60	60	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
61	61	SECTION 1. Section 28-1-7 NMSA 1978 (being Laws 1969,
62	62	Chapter 196, Section 7, as amended) is amended to read:

90	90	"28-1-7. UNLAWFUL DISCRIMINATORY PRACTICE.--It is an
91	91	unlawful discriminatory practice for:
92	92	A. an employer, unless based on a bona fide
93	93	occupational qualification or other statutory prohibition, to
94	94	refuse to hire, to discharge, to promote or demote or to
95	95	discriminate in matters of compensation, terms, conditions or
96	96	privileges of employment against any person otherwise qualified
97	97	because of race, age, religion, color, national origin,
98	98	ancestry, sex, sexual orientation, gender, gender identity,
99	99	pregnancy, childbirth or condition related to pregnancy or
100	100	childbirth, physical or mental disability, serious medical
101	101	condition or military status, or, if the employer has fifty or
102	102	more employees, spousal affiliation; provided, however, that 29
103	103	U.S.C. Section 631(c)(1) and (2) shall apply to discrimination
104	104	based on age;
105	105	B. a labor organization to exclude a person or to
106	106	expel or otherwise discriminate against any of its members or
107	107	against any employer or employee because of race, religion,
108	108	color, national origin, ancestry, sex, sexual orientation,
109	109	gender, gender identity, pregnancy, childbirth or condition
110	110	related to pregnancy or childbirth, spousal affiliation,
111	111	physical or mental disability, serious medical condition or
112	112	military status;
113	113	C. any employer, labor organization or joint
114	114	apprenticeship committee to refuse to admit or employ any

154	154	any form of application for employment or membership or to make
155	155	any inquiry regarding prospective membership or employment that
156	156	expresses, directly or indirectly, any limitation,
157	157	specification or discrimination as to race, color, religion,
158	158	national origin, ancestry, sex, sexual orientation, gender,
159	159	gender identity, pregnancy, childbirth or condition related to
160	160	pregnancy or childbirth, physical or mental disability, serious
161	161	medical condition or military status, or, if the employer has
162	162	fifty or more employees, spousal affiliation, unless based on a
163	163	bona fide occupational qualification;
164	164	E. an employment agency to refuse to list and
165	165	properly classify for employment or refer a person for
166	166	employment in a known available job, for which the person is
167	167	otherwise qualified, because of race, religion, color, national

210	210	F. any person in any public accommodation to make a
211	211	distinction, directly or indirectly, in offering or refusing to
212	212	offer its services, facilities, accommodations or goods to any
213	213	person because of race, religion, color, national origin,
214	214	ancestry, sex, sexual orientation, gender, gender identity,
215	215	pregnancy, childbirth or condition related to pregnancy or
216	216	childbirth, spousal affiliation, physical or mental disability
217	217	or military status; provided that the physical or mental
218	218	disability is unrelated to a person's ability to acquire or
219	219	rent and maintain particular real property or housing

250	250	(1) refuse to sell, rent, assign, lease or

303	303	(3) print, circulate, display or mail or cause
304	304	to be printed, circulated, displayed or mailed any statement,
305	305	advertisement, publication or sign or use any form of
306	306	application for the purchase, rental, lease, assignment or
307	307	sublease of any housing accommodation or real property or to
308	308	make any record or inquiry regarding the prospective purchase,
309	309	rental, lease, assignment or sublease of any housing
310	310	accommodation or real property that expresses any preference,
311	311	limitation or discrimination as to race, religion, color,
312	312	national origin, ancestry, sex, sexual orientation, gender,
313	313	gender identity, pregnancy, childbirth or condition related to
314	314	pregnancy or childbirth, spousal affiliation, physical or
315	315	mental disability or military status; provided that the
316	316	physical or mental disability is unrelated to a person's
317	317	ability to acquire or rent and maintain particular real
318	318	property or housing accommodation; or
319	319	(4) submit a deed or other instrument of
320	320	writing to the office of the county clerk for recording with an
321	321	attached restrictive covenant, the intent or effect of which is
322	322	to restrict ownership, residency or use of real property
323	323	because of race, religion, color, national origin, ancestry,
324	324	sex, sexual orientation, gender identity, pregnancy, childbirth
325	325	or condition related to pregnancy or childbirth, spousal
326	326	affiliation, physical or mental disability or military status;

356	356	for financial assistance for the acquisition, construction,
357	357	rehabilitation, repair or maintenance of any housing
358	358	accommodation or real property or for any type of consumer
359	359	credit, including financial assistance for the acquisition of
360	360	any consumer good as defined by Section 55-9-102 NMSA 1978, to:
361	361	(1) consider the race, religion, color,
362	362	national origin, ancestry, sex, sexual orientation, gender,
363	363	gender identity, pregnancy, childbirth or condition related to
364	364	pregnancy or childbirth, spousal affiliation or physical or
365	365	mental disability of any individual in the granting,
366	366	withholding, extending, modifying or renewing or in the fixing
367	367	of the rates, terms, conditions or provisions of any financial
368	368	assistance or in the extension of services in connection with
369	369	the request for financial assistance; or
370	370	(2) use any form of application for financial
371	371	assistance or to make any record or inquiry in connection with
372	372	applications for financial assistance that expresses, directly
373	373	or indirectly, any limitation, specification or discrimination
374	374	as to race, religion, color, national origin, ancestry, sex,
375	375	sexual orientation, gender, gender identity, pregnancy,
376	376	childbirth or condition related to pregnancy or childbirth,
377	377	spousal affiliation or physical or mental disability;
378	378	I. any person or employer to:
379	379	(1) aid, abet, incite, compel or coerce the

408	408	doing of any unlawful discriminatory practice or to attempt to
409	409	do so;
410	410	(2) engage in any form of threats, reprisal or
411	411	discrimination against any person who has opposed any unlawful
412	412	discriminatory practice or has filed a complaint, testified or
413	413	participated in any proceeding under the Human Rights Act; or
414	414	(3) willfully obstruct or prevent any person
415	415	from complying with the provisions of the Human Rights Act or
416	416	to resist, prevent, impede or interfere with the commission or
417	417	any of its members, staff or representatives in the performance
418	418	of their duties under the Human Rights Act;
419	419	J. any employer to refuse or fail to accommodate a
420	420	person's physical or mental disability or serious medical
421	421	condition, unless such accommodation is unreasonable or an
422	422	undue hardship;
423	423	K. any employer to refuse or fail to make
424	424	reasonable accommodation for an employee or job applicant with
425	425	a need arising from pregnancy, childbirth or condition related
426	426	to pregnancy or childbirth;
427	427	L. any employer to require an employee with a need
428	428	arising from pregnancy, childbirth or condition related to
429	429	pregnancy or childbirth to take paid or unpaid leave if another
430	430	reasonable accommodation can be provided unless the employee
431	431	voluntarily requests to be placed on leave or the employee is
432	432	placed on leave pursuant to federal law; or

462	462	refuse or otherwise limit or put conditions on services to a
463	463	person because of race, age, religion, color, national origin,
464	464	ancestry, sex, sexual orientation, gender, gender identity,
465	465	pregnancy, childbirth or condition related to pregnancy or
466	466	childbirth, physical or mental disability, serious medical
467	467	condition or spousal affiliation; provided that nothing in this
468	468	subsection shall be construed to require a governmental entity
469	469	or a public contractor to provide services or programs beyond
470	470	services or programs to the specific populations that the
471	471	governmental entity or public contractor is tasked with
472	472	serving."
473	473	SECTION 2. A new section of Chapter 47, Article 1 NMSA
474	474	1978 is enacted to read:
475	475	"[NEW MATERIAL] UNLAWFUL RESTRICTIVE COVENANTS--
476	476	RECORDING.--
477	477	A. Any covenant attached to real property that
478	478	contains language with the intent or effect to restrict
479	479	ownership, residency or use of real property because of a
480	480	person's race, religion, national origin or any other class
481	481	that is protected by the Human Rights Act is void as against
482	482	public policy.
483	483	B. No deed or other instrument of writing relating
484	484	to real property shall use gender-specific language when
485	485	referring to grantors or grantees.

514	514	C. No deed or other instrument of writing shall be
515	515	submitted to be recorded in the property records of the county
516	516	clerk that contains a covenant or language that meets the
517	517	description in Subsection A or B of this section. A county
518	518	clerk may reject an instrument of writing submitted to be
519	519	recorded if it contains a covenant or language that meets the
520	520	description in Subsection A or B of this section.
521	521	D. When preparing a deed or other instrument of
522	522	writing to be recorded in the office of the county clerk, a
523	523	title company, an attorney or any other person shall remove a
524	524	covenant or language that meets the description in Subsection A
525	525	or B of this section from the description of real property. A
526	526	deed or other instrument of writing may contain the following
527	527	disclaimer to comply with this section:
528	528	"It is the policy of the state of New Mexico that there be
529	529	no discrimination in the ownership, residency or use of real
530	530	property. Any covenants that would restrict such ownership in
531	531	violation of state or federal law is hereby void as against
532	532	public policy.".
533	533	E. Any person with an ownership or financial
534	534	interest in real property may, at any time, re-record the deed
535	535	to such property so that the deed conforms with the
536	536	requirements of this section."
