50	50	RELATING TO HEALTH; REQUIRING THE DEPARTMENT OF HEALTH TO PAY
51	51	LICENSED BOARDING HOMES FOR HOUSING PEOPLE DISCHARGED FROM THE
52	52	NEW MEXICO BEHAVIORAL HEALTH INSTITUTE AT LAS VEGAS OR THE
53	53	UNIVERSITY OF NEW MEXICO ADULT PSYCHIATRIC CENTER; MAKING AN
54	54	APPROPRIATION.
55	55	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
56	56	SECTION 1. A new section of the Public Health Act is
57	57	enacted to read:
58	58	"[NEW MATERIAL] PAYMENT TO LICENSED BOARDING HOMES.--
59	59	A. Beginning January 1, 2026, the department of
60	60	health shall pay each boarding home that admits a person who is
61	61	discharged from the New Mexico behavioral health institute at
62	62	Las Vegas or the university of New Mexico adult psychiatric
63	63	center two hundred dollars ($200) for each month that the

91	91	person is a resident of the boarding home.
92	92	B. The department of health shall promulgate rules
93	93	for the payment of boarding homes. At a minimum, the rules
94	94	shall address:
95	95	(1) the documentation required to be submitted
96	96	by the boarding home to be eligible for payment; and
97	97	(2) safeguards to prevent fraud.
98	98	C. For the purposes of this section, "boarding
99	99	home" means a facility licensed by the department of health as
100	100	a boarding home."
101	101	SECTION 2. APPROPRIATION.--Two hundred fifty thousand
102	102	dollars ($250,000) is appropriated from the general fund to the
103	103	department of health for expenditure in fiscal year 2026 to pay
104	104	licensed boarding homes for housing people released from the
105	105	New Mexico behavioral health institute at Las Vegas or the
106	106	university of New Mexico adult psychiatric center. Any
107	107	unexpended or unencumbered balance remaining at the end of
108	108	fiscal year 2026 shall revert to the general fund.
