5050 PATIENTS SEEKING MEDICATION ABORTIONS; PROVIDING PENALTIES;
5151 CREATING A PRIVATE RIGHT OF ACTION.
5252 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5353 SECTION 1. [NEW MATERIAL] NOTICE TO MEDICATION ABORTION
5454 PATIENTS.--
5555 A. As used in this section:
5656 (1) "medical emergency" means a condition
5757 that, in reasonable medical judgement, so complicates the
5858 medical condition of a patient as to necessitate the immediate
5959 abortion of the pregnancy to avoid the patient's death, or for
6060 which a delay will create serious risk of substantial and
6161 irreversible physical impairment of a major bodily function;
6262 (2) "medication abortion" means the use or

9090 prescription of any drug for the purpose of inducing an
9191 abortion; and
9292 (3) "mifepristone" means the drug
9393 mifepristone, including any official, generic or chemical name
9494 used to describe mifepristone, prescribed for a medication
9595 abortion.
9696 B. Any office, clinic, hospital, pharmacy or other
9797 health care facility where mifepristone is prescribed,
9898 dispensed or administered for the purpose of inducing a
9999 medication abortion shall post a conspicuous sign in a place
100100 clearly visible to patients and customers, printed with
101101 lettering that is legible and at least three-fourths of an inch
102102 in boldface type, that shall read:
103103 "NOTICE TO PATIENTS HAVING MEDICATION ABORTIONS THAT USE
104104 MIFEPRISTONE: Mifepristone, also known as RU-486 or mifeprex,
105105 alone is not always effective in ending a pregnancy. It may be
106106 possible to reverse the drug's intended effect if the second
107107 pill or tablet has not been taken or administered. If you
108108 change your mind and wish to try to continue the pregnancy, you
109109 can get immediate help by accessing available resources. ".
110110 C. An office, clinic or other health care facility
111111 that is not a hospital or pharmacy where mifepristone is
112112 prescribed, dispensed or administered for the purpose of
113113 inducing a medication abortion shall post the sign required by
114114 Subsection B of this section in each patient waiting room and

145145 D. A hospital where mifepristone is prescribed,
146146 dispensed or administered for the purpose of inducing a
147147 medication abortion shall post the sign required by Subsection
148148 B of this section in each patient admission area used by
149149 patients seeking medication abortions.
150150 E. A pharmacy where mifepristone is prescribed,
151151 dispensed or administered for the purpose of inducing a
152152 medication abortion shall post the sign required by Subsection
153153 B of this section in the area inside the premises where
154154 customers are provided prescription medications and on the
155155 exterior of the premises in the area where customers are
156156 provided prescription medications via a drive-through window.
157157 F. Except in the case of a medical emergency, no
158158 physician shall provide, induce or attempt to provide or induce
159159 a medication abortion that uses mifepristone without providing
160160 the patient written notice at least twenty-four hours prior to
161161 the medication abortion that includes information on:
162162 (1) the possibility of reversing the intended
163163 effects of a medication abortion that uses mifepristone; and
164164 (2) resources for reversing a medication
165165 abortion, including contact information that the patient can
166166 use to obtain timely assistance to attempt to reverse the
167167 medication abortion.

196196 G. When a medical emergency compels the performance
197197 of a medication abortion that uses mifepristone, the physician
198198 shall inform the patient, prior to the medication abortion if
199199 possible, of the medical indications supporting the physician's
200200 judgment that an abortion is necessary to avert the patient's
201201 death or that a twenty-four-hour delay would create serious
202202 risk of substantial and irreversible impairment of a major
203203 bodily function, excluding psychological or emotional
204204 conditions.
205205 H. By September 1, 2025, the department of health
206206 shall publish materials on the department's website to provide
207207 information on:
208208 (1) the possibility of reversing the intended
209209 effects of a medication abortion that uses mifepristone; and
210210 (2) resources available to reverse the effects
211211 of a medication abortion that uses mifepristone.
212212 I. The health care authority shall assess a fine
213213 not to exceed ten thousand dollars ($10,000) to any office,
214214 clinic, hospital, pharmacy or other health care facility that
215215 fails to post a sign required by Subsection B of this section.
216216 J. If a physician provides a medication abortion
217217 using mifepristone in violation of this section, the following
218218 individuals may bring a civil action in a court of competent
219219 jurisdiction against the physician for compensatory damages,
220220 punitive damages and any other appropriate relief:

251251 (2) the patient's biological parents, if the
252252 patient was not eighteen years of age or older at the time of
253253 the medication abortion, or if the patient died as a result of
254254 the medication abortion.
