53	53	THAT ARE ANTICIPATED TO AFFECT THE COST OF COMMERCIAL OR
54	54	RESIDENTIAL CONSTRUCTION; REQUIRING THE CONSTRUCTION INDUSTRIES
55	55	COMMISSION AND THE TRADE BUREAUS TO PRODUCE COST STUDIES FOR
56	56	PROPOSED RULES AND TRADE BUREAU RECOMMENDATIONS THAT ARE
57	57	ANTICIPATED TO AFFECT THE COST OF COMMERCIAL OR RESIDENTIAL
58	58	CONSTRUCTION.
59	59	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
60	60	SECTION 1. A new section of the Construction Industries
61	61	Licensing Act is enacted to read:
62	62	"[NEW MATERIAL] COST STUDIES REQUIRED--ADOPTION OF CODE--

90	90	RULEMAKING.--
91	91	A. A trade bureau within its respective
92	92	jurisdiction shall produce a cost study for any recommendation
93	93	for a minimum standard or additional specification made
94	94	pursuant to Section 60-13-44 NMSA 1978 or a rule that is
95	95	anticipated to affect the cost of commercial or residential
96	96	construction and submit the cost study along with the
97	97	recommendation to the commission and the division.
98	98	B. The commission shall produce a cost study for
99	99	any rule that is anticipated to affect the cost of commercial
100	100	or residential construction for which a trade bureau has not
101	101	already produced a cost study and submit the cost study to the
102	102	division. If the commission or the division changes a minimum
103	103	standard or additional specification recommended to the
104	104	commission and by a trade bureau pursuant to Section 60-13-44
105	105	NMSA 1978 and the changes are anticipated to affect the cost of
106	106	commercial or residential construction, the commission shall
107	107	complete a revised cost study for the standard or additional
108	108	specification and submit the cost study to the division.
109	109	C. A cost study or a revised cost study shall
110	110	estimate the change to the cost of commercial and residential
111	111	construction in the state that is anticipated by the proposed
112	112	change to rules or code.
113	113	D. Beginning July 1, 2025, the commission and the
114	114	division shall consider a cost study for any:

148	148	E. The commission or division shall provide the
149	149	cost study along with a proposed rule to the public in
150	150	accordance with the State Rules Act for review and public
151	151	comment prior to the rule's adoption, amendment or repeal."
