53	53	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
54	54	SECTION 1. [NEW MATERIAL] SHORT TITLE.--This act may be
55	55	cited as the "Health Care Practitioner Transparency Act".
56	56	SECTION 2. [NEW MATERIAL] DEFINITIONS.--As used in the
57	57	Health Care Practitioner Transparency Act:
58	58	A. "advertisement" means any communication or
59	59	statement disseminated to the general public or to other health
60	60	care practitioners that names a health care practitioner or the
61	61	practice, profession or institution in which the practitioner
62	62	is employed, volunteers or otherwise provides health care

91	91	B. "clinical setting" means a location, whether
92	92	physical or virtual, in which a person is evaluated, diagnosed,
93	93	counseled or treated for a disease, defect or injury by a
94	94	health care practitioner;
95	95	C. "deceptive or misleading terms or false
96	96	representations" means the use of titles, terms or other words
97	97	that misstate, falsely describe, falsely hold out, falsely
98	98	detail or falsely imply the health care practitioner's:
99	99	(1) profession;
100	100	(2) skills;
101	101	(3) training;
102	102	(4) expertise;
103	103	(5) educational degree;
104	104	(6) board certification;
105	105	(7) licensure;
106	106	(8) work or services offered; or
107	107	(9) medical field, if the practitioner is not
108	108	a physician licensed pursuant to Section 61-6-11 NMSA 1978;
109	109	D. "health care practice or facility" means a
110	110	hospital, outpatient practice setting, nursing home, assisted
111	111	living community or personal care home;
112	112	E. "health care practitioner" means a state-
113	113	licensed:
114	114	(1) chiropractic physician;

144	144	marriage and family therapist;
145	145	(3) dentist;
146	146	(4) dietitian;
147	147	(5) advanced practice registered nurse,
148	148	including nurse practitioner, certified registered nurse
149	149	anesthetist, certified nurse midwife, clinical nurse
150	150	specialist, registered professional nurse or licensed practical
151	151	nurse;
152	152	(6) occupational therapist;
153	153	(7) optometrist;
154	154	(8) physical therapist;
155	155	(9) allopathic physician or osteopathic
156	156	physician;
157	157	(10) physician assistant;
158	158	(11) acupuncturist;
159	159	(12) podiatric physician;
160	160	(13) psychologist;
161	161	(14) audiologist or speech-language
162	162	pathologist;
163	163	(15) pharmacist;
164	164	(16) ophthalmic technician;
165	165	(17) medical assistant or certified nursing
166	166	assistant; or
167	167	(18) respiratory care professional;

196	196	F. "identifier" means a physical credential that
197	197	identifies the person wearing it; and
198	198	G. "medical title" means a title that originates
199	199	from or is a derivation of specialty or subspecialty training
200	200	or certification attained through completion of nationally
201	201	accredited medical education culminating in a doctor of
202	202	medicine or doctor of osteopathic medicine degree or completion
203	203	of a physician internship, residency or fellowship training
204	204	program.
205	205	SECTION 3. [NEW MATERIAL] HEALTH CARE PRACTITIONER
206	206	ADVERTISING GUIDELINES.--
207	207	A. An advertisement by a health care practitioner
208	208	shall include the practitioner's name and, in regard to the
209	209	practitioner's license, disclose the type of license under
210	210	which the health care practitioner is authorized to provide
211	211	services.
212	212	B. An advertisement by a health care practitioner
213	213	shall not:
214	214	(1) include deceptive or misleading terms or
215	215	false representations; or
216	216	(2) include or reference a medical title
217	217	unless the health care practitioner is a physician.
218	218	C. A health care practitioner in a health care
219	219	practice or facility other than a hospital shall display in the
220	220	reception area of the practitioner's practice or facility where

249	249	the health care practitioner provides service an advertisement
250	250	that clearly identifies the type of health care practitioners
251	251	working in the practice or facility and the right of a patient
252	252	to inquire as to the type of license of the health care
253	253	practitioner treating the patient. The advertisement shall be
254	254	of a sufficient size that it is visible and apparent to all
255	255	current and prospective patients.
256	256	D. This section shall not be construed to require a
257	257	health care practice or facility in which multiple health care
258	258	practitioners are working to list in an advertisement the name
259	259	of every health care practitioner employed by the practice or
260	260	facility.
261	261	SECTION 4. [NEW MATERIAL] HEALTH CARE PRACTITIONER
262	262	IDENTIFIERS.--
263	263	A. A health care practice or facility shall
264	264	conspicuously display and clearly communicate the licensure of
265	265	each health care provider providing services at the practice or
266	266	facility to all current and prospective patients, as follows:
267	267	(1) each health care practitioner shall wear
268	268	an identifier during all patient encounters that shall include:
269	269	(a) the health care practitioner's name;
270	270	and
271	271	(b) the type of license and educational
272	272	degree the health care practitioner holds;
273	273	(2) the identifier shall be of sufficient size

302	302	and worn in a conspicuous manner in order to be visible and
303	303	apparent;
304	304	(3) an identifier shall not be required in an
305	305	operating room or other setting where maintaining a sterile
306	306	environment is medically necessary;
307	307	(4) an identifier shall not be required in a
308	308	mental health setting where it would impede the
309	309	psychotherapeutic relationship; and
310	310	(5) if a safety or health risk to the health
311	311	care practitioner or a patient would be created as a result of
312	312	the health care practitioner wearing an identifier, an
313	313	identifier shall not be required or may be modified by omitting
314	314	or concealing the last name of the health care practitioner.
315	315	B. An advanced practice registered nurse shall
316	316	verbally identify as an advanced practice registered nurse
317	317	during each initial patient interaction in a clinical setting.
318	318	An advanced practice registered nurse who holds a doctorate
319	319	degree and identifies with the title "doctor" while in a
320	320	clinical setting shall clearly state that the title does not
321	321	refer to the advanced practice registered nurse as being a
322	322	medical doctor or physician.
323	323	C. A physician assistant shall verbally identify as
324	324	a physician assistant during each initial patient interaction
325	325	in a clinical setting. A physician assistant who holds a
326	326	doctorate degree and identifies with the title "doctor" while

355	355	in a clinical setting shall clearly state that the title does
356	356	not refer to the physician assistant as being a medical doctor
357	357	or physician.
358	358	D. No health care practitioner shall identify in a
359	359	clinical setting using:
360	360	(1) deceptive or misleading terms or false
361	361	representations; or
362	362	(2) a medical title, unless the health care
363	363	practitioner is a licensed medical doctor or physician.
364	364	E. A health care practitioner who practices in a
365	365	nonpatient care setting and who does not have direct patient
366	366	care interactions shall not be subject to the provisions of
367	367	Subsections A through D of this section.
368	368	F. A health care practice or facility that
369	369	requires, as of the effective date of the Health Care
370	370	Practitioner Transparency Act, its health care practitioners to
371	371	wear an identification badge shall not be required to replace
372	372	existing badges to conform with the requirements of Subsections
373	373	A through D of this section.
374	374	G. Subsections A through D of this section shall
375	375	only apply to a dentist, chiropractic physician or optometrist
376	376	if the dentist, chiropractic physician or optometrist is
377	377	practicing in a hospital, nursing home, assisted living
378	378	community or personal care home.

408	408	ACTION--LIMITATION.--Nothing in the Health Care Practitioner
409	409	Transparency Act shall be construed to:
410	410	A. create or imply a private cause of action for
411	411	violation of that act; or
412	412	B. prevent a health care practitioner from using or
413	413	advertising a title that is statutorily authorized for the
414	414	health care practitioner pursuant to the statutes under which
415	415	the health care practitioner is licensed.
