5353 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5454 SECTION 1. [NEW MATERIAL] SHORT TITLE.--This act may be
5555 cited as the "Health Care Practitioner Transparency Act".
5656 SECTION 2. [NEW MATERIAL] DEFINITIONS.--As used in the
5757 Health Care Practitioner Transparency Act:
5858 A. "advertisement" means any communication or
5959 statement disseminated to the general public or to other health
6060 care practitioners that names a health care practitioner or the
6161 practice, profession or institution in which the practitioner
6262 is employed, volunteers or otherwise provides health care

9191 B. "clinical setting" means a location, whether
9292 physical or virtual, in which a person is evaluated, diagnosed,
9393 counseled or treated for a disease, defect or injury by a
9494 health care practitioner;
9595 C. "deceptive or misleading terms or false
9696 representations" means the use of titles, terms or other words
9797 that misstate, falsely describe, falsely hold out, falsely
9898 detail or falsely imply the health care practitioner's:
9999 (1) profession;
100100 (2) skills;
101101 (3) training;
102102 (4) expertise;
103103 (5) educational degree;
104104 (6) board certification;
105105 (7) licensure;
106106 (8) work or services offered; or
107107 (9) medical field, if the practitioner is not
108108 a physician licensed pursuant to Section 61-6-11 NMSA 1978;
109109 D. "health care practice or facility" means a
110110 hospital, outpatient practice setting, nursing home, assisted
111111 living community or personal care home;
112112 E. "health care practitioner" means a state-
113113 licensed:

143143 (2) professional counselor, social worker or
144144 marriage and family therapist;
145145 (3) dentist;
146146 (4) dietitian;
147147 (5) advanced practice registered nurse,
148148 including nurse practitioner, certified registered nurse
149149 anesthetist, certified nurse midwife, clinical nurse
150150 specialist, registered professional nurse or licensed practical
151151 nurse;
152152 (6) occupational therapist;
153153 (7) optometrist;
154154 (8) physical therapist;
155155 (9) allopathic physician or osteopathic
156156 physician;
157157 (10) physician assistant;
158158 (11) acupuncturist;
159159 (12) podiatric physician;
160160 (13) psychologist;
161161 (14) audiologist or speech-language
162162 pathologist;
163163 (15) pharmacist;
164164 (16) ophthalmic technician;
165165 (17) medical assistant or certified nursing
166166 assistant; or
167167 (18) respiratory care professional;

196196 F. "identifier" means a physical credential that
197197 identifies the person wearing it; and
198198 G. "medical title" means a title that originates
199199 from or is a derivation of specialty or subspecialty training
200200 or certification attained through completion of nationally
201201 accredited medical education culminating in a doctor of
202202 medicine or doctor of osteopathic medicine degree or completion
203203 of a physician internship, residency or fellowship training
204204 program.
205205 SECTION 3. [NEW MATERIAL] HEALTH CARE PRACTITIONER
206206 ADVERTISING GUIDELINES.--
207207 A. An advertisement by a health care practitioner
208208 shall include the practitioner's name and, in regard to the
209209 practitioner's license, disclose the type of license under
210210 which the health care practitioner is authorized to provide
211211 services.
212212 B. An advertisement by a health care practitioner
213213 shall not:
214214 (1) include deceptive or misleading terms or
215215 false representations; or
216216 (2) include or reference a medical title
217217 unless the health care practitioner is a physician.
218218 C. A health care practitioner in a health care
219219 practice or facility other than a hospital shall display in the
220220 reception area of the practitioner's practice or facility where

249249 the health care practitioner provides service an advertisement
250250 that clearly identifies the type of health care practitioners
251251 working in the practice or facility and the right of a patient
252252 to inquire as to the type of license of the health care
253253 practitioner treating the patient. The advertisement shall be
254254 of a sufficient size that it is visible and apparent to all
255255 current and prospective patients.
256256 D. This section shall not be construed to require a
257257 health care practice or facility in which multiple health care
258258 practitioners are working to list in an advertisement the name
259259 of every health care practitioner employed by the practice or
260260 facility.
261261 SECTION 4. [NEW MATERIAL] HEALTH CARE PRACTITIONER
262262 IDENTIFIERS.--
263263 A. A health care practice or facility shall
264264 conspicuously display and clearly communicate the licensure of
265265 each health care provider providing services at the practice or
266266 facility to all current and prospective patients, as follows:
267267 (1) each health care practitioner shall wear
268268 an identifier during all patient encounters that shall include:
269269 (a) the health care practitioner's name;
270270 and
271271 (b) the type of license and educational
272272 degree the health care practitioner holds;
273273 (2) the identifier shall be of sufficient size

302302 and worn in a conspicuous manner in order to be visible and
303303 apparent;
304304 (3) an identifier shall not be required in an
305305 operating room or other setting where maintaining a sterile
306306 environment is medically necessary;
307307 (4) an identifier shall not be required in a
308308 mental health setting where it would impede the
309309 psychotherapeutic relationship; and
310310 (5) if a safety or health risk to the health
311311 care practitioner or a patient would be created as a result of
312312 the health care practitioner wearing an identifier, an
313313 identifier shall not be required or may be modified by omitting
314314 or concealing the last name of the health care practitioner.
315315 B. An advanced practice registered nurse shall
316316 verbally identify as an advanced practice registered nurse
317317 during each initial patient interaction in a clinical setting.
318318 An advanced practice registered nurse who holds a doctorate
319319 degree and identifies with the title "doctor" while in a
320320 clinical setting shall clearly state that the title does not
321321 refer to the advanced practice registered nurse as being a
322322 medical doctor or physician.
323323 C. A physician assistant shall verbally identify as
324324 a physician assistant during each initial patient interaction
325325 in a clinical setting. A physician assistant who holds a
326326 doctorate degree and identifies with the title "doctor" while

355355 in a clinical setting shall clearly state that the title does
356356 not refer to the physician assistant as being a medical doctor
357357 or physician.
358358 D. No health care practitioner shall identify in a
359359 clinical setting using:
360360 (1) deceptive or misleading terms or false
361361 representations; or
362362 (2) a medical title, unless the health care
363363 practitioner is a licensed medical doctor or physician.
364364 E. A health care practitioner who practices in a
365365 nonpatient care setting and who does not have direct patient
366366 care interactions shall not be subject to the provisions of
367367 Subsections A through D of this section.
368368 F. A health care practice or facility that
369369 requires, as of the effective date of the Health Care
370370 Practitioner Transparency Act, its health care practitioners to
371371 wear an identification badge shall not be required to replace
372372 existing badges to conform with the requirements of Subsections
373373 A through D of this section.
374374 G. Subsections A through D of this section shall
375375 only apply to a dentist, chiropractic physician or optometrist
376376 if the dentist, chiropractic physician or optometrist is
377377 practicing in a hospital, nursing home, assisted living
378378 community or personal care home.
379379 SECTION 5. [NEW MATERIAL] PENALTIES--NO PRIVATE CAUSE OF

408408 ACTION--LIMITATION.--Nothing in the Health Care Practitioner
409409 Transparency Act shall be construed to:
410410 A. create or imply a private cause of action for
411411 violation of that act; or
412412 B. prevent a health care practitioner from using or
413413 advertising a title that is statutorily authorized for the
414414 health care practitioner pursuant to the statutes under which
415415 the health care practitioner is licensed.
