4949 RELATING TO CHILDREN; REQUIRING THE CHILDREN, YOUTH AND
5050 FAMILIES DEPARTMENT TO RECRUIT, SUPPORT AND RETAIN INDIAN
5151 FOSTER FAMILIES; PROVIDING REPORTING REQUIREMENTS; PROVIDING
5252 TECHNICAL CLEANUP.
5353 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5454 SECTION 1. A new section of the Children's Code is
5555 enacted to read:
5656 "[NEW MATERIAL] DEPARTMENT RECRUITING EFFORTS--INDIAN
5757 FOSTER FAMILIES.--The department shall make active and
5858 continual efforts to recruit, support and retain Indian foster
5959 families. As used in this section, an "Indian foster family"
6060 means a department-licensed foster family in which at least one
6161 parent is Indian."

9090 Act is enacted to read:
9191 "[NEW MATERIAL] ANNUAL REPORT--CONTENTS.--
9292 A. The department shall provide a report by no
9393 later than October 1 of each year to the legislature through
9494 appropriate interim committees and to the governor.
9595 B. The report shall contain the following
9696 information:
9797 (1) the active efforts the department has made
9898 to increase Indian foster families, specifying the county and
9999 Indian nation, tribe or pueblo represented;
100100 (2) how many current foster homes licensed by
101101 the department have one or more foster parents who are an
102102 Indian;
103103 (3) the active number of foster placements
104104 each Indian foster family has, and:
105105 (a) if an Indian foster family has more
106106 than six foster placements, a detailed explanation shall
107107 accompany the report; and
108108 (b) if the Indian child being placed and
109109 the Indian foster family are not from the same tribe, an
110110 explanation shall accompany the report;
111111 (4) how many Indian foster families are
112112 currently accepting new placements;
113113 (5) how many Indian children are in foster
114114 care through the department and the permanency goals the

144144 (6) how many Indian children were removed in a
145145 twelve-month period for a forty-eight-hour hold;
146146 (7) how many Indian children were victims of
147147 repeated maltreatment in a twelve-month period;
148148 (8) how many Indian children are not in
149149 preferred placements or with an Indian foster family and an
150150 explanation of why those children are in non-preferred
151151 placements, including any active efforts made by the department
152152 to place the children in preferred placement settings;
153153 (9) the number of non-relative foster families
154154 with an Indian child and length of each placement; and
155155 (10) if there are any Indian child sibling
156156 groups in department care and if they are placed together or
157157 separately, and if they are separated, an explanation of why
158158 they were separated.
159159 C. A copy of the report shall be provided to the
160160 legislature and maintained in the legislative council service
161161 library. The report shall be posted on the department's
162162 website.
163163 D. As used in this section, "Indian foster family"
164164 means a department-licensed foster family in which at least one
165165 parent is Indian."
166166 SECTION 3. Section 32A-28-1 NMSA 1978 (being Laws 2022,
167167 Chapter 41, Section 1) is amended to read:
