4949 RELATING TO PUBLIC HEALTH; CREATING THE EXTREME WEATHER
5050 RESILIENCE FUND; MAKING A TRANSFER FROM THE GENERAL FUND TO THE
5151 EXTREME WEATHER RESILIENCE FUND; MAKING AN APPROPRIATION.
5252 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5353 SECTION 1. A new section of the Public Health Act is
5454 enacted to read:
5555 "[NEW MATERIAL] EXTREME WEATHER RESILIENCE FUND CREATED.--
5656 A. The "extreme weather resilience fund" is created
5757 in the state treasury. The fund consists of appropriations,
5858 gifts, grants, donations, income from investment of the fund
5959 and any other money otherwise allocated to the fund. The
6060 department shall administer the fund. Money in the fund is
6161 appropriated to the department for the purposes set forth in
6262 Subsection B of this section. Disbursements from the fund

9090 shall be made by warrant of the secretary of finance and
9191 administration pursuant to vouchers signed by the secretary or
9292 the secretary's authorized representative. Any unexpended or
9393 unencumbered balance remaining at the end of fiscal year 2028
9494 shall revert to the general fund.
9595 B. Money in the extreme weather resilience fund may
9696 be used by the department to make grants of up to one million
9797 dollars ($1,000,000) to political subdivisions of the state or
9898 Indian nations, tribes or pueblos to prepare for and respond to
9999 public health emergencies related to extreme weather and other
100100 climate impacts; provided that grants to an Indian nation,
101101 tribe or pueblo shall be expended only within the exterior
102102 boundaries of the state.
103103 C. The secretary shall prioritize grant
104104 applications that:
105105 (1) emphasize planning, projects and
106106 activities that benefit people in low-income and disadvantaged
107107 communities;
108108 (2) integrate public health concerns and
109109 recommendations with other local climate adaptation plans or
110110 local emergency preparedness plans, projects and activities;
111111 (3) emphasize planning, projects and
112112 activities that are also eligible for grants from federal or
113113 other state programs or help New Mexico become eligible for
114114 federal funds; and

145145 D. At least fifty percent of the total grants
146146 approved by the secretary shall be awarded to political
147147 subdivisions with total human populations equal to or fewer
148148 than one hundred thousand according to the most recent federal
149149 decennial census."
150150 SECTION 2. TRANSFER.--Twelve million dollars
151151 ($12,000,000) is transferred from the general fund to the
152152 extreme weather resilience fund.
