5252 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5353 SECTION 1. Section 30-46-1 NMSA 1978 (being Laws 1989,
5454 Chapter 142, Section 1) is amended to read:
5555 "30-46-1. TICKET SCALPING.--
5656 A. Ticket scalping consists of selling, offering
5757 for sale or attempting to sell any ticket, privilege, license,
5858 admission or pass to [any ] a college athletic event or an event
5959 presented by the state or a political subdivision of the state
6060 or by a nonprofit corporation formally recognized as tax exempt
6161 under Section 501(c)(3) of the Internal Revenue Code of 1986 at
6262 a price greater than the price charged at the place of

9191 B. The sale of each ticket, privilege, license,

9494 C. Nothing in this section shall prohibit charging
9595 a fee for services rendered in connection with the sale of a
9696 ticket, privilege, license, admission or pass to an event if
9797 the fee is permitted pursuant to a contract between the ticket
9898 seller and the sponsor or promoter of the event.
9999 D. Whoever commits ticket scalping is guilty of a
100100 misdemeanor and upon conviction shall be punished by a fine up
101101 to five hundred dollars ($500) or by imprisonment for a
102102 definite term of less than one year or both."
