5353 CHILDREN, YOUTH AND FAMILIES DEPARTMENT TO PROVIDE ADDITIONAL
5454 COMPENSATION WHEN THE DEPARTMENT DOES NOT ADHERE TO CASELOAD
5555 STANDARDS.
5656 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5757 SECTION 1. A new section of the Children's Code is
5858 enacted to read:
5959 "[NEW MATERIAL] CASELOAD STANDARDS--INVESTIGATION CASE
6060 WORKERS--PERMANENCY PLANNING WORKERS--IN-HOME SERVICES
6161 PROVIDERS--PLACEMENT WORKERS.--The department shall implement
6262 the following caseload standards:

9090 A. for investigation case workers, the standard
9191 shall be:
9292 (1) no more than twelve active cases or
9393 families total;
9494 (2) no primary assignments for the first two
9595 months after the completion of a new employee training program;
9696 (3) no more than three primary assignments at
9797 a time three to four months after the completion of a new
9898 employee training program; and
9999 (4) no more than six primary assignments at a
100100 time five to six months after the completion of a new employee
101101 training program;
102102 B. for permanency planning workers, the standard
103103 shall be:
104104 (1) no more than fifteen children on a
105105 caseload at a time;
106106 (2) no more than five children at a time,
107107 assigned as primary, for two months after the completion of a
108108 new employee training program, and these cases shall only
109109 consist of transferred cases;
110110 (3) no more than eight primary case
111111 assignments at a time three to four months after the completion
112112 of a new employee training program, and this can include new
113113 cases; and
114114 (4) no more than twelve primary case

147147 D. for investigation case workers, the standard
148148 shall be:
149149 (1) no more than twelve active cases or
150150 families total;
151151 (2) no primary assignments for the first two
152152 months after the completion of a new employee training program;
153153 (3) no more than three primary assignments at
154154 a time three to four months after the completion of a new
155155 employee training program; and
156156 (4) no more than six primary assignments at a
157157 time five to six months after the completion of a new employee
158158 training program."
159159 SECTION 2. A new section of the Children's Code is
160160 enacted to read:
161161 "[NEW MATERIAL] ADDITIONAL COMPENSATION--TIERS--
162162 INVESTIGATION CASE WORKERS--PERMANENCY PLANNING WORKERS--
163163 IN-HOME SERVICES PROVIDERS--PLACEMENT WORKERS.--
164164 A. If the caseload standards in Section 1 of this
165165 2023 act are not adhered to by the department, the department
166166 shall follow the compensation scales as provided in Subsection
167167 B of this section and provide additional compensation for

198198 B. The following compensation tiers shall take
199199 effect if the department does not adhere to the caseload
200200 standards in Section 1 of this 2023 act:
201201 (1) if an investigation case worker has:
202202 (a) thirteen to twenty-four active
203203 cases, the investigation case worker shall receive an
204204 additional five dollars ($5.00) per hour in addition to the
205205 base hourly salary;
206206 (b) twenty-five to thirty-six active
207207 cases, the investigation case worker shall receive an
208208 additional seven dollars ($7.00) per hour in addition to the
209209 base hourly salary; and
210210 (c) thirty-seven or more active cases,
211211 the investigation case worker shall receive an additional ten
212212 dollars ($10.00) per hour in addition to the base hourly
213213 salary;
214214 (2) if a permanency planning worker has:
215215 (a) sixteen to thirty children on the
216216 permanency planning worker's caseload, the permanency planning
217217 worker shall receive an additional five dollars ($5.00) per
218218 hour in addition to the base hourly salary;
219219 (b) thirty-one to forty-five children on
220220 the permanency planning worker's caseload, the permanency

251251 (c) forty-six or more active cases, the
252252 permanency planning worker shall receive an additional ten
253253 dollars ($10.00) per hour in addition to the base hourly
254254 salary;
255255 (3) if an in-home services provider has:
256256 (a) nine to sixteen active cases or
257257 families, the in-home services provider shall receive an
258258 additional five dollars ($5.00) per hour in addition to the
259259 base hourly salary;
260260 (b) seventeen to twenty-four active
261261 cases or families, the in-home services provider shall receive
262262 an additional seven dollars ($7.00) per hour in addition to the
263263 base hourly salary; and
264264 (c) twenty-five or more active cases or
265265 families, the in-home services provider shall receive an
266266 additional ten dollars ($10.00) per hour in addition to the
267267 base hourly salary; and
268268 (4) if a placement worker has:
269269 (a) thirteen to twenty-four active
270270 cases, the placement worker shall receive an additional five
271271 dollars ($5.00) per hour in addition to the base hourly salary;
272272 (b) twenty-five to thirty-six active
273273 cases, the placement worker shall receive an additional seven

307307 SECTION 3. EFFECTIVE DATE.--The effective date of the
308308 provisions of this act is July 1, 2023.
