49	49	RELATING TO PROCUREMENT; AMENDING THE PROCUREMENT CODE TO
50	50	PROVIDE FOR CONTRACT ADJUSTMENTS; REQUIRING THE STATE TO
51	51	REQUEST ADJUSTMENTS IN REIMBURSEMENT RATES FOR HEALTH CARE.
52	52	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
53	53	SECTION 1. A new section of the Procurement Code is
54	54	enacted to read:
55	55	"[NEW MATERIAL] WAGE AND BENEFITS CHANGES--CONTRACT
56	56	ADJUSTMENTS.--When a contract with a state agency provides for
57	57	a contractor to employ persons whose benefits and compensation
58	58	are subject to adjustment due to changes in state statutes, the
59	59	contractor may request the state agency to amend the terms of
60	60	the contract to accommodate any increase to the contractor's
61	61	expenses due to statutory adjustments in employee compensation
62	62	and benefits. Any such request on the part of the contractor

90	90	shall be made to the state agency within forty-five days of the
91	91	date on which the relevant changes in state statutes become
92	92	law. The state agency shall respond in writing to any such
93	93	contract request."
94	94	SECTION 2. [NEW MATERIAL] WAGE AND BENEFITS CHANGES--
95	95	MEDICAID REIMBURSEMENT RATE ADJUSTMENTS.--
96	96	A. When medicaid providers employ persons whose
97	97	benefits and compensation are subject to adjustment due to
98	98	changes in state statutes, the state agency responsible for
99	99	providing payment to such medicaid providers shall request the
100	100	federal centers for medicare and medicaid services to amend
101	101	medicaid reimbursement rates to accommodate any increase to the
102	102	medicaid provider's expenses due to statutory adjustments in
103	103	employee compensation and benefits. The responsible state
104	104	agency shall make such request within forty-five days of the
105	105	date on which the relevant changes in state statutes become
106	106	law.
107	107	B. As used in this section:
108	108	(1) "authority" means the health care
109	109	authority;
110	110	(2) "medicaid" means the medical assistance
111	111	program established pursuant to Title 19 of the federal Social
112	112	Security Act and rules issued pursuant to that act;
113	113	(3) "medicaid provider" means a person that
114	114	provides medicaid-related services to medicaid recipients; and

143	143	(4) "medicaid recipient" means a person whom
144	144	the authority has determined to be eligible to receive
145	145	medicaid-related services in the state.
146	146	SECTION 3. [NEW MATERIAL] WAGE AND BENEFITS CHANGES--
147	147	MEDICARE REIMBURSEMENT RATE ADJUSTMENTS.--
148	148	A. When medicare health care providers employ
149	149	persons whose benefits and compensation are subject to
150	150	adjustment due to changes in state statutes, the state agency
151	151	responsible for providing payment to such medicare health care
152	152	providers shall request the federal centers for medicare and
153	153	medicaid services to amend medicare reimbursement rates to
154	154	accommodate any increase to the medicare health care provider's
155	155	expenses due to statutory adjustments in employee compensation
156	156	and benefits. The responsible state agency shall make such
157	157	request within forty-five days of the date on which the
158	158	relevant changes in state statutes become law.
159	159	B. As used in this section, "medicare health care
160	160	provider" means a person that provides health care services,
161	161	the charges for which either the provider or the recipient of
162	162	the services is eligible for payment or reimbursement under
163	163	provisions of the federal medicare program.
