52 | 52 | | SECTION 1. [NEW MATERIAL] FREE MENSTRUAL HYGIENE PRODUCTS |

53 | 53 | | REQUIRED IN CORRECTIONAL FACILITIES.-- |

54 | 54 | | A. As used in this section: |
---|
55 | 55 | | (1) "correctional facility" means a jail, |
---|
56 | 56 | | prison or other detention facility, whether operated by the |
---|
57 | 57 | | state, a local government or a private contractor, that is used |
---|
58 | 58 | | for the confinement of adult or juvenile persons; and |
---|
59 | 59 | | (2) "menstrual hygiene products" means |
---|
60 | 60 | | products used during menstruation or uterine or vaginal |
---|
61 | 61 | | bleeding and includes panty liners, tampons in differing |
---|
62 | 62 | | absorbencies and pads in differing absorbencies. |

91 | 91 | | custody who menstruate, or who experience uterine or vaginal |

92 | 92 | | bleeding, shall develop and implement a policy for all |

93 | 93 | | menstruating persons in custody. The policy shall include |

94 | 94 | | provisions for: |

95 | 95 | | (1) ensuring that correctional facilities |
---|
96 | 96 | | provide menstrual hygiene products sufficient for the needs of |
---|
97 | 97 | | each person in custody at no cost to the person in custody; and |
---|
98 | 98 | | (2) allowing persons in custody to choose from |
---|
99 | 99 | | panty liners, tampons and pads with the option to choose a |
---|
100 | 100 | | combination of menstrual hygiene products. |
---|
101 | 101 | | C. Menstrual hygiene products shall be made |
---|
102 | 102 | | available to a person in custody upon admission to a |
---|
103 | 103 | | correctional facility and on a routine basis and as needed and |
---|
104 | 104 | | upon request without a medical referral as a requisite. |
---|
105 | 105 | | D. Menstrual hygiene products shall be made |
---|
106 | 106 | | available to all persons in custody who menstruate or |
---|
107 | 107 | | experience vaginal or uterine bleeding regardless of conditions |
---|
108 | 108 | | of confinement, except when restrictions are strictly necessary |
---|
109 | 109 | | to prevent injury to the person or others. |
---|
110 | 110 | | SECTION 2. EFFECTIVE DATE.--The effective date of the |
---|
111 | 111 | | provisions of this act is July 1, 2025. |
