49	49	RELATING TO CHILDREN; REQUIRING THE CHILDREN, YOUTH AND
50	50	FAMILIES DEPARTMENT TO RECRUIT, SUPPORT AND RETAIN INDIAN
51	51	FOSTER FAMILIES; PROVIDING REPORTING REQUIREMENTS; PROVIDING
52	52	TECHNICAL CLEANUP.
53	53	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
54	54	SECTION 1. A new section of the Children's Code is
55	55	enacted to read:
56	56	"[NEW MATERIAL] DEPARTMENT RECRUITING EFFORTS--INDIAN
57	57	FOSTER FAMILIES.--The department shall make active and
58	58	continual efforts to recruit, support and retain Indian foster
59	59	families. As used in this section, an "Indian foster family"
60	60	means a department-licensed foster family in which at least one
61	61	parent is Indian."
62	62	SECTION 2. A new section of the Indian Family Protection

91	91	"[NEW MATERIAL] ANNUAL REPORT--CONTENTS.--
92	92	A. The department shall provide a report by no
93	93	later than October 1 of each year to the legislature through
94	94	appropriate interim committees and to the governor.
95	95	B. The report shall contain the following
96	96	information:
97	97	(1) the active efforts the department has made
98	98	to increase Indian foster families, specifying the county and
99	99	Indian nation, tribe or pueblo represented;
100	100	(2) how many current foster homes licensed by
101	101	the department have one or more foster parents who are an
102	102	Indian;
103	103	(3) the active number of foster placements
104	104	each Indian foster family has, and:
105	105	(a) if an Indian foster family has more
106	106	than six foster placements, a detailed explanation shall
107	107	accompany the report; and
108	108	(b) if the Indian child being placed and
109	109	the Indian foster family are not from the same tribe, an
110	110	explanation shall accompany the report;
111	111	(4) how many Indian foster families are
112	112	currently accepting new placements;
113	113	(5) how many Indian children are in foster
114	114	care through the department and the permanency goals the

144	144	(6) how many Indian children were removed in a
145	145	twelve-month period for a forty-eight-hour hold;
146	146	(7) how many Indian children were victims of
147	147	repeated maltreatment in a twelve-month period;
148	148	(8) how many Indian children are not in
149	149	preferred placements or with an Indian foster family and an
150	150	explanation of why those children are in non-preferred
151	151	placements, including any active efforts made by the department
152	152	to place the children in preferred placement settings;
153	153	(9) the number of non-relative foster families
154	154	with an Indian child and length of each placement; and
155	155	(10) if there are any Indian child sibling
156	156	groups in department care and if they are placed together or
157	157	separately, and if they are separated, an explanation of why
158	158	they were separated.
159	159	C. A copy of the report shall be provided to the
160	160	legislature and maintained in the legislative council service
161	161	library. The report shall be posted on the department's
162	162	website.
163	163	D. As used in this section, "Indian foster family"
164	164	means a department-licensed foster family in which at least one
165	165	parent is Indian."
166	166	SECTION 3. Section 32A-28-1 NMSA 1978 (being Laws 2022,
167	167	Chapter 41, Section 1) is amended to read:
