5454 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5555 SECTION 1. Section 30-31-20 NMSA 1978 (being Laws 1972,
5656 Chapter 84, Section 20, as amended) is amended to read:
5757 "30-31-20. TRAFFICKING CONTROLLED SUBSTANCES--
5858 VIOLATION.--
5959 A. As used in the Controlled Substances Act,
6060 "traffic" means the:
6161 (1) manufacture of a controlled substance
6262 enumerated in Schedules I through V or a controlled substance

149149 B. Except as authorized by the Controlled
150150 Substances Act, it is unlawful for a person to intentionally
151151 traffic. A person who violates this subsection is:
152152 (1) for the first offense, except as provided
153153 in Paragraph (2) of this subsection , guilty of a second degree
154154 felony for trafficking a controlled substance and shall be
155155 sentenced pursuant to the provisions of Section 31-18-15 NMSA
156156 1978; [and] provided that the person shall serve a minimum term
157157 of imprisonment of nine years;
158158 (2) for the first offense resulting in the
159159 death of a human being, guilty of a second degree felony for
160160 trafficking a controlled substance resulting in the death of a
161161 human being and shall be sentenced pursuant to the provisions
162162 of Section 31-18-15 NMSA 1978; provided that the person shall
163163 serve a minimum term of imprisonment of twelve years ;
164164 [(2)] (3) for the second and subsequent
165165 offenses, except as provided in Paragraph (4) of this
166166 subsection, guilty of a first degree felony and shall be
167167 sentenced pursuant to the provisions of Section 31-18-15 NMSA

202202 C. A person who knowingly violates Subsection B of
203203 this section within a drug-free school zone excluding private
204204 property residentially zoned or used primarily as a residence
205205 is guilty of a first degree felony and shall be sentenced
206206 pursuant to the provisions of Section 31-18-15 NMSA 1978."
207207 SECTION 2. Section 30-31-21 NMSA 1978 (being Laws 1972,
208208 Chapter 84, Section 21, as amended) is amended to read:
209209 "30-31-21. DISTRIBUTION TO A MINOR.--
210210 A. Except as authorized by the Controlled
211211 Substances Act, no person who is eighteen years of age or older
212212 shall intentionally distribute a controlled substance to a
213213 person under the age of eighteen years.
214214 B. Except as provided in Subsection C of this
215215 section, any person who violates this section with respect to a
216216 controlled substance enumerated in Schedule I, II, III or IV or
217217 a controlled substance analog of any controlled substance
218218 enumerated in Schedule I, II, III or IV is:
219219 (1) for the first offense, guilty of a second
220220 degree felony and shall be sentenced pursuant to the provisions

255255 is a narcotic drug or a controlled substance analog of a
256256 controlled substance enumerated in Schedule I or II that is a
257257 narcotic drug, methamphetamine, its salts, isomers or salts of
258258 isomers as enumerated in Schedule II or a controlled substance
259259 analog of methamphetamine, its salts, isomers or salts of
260260 isomers is guilty of a first degree felony and shall be
261261 sentenced pursuant to the provisions of Section 31-18-15 NMSA
262262 1978."
263263 SECTION 3. Section 30-31-22 NMSA 1978 (being Laws 1972,
264264 Chapter 84, Section 22, as amended) is amended to read:
265265 "30-31-22. CONTROLLED OR COUNTERFEIT SUBSTANCES--
266266 DISTRIBUTION PROHIBITED.--
267267 A. Except as authorized by the Controlled
268268 Substances Act, it is unlawful for a person to intentionally
269269 distribute or possess with intent to distribute a controlled
270270 substance or a controlled substance analog except a substance
271271 enumerated in Schedule I or II that is a narcotic drug, a
272272 controlled substance analog of a controlled substance
273273 enumerated in Schedule I or II that is a narcotic drug or

303303 person who violates this subsection with respect to:
304304 (1) synthetic cannabinoids is:
305305 (a) for the first offense, guilty of a
306306 fourth degree felony and shall be sentenced pursuant to the
307307 provisions of Section 31-18-15 NMSA 1978;
308308 (b) for the second and subsequent
309309 offenses, guilty of a third degree felony and shall be
310310 sentenced pursuant to the provisions of Section 31-18-15 NMSA
311311 1978;
312312 (c) for the first offense, if more than
313313 one hundred pounds is possessed with intent to distribute or
314314 distributed or both, guilty of a third degree felony and shall
315315 be sentenced pursuant to the provisions of Section 31-18-15
316316 NMSA 1978; and
317317 (d) for the second and subsequent
318318 offenses, if more than one hundred pounds is possessed with
319319 intent to distribute or distributed or both, guilty of a second
320320 degree felony and shall be sentenced pursuant to the provisions
321321 of Section 31-18-15 NMSA 1978;
322322 (2) any other controlled substance enumerated
323323 in Schedule I, II, III or IV or a controlled substance analog
324324 of a controlled substance enumerated in Schedule I, II, III or
325325 IV except a substance enumerated in Schedule I or II that is a
326326 narcotic drug, a controlled substance analog of a controlled

356356 drug or methamphetamine, its salts, isomers and salts of
357357 isomers, is:
358358 (a) for the first offense, guilty of a
359359 third degree felony and shall be sentenced pursuant to the
360360 provisions of Section 31-18-15 NMSA 1978; and
361361 (b) for the second and subsequent
362362 offenses, guilty of a second degree felony and shall be
363363 sentenced pursuant to the provisions of Section 31-18-15 NMSA
364364 1978; and
365365 (3) a controlled substance enumerated in
366366 Schedule V or a controlled substance analog of a controlled
367367 substance enumerated in Schedule V is guilty of a misdemeanor
368368 and shall be punished by a fine of not less than one hundred
369369 dollars ($100) or more than five hundred dollars ($500) or by
370370 imprisonment for a definite term not less than one hundred
371371 eighty days but less than one year, or both.
372372 B. It is unlawful for a person to distribute gamma
373373 hydroxybutyric acid or flunitrazepam to another person without
374374 that person's knowledge and with intent to commit a crime
375375 against that person, including criminal sexual penetration.
376376 For the purposes of this subsection, "without that person's
377377 knowledge" means the person is unaware that a substance with
378378 the ability to alter that person's ability to appraise conduct
379379 or to decline participation in or communicate unwillingness to

409409 Any person who violates this subsection is:
410410 (1) for the first offense, guilty of a third
411411 degree felony and shall be sentenced pursuant to the provisions
412412 of Section 31-18-15 NMSA 1978; and
413413 (2) for the second and subsequent offenses,
414414 guilty of a second degree felony and shall be sentenced
415415 pursuant to the provisions of Section 31-18-15 NMSA 1978.
416416 C. Except as authorized by the Controlled
417417 Substances Act, it is unlawful for a person to intentionally
418418 create or deliver, or possess with intent to deliver, a
419419 counterfeit substance. A person who violates this subsection
420420 with respect to:
421421 (1) a counterfeit substance enumerated in
422422 Schedule I, II, III or IV, except a counterfeit substance of a
423423 controlled substance enumerated in Schedule I or II that is a
424424 narcotic drug or a counterfeit substance of a controlled
425425 substance analog of a controlled substance enumerated in
426426 Schedule I or II that is a narcotic drug , is guilty of a fourth
427427 degree felony and shall be sentenced pursuant to the provisions
428428 of Section 31-18-15 NMSA 1978; and
429429 (2) a counterfeit substance enumerated in
430430 Schedule V is guilty of a petty misdemeanor and shall be
431431 punished by a fine of not more than one hundred dollars ($100)
432432 or by imprisonment for a definite term not to exceed six

462462 D. A person who knowingly violates Subsection A or
463463 C of this section while within a drug-free school zone with
464464 respect to:
465465 (1) synthetic cannabinoids is:
466466 (a) for the first offense, guilty of a
467467 third degree felony and shall be sentenced pursuant to the
468468 provisions of Section 31-18-15 NMSA 1978;
469469 (b) for the second and subsequent
470470 offenses, guilty of a second degree felony and shall be
471471 sentenced pursuant to the provisions of Section 31-18-15 NMSA
472472 1978;
473473 (c) for the first offense, if more than
474474 one hundred pounds is possessed with intent to distribute or
475475 distributed or both, guilty of a second degree felony and shall
476476 be sentenced pursuant to the provisions of Section 31-18-15
477477 NMSA 1978; and
478478 (d) for the second and subsequent
479479 offenses, if more than one hundred pounds is possessed with
480480 intent to distribute or distributed or both, guilty of a first
481481 degree felony and shall be sentenced pursuant to the provisions
482482 of Section 31-18-15 NMSA 1978;
483483 (2) any other controlled substance enumerated
484484 in Schedule I, II, III or IV or a controlled substance analog

529529 felony and shall be sentenced pursuant to the provisions of
530530 Section 31-18-15 NMSA 1978; and
531531 (4) the intentional creation, delivery or
532532 possession with the intent to deliver:
533533 (a) a counterfeit substance enumerated
534534 in Schedule I, II, III or IV, except a counterfeit substance of
535535 a controlled substance enumerated in Schedule I or II that is a
536536 narcotic drug or a counterfeit substance of a controlled
537537 substance analog of a controlled substance enumerated in

577577 cannabinoids for no remuneration shall be treated as provided
578578 in Paragraph (1) of Subsection B of Section 30-31-23 NMSA
579579 1978."
580580 SECTION 4. Section 31-18-15 NMSA 1978 (being Laws 1977,
581581 Chapter 216, Section 4, as amended) is amended to read:
582582 "31-18-15. SENTENCING AUTHORITY--NONCAPITAL FELONIES--
583583 BASIC SENTENCES AND FINES--PAROLE AUTHORITY--MERITORIOUS

585585 A. As used in a statute that establishes a

682682 B. The appropriate basic sentence of imprisonment
683683 shall be imposed upon a person convicted and sentenced pursuant
684684 to Subsection A of this section, unless the court alters the
685685 sentence pursuant to the provisions of the Criminal Sentencing
686686 Act.
687687 C. A period of parole shall be imposed only for
688688 felony convictions wherein a person is sentenced to
689689 imprisonment of more than one year, unless the parties to a
690690 proceeding agree that a period of parole should be imposed. If
691691 a period of parole is imposed, the court shall include in the
692692 judgment and sentence of each person convicted and sentenced to
693693 imprisonment in a corrections facility designated by the
694694 corrections department authority for a period of parole to be
695695 served in accordance with the provisions of Section 31-21-10
696696 NMSA 1978 after the completion of any actual time of
697697 imprisonment and authority to require, as a condition of

727727 reimbursement to a law enforcement agency or local crime
728728 stopper program in accordance with the provisions of that
729729 section. If imposed, the period of parole shall be deemed to
730730 be part of the sentence of the convicted person in addition to
731731 the basic sentence imposed pursuant to Subsection A of this
732732 section together with alterations, if any, pursuant to the
733733 provisions of the Criminal Sentencing Act.
734734 D. When a court imposes a sentence of imprisonment
735735 pursuant to the provisions of Section 31-18-15.1, 31-18-16 or
736736 31-18-17 NMSA 1978 and suspends or defers the basic sentence of
737737 imprisonment provided pursuant to the provisions of Subsection
738738 A of this section, the period of parole shall be served in
739739 accordance with the provisions of Section 31-21-10 NMSA 1978
740740 for the degree of felony for the basic sentence for which the
741741 inmate was convicted. For the purpose of designating a period
742742 of parole, a court shall not consider that the basic sentence
743743 of imprisonment was suspended or deferred and that the inmate
744744 served a period of imprisonment pursuant to the provisions of
745745 the Criminal Sentencing Act.
746746 E. The court may, in addition to the imposition of
747747 a basic sentence of imprisonment, impose a fine not to exceed:
748748 (1) for a first degree felony resulting in the
749749 death of a child, seventeen thousand five hundred dollars

841841 F. When the court imposes a sentence of
842842 imprisonment for a felony offense, the court shall indicate
