2950 RELATING TO PHARMACIES; AMENDING THE PHARMACY ACT TO PROVIDE
3051 FOR CUSTODIAL CARE FACILITIES ACQUIRING AND POSSESSING
3152 CONTROLLED SUBSTANCES FOR WITHDRAWAL MANAGEMENT.
3253 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3354 SECTION 1. A new section of the Pharmacy Act is enacted
3455 to read:
35-"CUSTODIAL CARE FACILITIES--ACQUIRING AND POSSESSING
36-CONTROLLED SUBSTANCES.--
56+"[NEW MATERIAL] CUSTODIAL CARE FACILITIES--ACQUIRING AND
57+POSSESSING CONTROLLED SUBSTANCES.--
3758 A. A licensed custodial care facility that is
38-authorized to provide medically monitored withdrawal
39-management that is under the supervision of a consulting
40-pharmacist and has nursing staff on-site twenty-four hours
41-per day, three hundred sixty-five days per year, may acquire,
42-stock, maintain and have in the facility's possession
43-dangerous drugs, including controlled substances to be used
44-for withdrawal management purposes, in accordance with board
45-rules.

49-SECTION 2. EFFECTIVE DATE.--The effective date of the
