4949 RELATING TO PROCUREMENT; AMENDING THE PROCUREMENT CODE TO

5151 REQUEST ADJUSTMENTS IN REIMBURSEMENT RATES FOR HEALTH CARE.
5252 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5353 SECTION 1. A new section of the Procurement Code is
5454 enacted to read:
5555 "[NEW MATERIAL] WAGE AND BENEFITS CHANGES--CONTRACT
5656 ADJUSTMENTS.--When a contract with a state agency provides for
5757 a contractor to employ persons whose benefits and compensation
5858 are subject to adjustment due to changes in state statutes, the
5959 contractor may request the state agency to amend the terms of
6060 the contract to accommodate any increase to the contractor's
6161 expenses due to statutory adjustments in employee compensation
6262 and benefits. Any such request on the part of the contractor

9090 shall be made to the state agency within forty-five days of the
9191 date on which the relevant changes in state statutes become
9292 law. The state agency shall respond in writing to any such
9393 contract request."
9494 SECTION 2. [NEW MATERIAL] WAGE AND BENEFITS CHANGES--
9595 MEDICAID REIMBURSEMENT RATE ADJUSTMENTS.--
9696 A. When medicaid providers employ persons whose
9797 benefits and compensation are subject to adjustment due to
9898 changes in state statutes, the state agency responsible for
9999 providing payment to such medicaid providers shall request the
100100 federal centers for medicare and medicaid services to amend
101101 medicaid reimbursement rates to accommodate any increase to the
102102 medicaid provider's expenses due to statutory adjustments in
103103 employee compensation and benefits. The responsible state
104104 agency shall make such request within forty-five days of the
105105 date on which the relevant changes in state statutes become
106106 law.
107107 B. As used in this section:
108108 (1) "authority" means the health care
109109 authority;
110110 (2) "medicaid" means the medical assistance
111111 program established pursuant to Title 19 of the federal Social
112112 Security Act and rules issued pursuant to that act;
113113 (3) "medicaid provider" means a person that
114114 provides medicaid-related services to medicaid recipients; and

143143 (4) "medicaid recipient" means a person whom
144144 the authority has determined to be eligible to receive
145145 medicaid-related services in the state.
146146 SECTION 3. [NEW MATERIAL] WAGE AND BENEFITS CHANGES--
147147 MEDICARE REIMBURSEMENT RATE ADJUSTMENTS.--
148148 A. When medicare health care providers employ
149149 persons whose benefits and compensation are subject to
150150 adjustment due to changes in state statutes, the state agency
151151 responsible for providing payment to such medicare health care
152152 providers shall request the federal centers for medicare and
153153 medicaid services to amend medicare reimbursement rates to
154154 accommodate any increase to the medicare health care provider's
155155 expenses due to statutory adjustments in employee compensation
156156 and benefits. The responsible state agency shall make such
157157 request within forty-five days of the date on which the
158158 relevant changes in state statutes become law.
159159 B. As used in this section, "medicare health care
160160 provider" means a person that provides health care services,
161161 the charges for which either the provider or the recipient of
162162 the services is eligible for payment or reimbursement under
163163 provisions of the federal medicare program.
