49	49	RELATING TO TICKET SCALPING; AMENDING THE CRIME OF TICKET
50	50	SCALPING TO INCLUDE EVENTS PRESENTED BY THE STATE OR POLITICAL

52	52	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
53	53	SECTION 1. Section 30-46-1 NMSA 1978 (being Laws 1989,
54	54	Chapter 142, Section 1) is amended to read:
55	55	"30-46-1. TICKET SCALPING.--
56	56	A. Ticket scalping consists of selling, offering
57	57	for sale or attempting to sell any ticket, privilege, license,
58	58	admission or pass to [any ] a college athletic event or an event
59	59	presented by the state or a political subdivision of the state
60	60	or by a nonprofit corporation formally recognized as tax exempt
61	61	under Section 501(c)(3) of the Internal Revenue Code of 1986 at
62	62	a price greater than the price charged at the place of

91	91	B. The sale of each ticket, privilege, license,
92	92	admission or pass in violation of this section shall constitute
93	93	a separate offense.
94	94	C. Nothing in this section shall prohibit charging
95	95	a fee for services rendered in connection with the sale of a
96	96	ticket, privilege, license, admission or pass to an event if
97	97	the fee is permitted pursuant to a contract between the ticket
98	98	seller and the sponsor or promoter of the event.
99	99	D. Whoever commits ticket scalping is guilty of a
100	100	misdemeanor and upon conviction shall be punished by a fine up
101	101	to five hundred dollars ($500) or by imprisonment for a
102	102	definite term of less than one year or both."
