3333 RELATING TO HEALTH; PREVENTING THE RESTRICTION OF MEDICATION-
3434 ASSISTED TREATMENT FOR MINORS IN INPATIENT, OUTPATIENT,
3535 JUVENILE CORRECTION AND JUVENILE DETENTION FACILITIES AND
3636 PROGRAMS THAT HOUSE OR TREAT ADOLESCENTS WITH SUBSTANCE USE
3737 DISORDERS AND ARE OPERATED OR FUNDED BY THE STATE; CREATING THE
3838 EVIDENCE-BASED SUBSTANCE USE DISORDER TREATMENT FOR MINORS
3939 FUND; MAKING AN APPROPRIATION.
4040 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
4141 SECTION 1. [NEW MATERIAL] DEFINITIONS.--As used in
4242 Sections 1 through 3 of this act:
4343 A. "evidence-based" means a course of treatment
4444 that is supported by research, clinical expertise and the needs
4545 of a patient;

7474 means a residential facility that operates twenty-four hours
7575 per day and provides intensive management of symptoms related
7676 to substance use disorder and monitoring of the physical and
7777 mental complications resulting from substance use;
7878 C. "juvenile correction facility" means the
7979 physical plant and buildings operated by or on behalf of the
8080 juvenile justice division of the children, youth and families
8181 department or any other facility or location designated by the
8282 juvenile justice division's director to house or provide care
8383 to clients committed to the custody of the children, youth and
8484 families department;
8585 D. "juvenile detention facility" means a place
8686 where a child may be detained under the Children's Code pending
8787 a court hearing and does not include a facility for the care
8888 and rehabilitation of an adjudicated delinquent child;
8989 E. "medication-assisted treatment" means the use of
9090 federal-food-and-drug-administration-approved prescription
9191 drugs, in combination with counseling and behavioral therapies,
9292 to provide a whole-patient approach to the treatment of
9393 substance use disorders;
9494 F. "minor" means an individual who is under
9595 eighteen years of age; and
9696 G. "outpatient substance use treatment program"
9797 means a program that offers resources, counseling and substance
9898 use treatment on an outpatient basis.

127127 SECTION 2. [NEW MATERIAL] MEDICATION-ASSISTED TREATMENT
128128 FOR MINORS IN INPATIENT SUBSTANCE USE TREATMENT FACILITIES,
129129 OUTPATIENT SUBSTANCE USE TREATMENT PROGRAMS, JUVENILE
130130 CORRECTION FACILITIES AND JUVENILE DETENTION FACILITIES.--
131131 A. By the end of fiscal year 2026, the department
132132 of health, the health care authority and the children, youth
133133 and families department shall not operate or contract with an
134134 inpatient substance use treatment facility, an outpatient
135135 substance use treatment program, a juvenile correction facility
136136 or a juvenile detention facility that has policies or
137137 procedures that restrict the use of medication-assisted
138138 treatment for the treatment of substance use disorder in minor
139139 patients.
140140 B. Beginning July 1, 2026, an inpatient substance
141141 use treatment facility, an outpatient substance use treatment
142142 program, a juvenile correction facility or a juvenile detention
143143 facility that has policies or procedures that restrict the use
144144 of medication-assisted treatment for the treatment of substance
145145 use disorder in minor patients shall not be eligible for
146146 reimbursement from the state's medicaid program for services
147147 rendered to minors.
148148 C. No later than December 1, 2025, the health care
149149 authority shall promulgate rules for the operation of
150150 medication-assisted treatment programs in inpatient substance
151151 use treatment facilities, outpatient substance use treatment

184184 treatment program administrators and health care providers with
185185 experience treating substance use disorder among minor
186186 patients.
187187 D. Beginning October 1, 2025 and annually
188188 thereafter, the health care authority shall report to the
189189 interim legislative health and human services committee on the
190190 availability of medication-assisted treatment for minor
191191 patients at inpatient substance use treatment facilities,
192192 outpatient substance use treatment programs, juvenile
193193 correction facilities and juvenile detention facilities.
194194 SECTION 3. [NEW MATERIAL] EVIDENCE-BASED SUBSTANCE USE
195195 DISORDER TREATMENT FOR MINORS FUND--CREATED.--
196196 A. The "evidence-based substance use disorder
197197 treatment for minors fund" is created as a nonreverting fund in
198198 the state treasury. The fund consists of appropriations,
199199 gifts, grants and donations. The health care authority shall
200200 administer the fund, and money in the fund is appropriated to
201201 the health care authority to assist the children, youth and
202202 families department, the department of health and licensed
203203 substance use treatment providers to establish and operate
204204 medication-assisted treatment programs for minors.

233233 Disbursements from the fund shall be made by warrants of the
234234 secretary of finance and administration pursuant to vouchers
235235 signed by the secretary of health care authority.
236236 B. No later than December 1, 2025, the health care
237237 authority shall promulgate rules for the disbursement of money
238238 from the fund, including eligibility criteria for receiving
239239 money from the fund.
