49	49	RELATING TO FIREARMS; PROHIBITING AN UNDOCUMENTED ALIEN FROM
50	50	RECEIVING, TRANSPORTING OR POSSESSING A FIREARM OR DESTRUCTIVE
51	51	DEVICE; PROVIDING A PENALTY.
52	52	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
53	53	SECTION 1. Section 30-7-16 NMSA 1978 (being Laws 1981,
54	54	Chapter 225, Section 1, as amended) is amended to read:
55	55	"30-7-16. FIREARMS OR DESTRUCTIVE DEVICES--RECEIPT,
56	56	TRANSPORTATION OR POSSESSION BY CERTAIN PERSONS--PENALTY.--
57	57	A. It is unlawful for the following persons to
58	58	receive, transport or possess a firearm or destructive device
59	59	in this state:
60	60	(1) a felon;
61	61	(2) a person subject to an order of protection
62	62	pursuant to Section 40-13-5 or 40-13A-5 NMSA 1978; [or ]

91	91	[(3)] (4) a person convicted of any of the
92	92	following crimes:
93	93	(a) battery against a household member
94	94	pursuant to Section 30-3-15 NMSA 1978;
95	95	(b) criminal damage to property of a
96	96	household member pursuant to Section 30-3-18 NMSA 1978;
97	97	(c) a first offense of stalking pursuant
98	98	to Section 30-3A-3 NMSA 1978; or
99	99	(d) a crime listed in 18 U.S.C. 921.
100	100	B. A felon found in possession of a firearm shall
101	101	be guilty of a third degree felony.
102	102	C. A serious violent felon that is found to be in
103	103	possession of a firearm shall be guilty of a third degree
104	104	felony, and notwithstanding the provisions of Section 31-18-15
105	105	NMSA 1978, shall be sentenced to a basic term of six years
106	106	imprisonment.
107	107	D. Any person subject to an order of protection
108	108	pursuant to Section 40-13-5 or 40-13A-5 NMSA 1978 or convicted
109	109	of a crime listed in Paragraph [(3) ] (4) of Subsection A of
110	110	this section or an undocumented alien who receives, transports
111	111	or possesses a firearm or destructive device is guilty of a
112	112	misdemeanor.
113	113	E. As used in this section:

143	143	this subsection, "destructive device" means:
144	144	(a) any explosive, incendiary or poison
145	145	gas: 1) bomb; 2) grenade; 3) rocket having a propellant charge
146	146	of more than four ounces; 4) missile having an explosive or
147	147	incendiary charge of more than one-fourth ounce; 5) mine; or 6)
148	148	similar device;
149	149	(b) any type of weapon by whatever name
150	150	known that will, or that may be readily converted to, expel a
151	151	projectile by the action of an explosive or other propellant,
152	152	the barrel or barrels of which have a bore of more than one-
153	153	half inch in diameter, except a shotgun or shotgun shell that
154	154	is generally recognized as particularly suitable for sporting
155	155	purposes; or
156	156	(c) any combination of parts either
157	157	designed or intended for use in converting any device into a
158	158	destructive device as defined in this paragraph and from which
159	159	a destructive device may be readily assembled;
160	160	(2) the term "destructive device" does not
161	161	include any device that is neither designed nor redesigned for
162	162	use as a weapon or any device, although originally designed for
163	163	use as a weapon, that is redesigned for use as a signaling,
164	164	pyrotechnic, line throwing, safety or similar device;
165	165	(3) "felon" means a person convicted of a
166	166	felony offense by a court of the United States or of any state
167	167	or political subdivision thereof and:

197	197	since the person completed serving a sentence or period of
198	198	probation for the felony conviction, whichever is later;
199	199	(b) the person has not been pardoned for
200	200	the felony conviction by the proper authority; and
201	201	(c) the person has not received a
202	202	deferred sentence;
203	203	(4) "firearm" means any weapon that will or is
204	204	designed to or may readily be converted to expel a projectile
205	205	by the action of an explosion or the frame or receiver of any
206	206	such weapon; [and]
207	207	(5) "serious violent felon" means a person
208	208	convicted of an offense enumerated in [Subparagraphs (a)
209	209	through (n) of] Paragraph (4) of Subsection L of Section
210	210	33-2-34 NMSA 1978; provided that:
211	211	(a) less than ten years have passed
212	212	since the person completed serving a sentence or a period of
213	213	probation for the felony conviction, whichever is later;
214	214	(b) the person has not been pardoned for
215	215	the felony conviction by the proper authority; and
216	216	(c) the person has not received a
217	217	deferred sentence and completed the total term of deferment as
218	218	provided in Section 31-20-9 NMSA 1978; and
219	219	(6) "undocumented alien" means a person who is
220	220	a foreign national and who is illegally or unlawfully present
