4848 AN ACT
4949 RELATING TO HYGIENE; REQUIRING CORRECTIONAL FACILITIES TO
5050 PROVIDE FREE MENSTRUAL HYGIENE PRODUCTS.
5151 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5252 SECTION 1. [NEW MATERIAL] FREE MENSTRUAL HYGIENE PRODUCTS
5353 REQUIRED IN CORRECTIONAL FACILITIES.--
5454 A. As used in this section:
5555 (1) "correctional facility" means a jail,
5656 prison or other detention facility, whether operated by the
5757 state, a local government or a private contractor, that is used
5858 for the confinement of adult or juvenile persons; and
5959 (2) "menstrual hygiene products" means
6060 products used during menstruation or uterine or vaginal
6161 bleeding and includes panty liners, tampons in differing
6262 absorbencies and pads in differing absorbencies.

9090 B. Correctional facilities that house persons in
9191 custody who menstruate, or who experience uterine or vaginal
9292 bleeding, shall develop and implement a policy for all
9393 menstruating persons in custody. The policy shall include
9494 provisions for:
9595 (1) ensuring that correctional facilities
9696 provide menstrual hygiene products sufficient for the needs of
9797 each person in custody at no cost to the person in custody; and
9898 (2) allowing persons in custody to choose from
9999 panty liners, tampons and pads with the option to choose a
100100 combination of menstrual hygiene products.
101101 C. Menstrual hygiene products shall be made
102102 available to a person in custody upon admission to a
103103 correctional facility and on a routine basis and as needed and
104104 upon request without a medical referral as a requisite.
105105 D. Menstrual hygiene products shall be made
106106 available to all persons in custody who menstruate or
107107 experience vaginal or uterine bleeding regardless of conditions
108108 of confinement, except when restrictions are strictly necessary
109109 to prevent injury to the person or others.
110110 SECTION 2. EFFECTIVE DATE.--The effective date of the
111111 provisions of this act is July 1, 2025.
