Sources of Information LFC Files Agency Analysis Received From New Mexico Corrections Department (NMCD) Agency Analysis was Solicited but Not Received From Department of Finance and Administration (DFA) SUMMARY Synopsis of House Bill 250 House Bill 250 (HB250) requires all correctional facilities to provide menstrual hygiene products to inmates in custody who menstruate or experience uterine or vaginal bleeding at no cost to the persons in custody. HB250 also requires each correctional facility to develop and implement a policy for providing free menstrual hygiene products to inmates. HB250 allows people in custody to choose from and use in combination a variety of menstrual hygiene products, including panty liners, tampons, and pads. HB250 specifies that menstrual hygiene products should be available on a routine basis and as needed upon request without requiring a medical referral. HB250 allows for exceptions or restrictions to the provisions of the bill when necessary to prevent injury to the person in custody or others. The effective date of this bill is July 1, 2025. House Bill 250 – Page 2 FISCAL IMPLICATIONS The New Mexico Corrections Department (NMCD) reports that HB250 would not have a fiscal impact on the department. NMCD reports that inmates under the department’s custody are already provided menstrual hygiene products at no charge. SIGNIFICANT ISSUES NMCD reports that, in addition to the menstrual hygiene products provided at no cost, inmates also have the option to purchase alternative brands through correction facility commissary stores allowing for personal preferences in product choice.
