5353 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5454 SECTION 1. Section 61-29-2 NMSA 1978 (being Laws 1999,
5555 Chapter 127, Section 1, as amended) is amended to read:
5656 "61-29-2. DEFINITIONS AND EXCEPTIONS.--
5757 A. As used in Chapter 61, Article 29 NMSA 1978:
5858 (1) "agency relationship" means the fiduciary
5959 relationship created solely by an express written agency
6060 agreement between a person and a brokerage, authorizing the
6161 brokerage to act as an agent for the person according to the
6262 scope of authority granted in that express written agreement

9292 (2) "agent" means the brokerage authorized,
9393 solely by means of an express written agreement, to act as a
9494 fiduciary for a person and to provide real estate services that
9595 are subject to the jurisdiction of the commission; in the case
9696 of an associate broker, "agent" means the person who has been
9797 authorized to act by that associate broker's qualifying broker;
9898 (3) "associate broker" means a person who, for
9999 compensation or other valuable consideration, is associated
100100 with or engaged under contract by a qualifying broker to carry
101101 on the qualifying broker's business as a whole or partial
102102 vocation, and:
103103 (a) lists, sells or offers to sell real
104104 estate; buys or offers to buy real estate; or negotiates the
105105 purchase, sale or exchange of real estate or options on real
106106 estate;
107107 (b) is engaged in managing property for
108108 others;
109109 (c) leases, rents or auctions or offers
110110 to lease, rent or auction real estate;
111111 (d) advertises or makes any
112112 representation as being engaged in the business of buying,
113113 selling, exchanging, renting, leasing, auctioning or dealing
114114 with options on real estate for others as a whole or partial

144144 (e) engages in the business of charging
145145 an advance fee or contracting for collection of a fee in
146146 connection with a contract under which the qualifying broker
147147 undertakes primarily to promote the sale of real estate through
148148 its listing in a publication issued primarily for that purpose
149149 or for the purpose of referral of information concerning real
150150 estate to other qualifying brokers or associate brokers;
151151 (4) "auctioneer" means a person who auctions
152152 or offers to auction real property;
153153 (5) "brokerage" means a licensed qualifying
154154 broker and the licensed real estate business represented by the
155155 qualifying broker and its affiliated licensees;
156156 (6) "brokerage relationship" means the legal
157157 or contractual relationship between a person and a brokerage in
158158 a real estate transaction subject to the jurisdiction of the
159159 commission;
160160 (7) "client" means a person who has entered
161161 into an express written agreement with a brokerage for real
162162 estate services subject to the jurisdiction of the commission;
163163 (8) "commercial real estate" means real estate
164164 that is zoned:
165165 (a) for business or commercial use by a
166166 city or county; or
167167 (b) by a city or county to allow five or

198198 (9) "commission" means the New Mexico real
199199 estate commission;
200200 (10) "customer" means a person who uses real
201201 estate services without entering into an express written
202202 agreement with a brokerage subject to the jurisdiction of the
203203 commission;
204204 (11) "foreign broker" means a real estate
205205 broker who does not hold a real estate license issued by the
206206 commission, but who holds a current and valid real estate
207207 broker's license issued by another state in the United States,
208208 a province of Canada or any other sovereign nation;
209209 (12) "license" means a qualifying broker's
210210 license or an associate broker's license issued by the
211211 commission;
212212 (13) "licensee" means a person holding a valid
213213 qualifying broker's license or an associate broker's license
214214 subject to the jurisdiction of the commission;
215215 (14) "nonresident licensee" means an associate
216216 or qualifying broker holding a real estate license issued by
217217 the commission and whose license application address is not
218218 within the state of New Mexico;
219219 (15) "property management" means real estate
220220 services as specified by a management agreement that include

249249 marketing, showing, renting and leasing of real property;
250250 collection and disbursement of funds on behalf of the owner;
251251 supervision of employees and vendors; coordination of
252252 maintenance and repairs; management of tenant relations; and
253253 preparation of leases or rental agreements, financial reports
254254 and other documents. "Property management" does not mean
255255 inspections of property, repairs and maintenance incidental to
256256 the sale and marketing of property as authorized by the owner
257257 or the management of a condominium or homeowner association or
258258 advertising or taking reservations for vacation rental
259259 properties;
260260 (16) "qualifying broker" means a licensed real
261261 estate broker who has qualified a proprietorship, corporation,
262262 partnership or association to do business as a real estate
263263 brokerage in the state of New Mexico, who discharges the
264264 responsibilities specific to a qualifying broker as defined by
265265 the commission and who for compensation or other consideration
266266 from another:
267267 (a) lists, sells or offers to sell real
268268 estate; buys or offers to buy real estate; or negotiates the
269269 purchase, sale or exchange of real estate or options on real
270270 estate;
271271 (b) is engaged in managing property for
272272 others;

303303 (d) advertises or makes any

308308 (e) engages in the business of charging
309309 an advance fee or contracting for collection of a fee in
310310 connection with a contract under which the qualifying broker
311311 undertakes primarily to promote the sale of real estate through
312312 its listing in a publication issued primarily for that purpose
313313 or for the purpose of referral of information concerning real
314314 estate to other qualifying brokers or associate brokers;
315315 (17) "real estate" means land, improvements,
316316 leaseholds and other interests in real property that are less
317317 than a fee simple ownership interest, whether tangible or
318318 intangible; and
319319 (18) "transaction broker" means a qualifying
320320 broker, associate broker or brokerage that provides real estate
321321 services without entering into an agency relationship.
322322 B. A single act of a person in performing or
323323 attempting to perform an activity described in Paragraph (16)
324324 of Subsection A of this section makes the person a qualifying
325325 broker. A single act of a person in performing or attempting
326326 to perform an activity described in Paragraph (3) of Subsection

355355 A of this section makes the person an associate broker.
356356 C. The provisions of Chapter 61, Article 29 NMSA
357357 1978 do not apply to:
358358 (1) a person who as owner performs any of the
359359 activities included in this section with reference to property
360360 owned by the person, except when the sale or offering for sale
361361 of the property constitutes a subdivision containing one
362362 hundred or more parcels;
363363 (2) the employees of the owner or the
364364 employees of a qualifying broker acting on behalf of the owner,
365365 with respect to the property owned, if the acts are performed
366366 in the regular course of or incident to the management of the
367367 property and the investments;
368368 (3) isolated or sporadic transactions not
369369 exceeding two transactions annually in which a person acts as
370370 attorney-in-fact under a duly executed power of attorney
371371 delivered by an owner authorizing the person to finally
372372 consummate and to perform under any contract the sale, leasing
373373 or exchange of real estate on behalf of the owner; and the
374374 owner or attorney-in-fact has not used a power of attorney for
375375 the purpose of evading the provisions of Chapter 61, Article 29
376376 NMSA 1978;
377377 (4) transactions in which a person acts as
378378 attorney-in-fact under a duly executed power of attorney
379379 delivered by an owner related to the attorney-in-fact within

408408 the fourth degree of consanguinity or closer, authorizing the
409409 person to finally consummate and to perform under any contract
410410 for the sale, leasing or exchange of real estate on behalf of
411411 the owner;
412412 (5) the services rendered by an attorney at
413413 law in the performance of the attorney's duties as an attorney
414414 at law;
415415 (6) the services rendered in the performance
416416 of property management by an attorney at law;
417417 (7) the services rendered in the performance
418418 of property management by a contractor licensed pursuant to the
419419 Construction Industries Licensing Act;
420420 [(6)] (8) a person acting in the capacity of a
421421 receiver, trustee in bankruptcy, administrator or executor, a
422422 person selling real estate pursuant to an order of any court or
423423 a trustee acting under a trust agreement, deed of trust or will
424424 or the regular salaried employee of a trustee;
425425 [(7)] (9) the activities of a salaried
426426 employee of a governmental agency acting within the scope of
427427 employment;
428428 [(8)] (10) persons who deal exclusively in
429429 mineral leases or the sale or purchase of mineral rights or
430430 royalties in any case in which the fee to the land or the
431431 surface rights are in no way involved in the transaction; or
432432 [(9)] (11) an auctioneer; provided that

461461 payments to an auctioneer for services rendered in connection
462462 with an auction shall be made to the auctioneer by a qualifying
463463 broker, and prior to performing an auction of real estate, the
464464 auctioneer shall enter into a transaction-specific written
465465 agreement with a qualifying broker that includes:
466466 (a) a description of the parties, the
467467 real estate and any additional information necessary to
468468 identify the specific transaction governed by the agreement;
469469 (b) the terms of compensation between
470470 the auctioneer and the qualifying broker;
471471 (c) the effective date and definitive
472472 termination date of the agreement; and
473473 (d) a statement that the auctioneer
474474 agrees to: 1) cooperate fully with the qualifying broker and
475475 all associate brokers designated by the qualifying broker; 2)
476476 conduct all contact with parties, including the general public
477477 and other brokers, in association with the qualifying broker or
478478 associate brokers designated by the qualifying broker; and 3)
479479 conduct all marketing and solicitations for business in the
480480 name of the qualifying broker."
