3333 RELATING TO PUBLIC RECORDS; AMENDING THE INSPECTION OF PUBLIC
3434 RECORDS ACT; AMENDING, REPEALING AND ENACTING SECTIONS OF THE
3535 NMSA 1978.
3636 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3737 SECTION 1. A new section of the Inspection of Public
3838 Records Act is enacted to read:
3939 "[NEW MATERIAL] DEFINITIONS.--As used in the Inspection of
4040 Public Records Act:
4141 A. "access device" means a card, plate, code,
4242 account number, personal identification number, electronic
4343 serial number, mobile identification number or other
4444 telecommunications service, equipment or instrument identifier
4545 or means of account access that alone or in conjunction with
4646 another access device may be used to:

7878 B. "adversarial administrative proceedings" means
7979 those administrative proceedings in which the administrative
8080 agency or institution of higher education acts as a
8181 complainant, respondent or decision maker in an adverse
8282 administrative proceeding, but "adversarial administrative
8383 proceedings" does not refer to those instances in which the
8484 administrative agency or institution acts in its own rulemaking
8585 capacity;
8686 C. "archival records" means public records that
8787 were created or received by a public body more than one year
8888 previously and excludes current records;
8989 D. "attorney work product" means a document or
9090 record that:
9191 (1) was prepared by an attorney representing a
9292 public body or prepared at such an attorney's express
9393 direction;
9494 (2) reflects a mental impression, conclusion,
9595 litigation strategy or legal theory of that attorney or the
9696 entity; and
9797 (3) was prepared for civil or criminal
9898 litigation, for adversarial administrative proceedings, in

128128 litigation or adversarial administrative proceedings or for
129129 guidance on the legal risks, strengths and weaknesses of an
130130 action of a public body;
131131 E. "broad and burdensome" means a request that
132132 takes more than one hour of time to locate the public record
133133 and to redact information exempt from inspection from the
134134 public record;
135135 F. "correctional facility" means a corrections
136136 facility as defined in Section 33-1-2 NMSA 1978, a county jail
137137 as authorized under Section 33-3-1 NMSA 1978, an alternative
138138 sentencing facility as authorized under Section 33-3A-1 NMSA
139139 1978, a juvenile detention home as authorized under Section
140140 33-6-1 NMSA 1978 and all similar institutions operated by any
141141 federal, state, tribal, local or other jurisdiction;
142142 G. "county canvassing board" means the board
143143 created under Section 1-13-1 NMSA 1978;
144144 H. "critical infrastructure" means public
145145 buildings, systems, including telecommunications centers and
146146 computers, power generation plants, dams, bridges and similar
147147 key resources, and systems related to utility services, fuel
148148 supply, energy, hazardous liquid, natural gas or coal, whether
149149 physical or virtual, so vital to the state that the incapacity
150150 or destruction of these systems would have a debilitating
151151 impact on security, state economic security, state public

181181 I. "current records" means public records that were
182182 created or received by a public body within the past year but
183183 does not include archival records;
184184 J. "custodian" means any person responsible for the
185185 maintenance, care or keeping of a public body's public records,
186186 regardless of whether the records are in that person's actual
187187 physical custody and control;
188188 K. "cybersecurity" means processes or capabilities
189189 that protect and defend systems, communications and information
190190 from exploitation and unauthorized use or modification;
191191 L. "educational institution" means a charter
192192 school, public school, state institution or a state educational
193193 institution as defined in Subsection X of Section 22-1-2 NMSA
194194 1978;
195195 M. "employee personal information" means the
196196 following information regarding employees of public bodies:
197197 (1) date of birth;
198198 (2) home address;
199199 (3) home telephone number or personal cell
200200 phone number;
201201 (4) photograph;
202202 (5) medical information;
203203 (6) motor vehicle operator's identification
204204 number;

237237 (10) any credit, debit or electronic fund
238238 transfer card number;
239239 (11) any account number at a bank or other
240240 financial institution; and
241241 (12) access device number;
242242 N. "file format" means the internal structure of an
243243 electronic file that defines the way it is stored and used;
244244 O. "good faith" includes:
245245 (1) when conducting a search in response to a
246246 request for inspection, making reasonable efforts to determine
247247 from other officials or employees of a public body whether a
248248 requested record exists and, if so, how the record can be
249249 inspected; and
250250 (2) when denying inspection reasonably relying
251251 on statutes, case law, advice of counsel, guidance issued by
252252 the attorney general and public policy;
253253 P. "human services" means services provided to an
254254 individual or an individual's family in need of services to
255255 assist the individual or the individual's family in achieving
256256 and maintaining basic self-sufficiency, including physical
257257 health, mental health, education, welfare, food and nutrition

287287 Q. "information technology systems" means computer
288288 hardware, storage media, networking equipment, physical
289289 devices, infrastructure, processes and code, firmware, software
290290 and ancillary products and services, including:
291291 (1) systems design and analysis;
292292 (2) development or modification of hardware or
293293 solutions used to create, process, store, secure or exchange
294294 electronic data;
295295 (3) information storage and retrieval systems;
296296 (4) voice, radio, video and data communication
297297 systems;
298298 (5) network, hosting and cloud-based systems;
299299 (6) simulation and testing;
300300 (7) interactions between a user and an
301301 information system; and
302302 (8) user and system credentials;
303303 R. "inspect" means to review all public records
304304 that are not excluded in Section 23 of this 2025 act;
305305 S. "insurer" means an entity from which a public
306306 body obtains insurance, as that term is defined in Section
307307 59A-1-5 NMSA 1978; the risk management division of the general
308308 services department as established by Section 15-7-2 NMSA 1978;
309309 the New Mexico workers' compensation assigned risk pool
310310 established by the Workers' Compensation Assigned Risk Pool

340340 T. "investigatory work product" means records
341341 obtained, compiled or prepared by a public entity in an effort
342342 to monitor and enforce compliance with the law or an order,
343343 provided that investigatory work product must be considered
344344 active as long as it is related to monitoring and enforcement
345345 activity conducted with a reasonable good-faith belief that it
346346 will lead to enforcement of the law or an order the public
347347 entity is charged by statute or other law with monitoring and
348348 enforcing;
349349 U. "law enforcement agency" means a law enforcement
350350 agency of the state, a state agency or a political subdivision
351351 of the state;
352352 V. "law enforcement records" means evidence in any
353353 form received or compiled in connection with a criminal
354354 investigation or prosecution by a law enforcement or
355355 prosecuting agency, including inactive matters or closed
356356 investigations to the extent that they contain the information
357357 listed in this subsection; provided that the presence of such
358358 information on a law enforcement record does not exempt the
359359 record from inspection;
360360 W. "library" means a library as defined in the
361361 Library Privacy Act;
362362 X. "medical information" means information about:
363363 (1) the past, present or future physical or

400400 heart rate and steps taken;
401401 Y. "person" means an individual, corporation,
402402 partnership, firm, association, entity or public body domiciled
403403 in New Mexico, but does not include individuals incarcerated in
404404 a correctional facility;
405405 Z. "private place" means the interior of a
406406 residence, the interior of a facility that offers health care
407407 or social services and other indoor places that are not open to
408408 members of the public and that a reasonable person would expect
409409 to be private;
410410 AA. "protected personal identifier information"
411411 means:
412412 (1) identification numbers, including:
413413 (a) taxpayer identification number;
414414 (b) financial account number;
415415 (c) insurance policy number;
416416 (d) credit or debit card number;

446446 (f) all but the year of a person's date

448448 (g) social security number;
449449 (2) with regard to a non-elected employee of a
450450 public body in the context of the person's employment, the
451451 employee's non-business, home street and mailing address, but
452452 not the city, state or zip code; and
453453 (3) with regard to all employees, elected or
454454 otherwise, of a public body in the context of the person's
455455 employment:
456456 (a) the employee's personal telephone
457457 number;
458458 (b) the employee's personal email
459459 address; and
460460 (c) information identifying the names or
461461 other information about family members, emergency contacts and
462462 dependents;
463463 BB. "public business" means all matters that relate
464464 or may foreseeably relate in any way to:
465465 (1) the performance of the public body's
466466 governmental functions, including any matter over which the
467467 public entity has supervision, control, jurisdiction or
468468 advisory power; and
469469 (2) the public body's use of public funds;

498498 CC. "public body" means the executive, legislative
499499 and judicial branches of state and local governments and all
500500 advisory boards, commissions, committees, agencies or entities
501501 created by the constitution of New Mexico or any branch of
502502 state government that receives any public funding, including
503503 political subdivisions, special taxing districts, school
504504 districts and institutions of higher education;
505505 DD. "public funds" means cash and other assets with
506506 more than minimal value received from the state or other public
507507 body;
508508 EE. "public records" means all documents, papers,
509509 letters, books, maps, tapes, photographs, recordings and other
510510 materials, regardless of physical form or characteristics, that
511511 are used, created, received, maintained or held by or on behalf
512512 of any public body and relate to public business, whether or
513513 not the records are required by law to be created or
514514 maintained;
515515 FF. "public social services agency" means the adult
516516 protective services system created by the Adult Protective
517517 Services Act, a county when carrying out its duties under the
518518 Indigent Hospital and County Health Care Act, the health care
519519 authority and the children, youth and families department;
520520 GG. "reasonable denial" is a denial that states:
521521 (1) a reason supported by the Inspection of
522522 Public Records Act, another state, federal or local law or

553553 providing the precise legal citation; and
554554 (2) the reasonable justification, based on a
555555 public policy ground, for refusing to release the records;
556556 HH. "reasonable particularity" means identifying
557557 specific records by:
558558 (1) in the case of records other than audio or
559559 visual records, providing at least two of the following:
560560 (a) the record title or subject line;
561561 (b) the author; and
562562 (c) the date or date range with
563563 reasonable specificity; or
564564 (2) in the case of audio or visual records,
565565 providing at least one of the following:
566566 (a) the computer-aided dispatch record
567567 number;
568568 (b) the police report number; and
569569 (c) the date or date range with
570570 reasonable specificity and at least one of the following: 1)
571571 the name of a law enforcement officer or first responder; 2)
572572 the approximate time or the approximate location of the record;
573573 and 3) other criteria established and published by a law
574574 enforcement agency public body to facilitate access to videos;
575575 provided that a request that is made for search terms or

611611 JJ. "state commission of public records" means the
612612 commission established by Section 14-3-3 NMSA 1978;
613613 KK. "state records administrator" means the person
614614 hired by the state commission of public records pursuant to
615615 Section 14-3-4 NMSA 1978;
616616 LL. "reasonable fee" means the actual cost to the
617617 public entity of locating, reviewing, redacting and making the
618618 copy, including the cost of labor, materials and equipment;
619619 MM. "security system plan" includes:
620620 (1) records, information, photographs, audio
621621 and visual presentations, schematic diagrams, surveys,
622622 recommendations, communications or consultations relating
623623 directly to the physical or electronic security of a public
624624 facility or any critical infrastructure, whether owned by or
625625 leased to the state or any of its political subdivisions, or
626626 any privately owned or leased critical infrastructure if the
627627 plan or a portion of the plan is in the possession of a public
628628 body;

658658 defenses, or threats, attacks, attempted attacks and
659659 vulnerabilities of cyber system operations relating directly to
660660 the physical or electronic security of a public facility, or
661661 any critical infrastructure, whether owned by or leased to the
662662 state or any of its political subdivisions, or any privately
663663 owned or leased critical infrastructure if the information is
664664 in the possession of a public body;
665665 (3) threat assessments;
666666 (4) continuity of operations plans;
667667 (5) vulnerability and capability assessments
668668 conducted by a public body or any private entity;
669669 (6) terrorist or threat response plans; and
670670 (7) emergency evacuation plans;
671671 NN. "trade secret" means a trade secret as defined
672672 in Subsection D of Section 57-3A-2 NMSA 1978;
673673 OO. "undercover law enforcement officer" means an
674674 employee of a local or state law enforcement agency who acts
675675 surreptitiously or poses as someone other than a law
676676 enforcement officer while engaging in the investigation of a
677677 violation of law; and
678678 PP. "utility services" means those services, when
679679 performed by a public body, that would constitute a public
680680 utility as defined by Section 62-3-3 NMSA 1978, a public
681681 telecommunications service as defined by Section 63-9A-3 NMSA

713713 SECTION 2. A new section of the Inspection of Public
714714 Records Act is enacted to read:
715715 "[NEW MATERIAL] RECORDS CUSTODIAN.--Each public body shall
716716 designate at least one custodian of public records who shall:
717717 A. receive requests, including electronic mail or
718718 facsimile, to inspect public records;
719719 B. respond to requests in the same medium,
720720 electronic or paper, in which the request was made in addition
721721 to any other medium that the custodian deems appropriate;
722722 C. provide proper and reasonable opportunities to
723723 inspect public records;
724724 D. provide reasonable facilities to make or furnish
725725 copies of the public records during usual business hours; and
726726 E. post in a conspicuous location at the
727727 administrative office and on the publicly accessible website,
728728 if any, of each public body a notice describing:
729729 (1) the right of a person to inspect a public
730730 body's records;
731731 (2) procedures for requesting inspection of
732732 public records, including the contact information for the
733733 custodian of public records;
734734 (3) procedures for requesting copies of public

766766 (5) the responsibility of a public body to
767767 make available public records for inspection."
768768 SECTION 3. A new section of the Inspection of Public
769769 Records Act is enacted to read:
770770 "[NEW MATERIAL] PROCEDURE FOR REQUESTING RECORDS.--
771771 A. Any person wishing to inspect public records
772772 shall submit a written request to the custodian. The failure
773773 to respond to an oral request shall not subject the custodian
774774 to any penalty.
775775 B. If a request is sent to any person other than
776776 the proper records custodian, the time for fulfilling the
777777 request shall be tolled until the request is delivered to the
778778 proper records custodian. All employees or agents of public
779779 bodies shall forward the request to the proper records
780780 custodian any requests misdirected to them.
781781 C. A request shall provide the actual name, mailing
782782 address, telephone number and email address of the person
783783 seeking access to the records. Anonymous or pseudonymous
784784 requests are not permitted. If the request is made by an agent
785785 for another, the agent shall disclose the name of the person
786786 the agent is acting on behalf of.
787787 D. A request shall identify the records sought with

817817 E. No person requesting records shall be required
818818 to state the reason for inspecting the records.
819819 F. A custodian receiving a written request shall
820820 permit the inspection not later than fifteen days after
821821 receiving a written request in the case of current records or
822822 sixty days in the case of archival records or audio or visual
823823 records.
824824 G. For the purposes of this section, "written
825825 request" includes an electronic communication, including email,
826826 facsimile or use of a web page on the internet provided by the
827827 public body; provided that the request complies with the
828828 requirements of Subsection C of this section.
829829 H. A public body may ask the requester to clarify
830830 the request.
831831 I. A public body may discuss with the requester of
832832 a large volume of records how the scope of a request may be
833833 narrowed.
834834 J. If a requester does not respond to a request for
835835 clarification within fifteen days, the request for inspection
836836 may be considered withdrawn."
837837 SECTION 4. A new section of the Inspection of Public
838838 Records Act is enacted to read:
839839 "[NEW MATERIAL] REQUESTING ELECTRONIC RECORDS.--
840840 A. Automation of public records must not erode the

870870 increases its use of and dependence on electronic
871871 recordkeeping, each public body shall provide reasonable public
872872 access to records electronically maintained and shall ensure
873873 that exempt or confidential records are not disclosed except as
874874 otherwise permitted by law.
875875 B. A public body shall not enter into a contract
876876 for the creation or maintenance of a public records database if
877877 that contract impairs the ability of the public to inspect or
878878 copy the public records of the public body, including public
879879 records online or stored in an electronic record keeping system
880880 used by the public body.
881881 C. An electronic copy of a record shall be provided
882882 upon request at no cost, other than costs allowed by this 2025
883883 act; provided that if the nature or volume of the public
884884 records requested to be accessed or provided is a broad and
885885 burdensome use of information technology resources, the public
886886 body may charge no more than the actual cost incurred for the
887887 broad and burdensome use of information technology resources
888888 incurred by the public body.
889889 D. Nothing in this section requires a public body
890890 to create or compile a record that does not exist.

20452045 A. A public body may file a petition asking the
20462046 state commission of public records to request relief from a
20472047 person that the public body claims is a vexatious requester.
20482048 B. A petition under this section shall:
20492049 (1) be filed with the state records
20502050 administrator, who may not charge a fee to file a petition;
20512051 (2) contain the name and contact information
20522052 of a respondent to the petition;
20532053 (3) contain a description of the conduct that
20542054 the governmental entity claims demonstrates that the respondent
20552055 is a vexatious requester, which may include a description of
20562056 conduct directed toward public bodies other than the one filing
20572057 the petition; and
20582058 (4) be served on the respondent, such service
20592059 to be done contemporaneously with the filing of the petition.

21082108 issues. If a respondent fails to appear at the hearing, the

21102110 H. Within twenty-eight days after a hearing is

22612261 order an injunction or other appropriate remedy to enforce the
22622262 provisions of the Inspection of Public Records Act but only
22632263 after the public body has been served with a complaint, given
22642264 due process in accordance with the rules of civil procedure and
22652265 the court has found that the public body did not produce

22672267 H. The exhaustion of administrative remedies shall
22682268 not be required prior to bringing any action to enforce the
