4949 RELATING TO PROPERTY; ENACTING A NEW SECTION OF THE UNIFORM
5050 OWNER-RESIDENT RELATIONS ACT; PROHIBITING THE USE OF ARTIFICIAL
5151 INTELLIGENCE TO MANIPULATE RENT PRICING.
5252 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5353 SECTION 1. A new section of the Uniform Owner-Resident
5454 Relations Act is enacted to read:
5555 "[NEW MATERIAL] ARTIFICIAL INTELLIGENCE MANIPULATION OF
5656 RENT PRICING.--
5757 A. As used in this section:
5858 (1) "consciously parallel pricing
5959 coordination" means a tacit agreement between two or more
6060 owners of separate properties to raise, lower, change, maintain
6161 or manipulate pricing of rent for the separate properties;
6262 (2) "coordinating function" means:

9090 (a) collecting historical or
9191 contemporaneous prices, supply levels or lease or rental
9292 contract termination and renewal dates of dwelling units from
9393 two or more rental property owners;
9494 (b) analyzing or processing of the
9595 information described in Subparagraph (a) of this paragraph
9696 through use of a system, software or process that uses
9797 computation, including by using the information to train an
9898 algorithm; and
9999 (c) recommending rent prices, lease
100100 renewal terms or occupancy levels to an owner; and
101101 (3) "coordinator" means a person who operates
102102 a software or data analytics service that performs a
103103 coordinating function for an owner, including a rental property
104104 owner performing a coordinating function for the rental
105105 property owner's own benefit.
106106 B. It is unlawful for:
107107 (1) an owner or an agent of an owner to
108108 subscribe to, contract with or otherwise exchange a form of
109109 consideration in return for the use of services of a
110110 coordinator;
111111 (2) a coordinator to facilitate an agreement
112112 among owners of separate properties that restricts competition
113113 with respect to residential dwelling units, including by
114114 performing a coordinating function; or

145145 C. A person who is injured by unlawful actions
146146 provided pursuant to this section may sue in a court having
147147 jurisdiction in the county in the state where the defendant
148148 resides or is found or an agent resides or is found or where
149149 service may be obtained."
