6060 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

9090 "28-1-7. UNLAWFUL DISCRIMINATORY PRACTICE.--It is an
9191 unlawful discriminatory practice for:
9292 A. an employer, unless based on a bona fide
9393 occupational qualification or other statutory prohibition, to
9494 refuse to hire, to discharge, to promote or demote or to
9595 discriminate in matters of compensation, terms, conditions or
9696 privileges of employment against any person otherwise qualified
9797 because of race, age, religion, color, national origin,
9898 ancestry, sex, sexual orientation, gender, gender identity,
9999 pregnancy, childbirth or condition related to pregnancy or
100100 childbirth, physical or mental disability, serious medical
101101 condition or military status, or, if the employer has fifty or
102102 more employees, spousal affiliation; provided, however, that 29
103103 U.S.C. Section 631(c)(1) and (2) shall apply to discrimination
104104 based on age;
105105 B. a labor organization to exclude a person or to
106106 expel or otherwise discriminate against any of its members or
107107 against any employer or employee because of race, religion,
108108 color, national origin, ancestry, sex, sexual orientation,
109109 gender, gender identity, pregnancy, childbirth or condition
110110 related to pregnancy or childbirth, spousal affiliation,
111111 physical or mental disability, serious medical condition or
112112 military status;
113113 C. any employer, labor organization or joint
114114 apprenticeship committee to refuse to admit or employ any

155155 any inquiry regarding prospective membership or employment that
156156 expresses, directly or indirectly, any limitation,
157157 specification or discrimination as to race, color, religion,
158158 national origin, ancestry, sex, sexual orientation, gender,
159159 gender identity, pregnancy, childbirth or condition related to
160160 pregnancy or childbirth, physical or mental disability, serious
161161 medical condition or military status, or, if the employer has
162162 fifty or more employees, spousal affiliation, unless based on a
163163 bona fide occupational qualification;
164164 E. an employment agency to refuse to list and
165165 properly classify for employment or refer a person for
166166 employment in a known available job, for which the person is
167167 otherwise qualified, because of race, religion, color, national

211211 distinction, directly or indirectly, in offering or refusing to
212212 offer its services, facilities, accommodations or goods to any
213213 person because of race, religion, color, national origin,
214214 ancestry, sex, sexual orientation, gender, gender identity,
215215 pregnancy, childbirth or condition related to pregnancy or
216216 childbirth, spousal affiliation, physical or mental disability
217217 or military status; provided that the physical or mental
218218 disability is unrelated to a person's ability to acquire or
219219 rent and maintain particular real property or housing
220220 accommodation;

250250 (1) refuse to sell, rent, assign, lease or

303303 (3) print, circulate, display or mail or cause
304304 to be printed, circulated, displayed or mailed any statement,
305305 advertisement, publication or sign or use any form of
306306 application for the purchase, rental, lease, assignment or
307307 sublease of any housing accommodation or real property or to
308308 make any record or inquiry regarding the prospective purchase,
309309 rental, lease, assignment or sublease of any housing
310310 accommodation or real property that expresses any preference,
311311 limitation or discrimination as to race, religion, color,
312312 national origin, ancestry, sex, sexual orientation, gender,
313313 gender identity, pregnancy, childbirth or condition related to
314314 pregnancy or childbirth, spousal affiliation, physical or
315315 mental disability or military status; provided that the
316316 physical or mental disability is unrelated to a person's
317317 ability to acquire or rent and maintain particular real
318318 property or housing accommodation; or
319319 (4) submit a deed or other instrument of
320320 writing to the office of the county clerk for recording with an
321321 attached restrictive covenant, the intent or effect of which is
322322 to restrict ownership, residency or use of real property
323323 because of race, religion, color, national origin, ancestry,
324324 sex, sexual orientation, gender identity, pregnancy, childbirth
325325 or condition related to pregnancy or childbirth, spousal
326326 affiliation, physical or mental disability or military status;

355355 H. any person to whom application is made either
356356 for financial assistance for the acquisition, construction,
357357 rehabilitation, repair or maintenance of any housing
358358 accommodation or real property or for any type of consumer
359359 credit, including financial assistance for the acquisition of
360360 any consumer good as defined by Section 55-9-102 NMSA 1978, to:
361361 (1) consider the race, religion, color,
362362 national origin, ancestry, sex, sexual orientation, gender,
363363 gender identity, pregnancy, childbirth or condition related to
364364 pregnancy or childbirth, spousal affiliation or physical or
365365 mental disability of any individual in the granting,
366366 withholding, extending, modifying or renewing or in the fixing
367367 of the rates, terms, conditions or provisions of any financial
368368 assistance or in the extension of services in connection with
369369 the request for financial assistance; or
370370 (2) use any form of application for financial
371371 assistance or to make any record or inquiry in connection with
372372 applications for financial assistance that expresses, directly
373373 or indirectly, any limitation, specification or discrimination
374374 as to race, religion, color, national origin, ancestry, sex,
375375 sexual orientation, gender, gender identity, pregnancy,
376376 childbirth or condition related to pregnancy or childbirth,
377377 spousal affiliation or physical or mental disability;
378378 I. any person or employer to:
379379 (1) aid, abet, incite, compel or coerce the

408408 doing of any unlawful discriminatory practice or to attempt to
409409 do so;
410410 (2) engage in any form of threats, reprisal or
411411 discrimination against any person who has opposed any unlawful
412412 discriminatory practice or has filed a complaint, testified or
413413 participated in any proceeding under the Human Rights Act; or
414414 (3) willfully obstruct or prevent any person
415415 from complying with the provisions of the Human Rights Act or
416416 to resist, prevent, impede or interfere with the commission or
417417 any of its members, staff or representatives in the performance
418418 of their duties under the Human Rights Act;
419419 J. any employer to refuse or fail to accommodate a
420420 person's physical or mental disability or serious medical
421421 condition, unless such accommodation is unreasonable or an
422422 undue hardship;
423423 K. any employer to refuse or fail to make
424424 reasonable accommodation for an employee or job applicant with
425425 a need arising from pregnancy, childbirth or condition related
426426 to pregnancy or childbirth;
427427 L. any employer to require an employee with a need
428428 arising from pregnancy, childbirth or condition related to
429429 pregnancy or childbirth to take paid or unpaid leave if another
430430 reasonable accommodation can be provided unless the employee
431431 voluntarily requests to be placed on leave or the employee is
432432 placed on leave pursuant to federal law; or

461461 M. a governmental entity or a public contractor to
462462 refuse or otherwise limit or put conditions on services to a
463463 person because of race, age, religion, color, national origin,
464464 ancestry, sex, sexual orientation, gender, gender identity,
465465 pregnancy, childbirth or condition related to pregnancy or
466466 childbirth, physical or mental disability, serious medical
467467 condition or spousal affiliation; provided that nothing in this
468468 subsection shall be construed to require a governmental entity
469469 or a public contractor to provide services or programs beyond
470470 services or programs to the specific populations that the
471471 governmental entity or public contractor is tasked with
472472 serving."
473473 SECTION 2. A new section of Chapter 47, Article 1 NMSA
474474 1978 is enacted to read:
475475 "[NEW MATERIAL] UNLAWFUL RESTRICTIVE COVENANTS--
476476 RECORDING.--
477477 A. Any covenant attached to real property that
478478 contains language with the intent or effect to restrict
479479 ownership, residency or use of real property because of a
480480 person's race, religion, national origin or any other class
481481 that is protected by the Human Rights Act is void as against
482482 public policy.
483483 B. No deed or other instrument of writing relating
484484 to real property shall use gender-specific language when
485485 referring to grantors or grantees.

514514 C. No deed or other instrument of writing shall be
515515 submitted to be recorded in the property records of the county
516516 clerk that contains a covenant or language that meets the
517517 description in Subsection A or B of this section. A county
518518 clerk may reject an instrument of writing submitted to be
519519 recorded if it contains a covenant or language that meets the
520520 description in Subsection A or B of this section.
521521 D. When preparing a deed or other instrument of
522522 writing to be recorded in the office of the county clerk, a
523523 title company, an attorney or any other person shall remove a
524524 covenant or language that meets the description in Subsection A
525525 or B of this section from the description of real property. A
526526 deed or other instrument of writing may contain the following
527527 disclaimer to comply with this section:
528528 "It is the policy of the state of New Mexico that there be
529529 no discrimination in the ownership, residency or use of real
530530 property. Any covenants that would restrict such ownership in
531531 violation of state or federal law is hereby void as against
532532 public policy.".
533533 E. Any person with an ownership or financial
534534 interest in real property may, at any time, re-record the deed
535535 to such property so that the deed conforms with the
536536 requirements of this section."
