3756 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3857 SECTION 1. A new section of the New Mexico Commercial
3958 Driver's License Act is enacted to read:
40-"COMMERCIAL DRIVER'S LICENSE, COMMERCIAL LEARNER'S
41-PERMIT AND COMMERCIAL DRIVER'S PERMIT ELIGIBILITY--DIVISION
42-TO RECEIVE RECORDS FROM THE FEDERAL COMMERCIAL DRIVER'S
43-LICENSE DRUG AND ALCOHOL CLEARINGHOUSE--COMMERCIAL DRIVER'S
44-LICENSE DOWNGRADE PROCEDURES.--
45-A. As used in this section:
46-(1) "commercial driver's license downgrade"
47-means the division's removal of the commercial driver's
48-license or commercial driver's permit privilege from a
49-driver's license;
50-(2) "commercial driver's license drug and
51-alcohol clearinghouse" means the federal motor carrier safety HB 269/a

90+DRIVER'S LICENSE DOWNGRADE PROCEDURES.--
91+A. As used in this section:
92+(1) "commercial driver's license downgrade"
93+means the division's removal of the commercial driver's license
94+or commercial driver's permit privilege from a driver's
95+license;
96+(2) "commercial driver's license drug and
97+alcohol clearinghouse" means the federal motor carrier safety
7898 administration database that requires employers and service
79-agents to report information to and to query regarding
80-drivers who are subject to United States department of
81-transportation controlled substance and alcohol testing
82-regulations;
83-(3) "qualified" means the passage of the
84-drug or alcohol test; and
85-(4) "not qualified" means a failure or
86-refusal of the drug or alcohol test.

89-license drug and alcohol clearinghouse that determine whether
90-the commercial driver is qualified or not qualified as
91-required by the federal motor carrier safety administration.
92-Pursuant to this section, if a commercial driver's drug or
93-alcohol test results indicate that the commercial driver is
94-prohibited from operating a commercial motor vehicle, the
95-division shall refuse a request for:
96-(1) issuance or renewal of a commercial
97-learner's permit or a commercial driver's license;
98-(2) an upgrade of a commercial learner's
99-permit to a commercial driver's license; and
100-(3) transfer of an out-of-state commercial
101-driver's license to this state.
102-C. The division shall request commercial driver's HB 269/a

107+driver's drug test results from the commercial driver's license
108+drug and alcohol clearinghouse that determine whether the
109+commercial driver is qualified or not qualified as required by
110+the federal motor carrier safety administration. Pursuant to
111+this section, if a commercial driver's drug or alcohol test
112+results indicate that the commercial driver is prohibited from
113+operating a commercial motor vehicle, the division shall refuse

130-applicant for a commercial driver's license at the time of
131-application. Pursuant to this subsection, if the records
132-indicate that the commercial driver's license applicant is
133-prohibited from operating a commercial motor vehicle, the
134-division shall refuse to:
135-(1) renew the commercial driver's license or
136-H endorsement;
143+(1) issuance or renewal of a commercial
144+learner's permit or a commercial driver's license;
145+(2) an upgrade of a commercial learner's
146+permit to a commercial driver's license; and

140161 (4) issue, renew, transfer or upgrade a

149-vehicle. The division shall complete the downgrade and enter

198+vehicle. The division shall complete and record on the

201+E. The division shall amend a driver's eligibility

181203 that a condition resulting in a restriction on a commercial
182204 driver's license or a commercial learner's permit no longer
183205 exists or was erroneous. Pursuant to this subsection, the

185-(1) terminate the commercial driver's

187-driver's license or commercial learner's permit privilege
188-from the driver's license if the division finds that the
189-commercial driver's license or commercial learner's permit
190-holder is no longer prohibited from operating a commercial
191-motor vehicle;

233256 SECTION 2. Section 65-3-14 NMSA 1978 (being Laws 2007,
234257 Chapter 151, Section 1, as amended) is amended to read:
235258 "65-3-14. DRUG AND ALCOHOL TESTING PROGRAM--REPORT OF
236259 POSITIVE TEST.--
237260 A. A motor carrier shall have an in-house drug and
238261 alcohol testing program that meets the requirements of 49
239262 C.F.R. part 382 or be a member of a consortium, as defined in
240263 49 C.F.R. part 382.107, that provides testing that meets the
241264 requirements of 49 C.F.R. part 382.
242265 B. A person or entity specified in 49 C.F.R. part
243266 382.103, who is not explicitly excepted by New Mexico law, is
244267 subject to the provisions of this section and shall report
245-positive test results or a refusal to submit to a test
246-pursuant to provisions in this section. A refusal to submit
247-to a pre-employment test shall not be considered a violation
248-of this section.

294318 Chapter 14, Section 13, as amended) is amended to read:
295319 "66-5-64. COMMERCIAL DRIVER'S LICENSE AND COMMERCIAL
296320 LEARNER'S PERMIT--CONTENT.--The commercial driver's license
297-shall be marked "commercial driver's license" or "CDL". The
298-commercial learner's permit shall be marked "commercial
