3333 RELATING TO STATE EDUCATIONAL INSTITUTIONS; REQUIRING STATE
3434 EDUCATIONAL INSTITUTIONS TO PROVIDE MENSTRUAL PRODUCTS IN
3535 CAMPUS BATHROOMS; MAKING AN APPROPRIATION.
3636 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3737 SECTION 1. A new section of Chapter 21, Article 1 NMSA
3838 1978 is enacted to read:
3939 "[NEW MATERIAL] FREE MENSTRUAL PRODUCTS IN STATE
4040 EDUCATIONAL INSTITUTIONS.--
4141 A. As used in this section, "menstrual product"
4242 means a sanitary pad or tampon.
4343 B. Menstrual products shall be provided at no
4444 charge to students in each women's bathroom, each gender-
4545 neutral bathroom and at least one men's bathroom in every state
4646 educational institution enumerated in Article 12, Section 11 of

7575 SECTION 2. APPROPRIATION.--One million dollars
7676 ($1,000,000) is appropriated from the general fund to the
7777 higher education department for expenditure in fiscal year 2026
7878 for disbursement to each state educational institution
7979 enumerated in Article 12, Section 11 of the constitution of the
8080 New Mexico based on the proportion of female students for the
8181 purchase and installment of menstrual product dispensers and
8282 the purchase and distribution of menstrual products to state
8383 educational institutions statewide. Any unexpended or
8484 unencumbered balance remaining at the end of fiscal year 2026
8585 shall revert to the general fund.
