or handling in
1159	1159	connection with slaughtering shall be deemed to comply with the
1160	1160	public policy of the Meat Inspection Act unless it is humane.
1161	1161	The following two methods of slaughtering and handling are
1162	1162	humane:
1163	1163	(1) in the case of cattle, calves, sheep,
1164	1164	swine and other livestock, all animals are rendered insensible
1165	1165	to pain by a single blow or gunshot or electrical, chemical or
1166	1166	other means that is rapid and effective before being shackled,
1167	1167	hoisted, thrown, cast or cut; or
1168	1168	(2) by ritual slaughter.
1169	1169	B. Nothing in the Meat Inspection Act shall be
1170	1170	construed to prohibit, abridge or hinder the religious freedom
1171	1171	of an individual or group. To protect freedom of religion,
1172	1172	ritual slaughter and the handling or other preparation of
1173	1173	livestock for ritual slaughter are exempted from the provisions
1174	1174	of the Meat Inspection Act.
1175	1175	C. For the purposes of this section, "ritual
