49	49	RELATING TO ADVERTISING FOR LEGAL SERVICES; REQUIRING AN
50	50	ADVERTISEMENT FOR LEGAL SERVICES THAT INCLUDES MONETARY AWARDS
51	51	TO A CLIENT FOR SETTLEMENT OR JUDGMENT OF A CIVIL ACTION TO
52	52	INCLUDE THE MONETARY AMOUNT CHARGED TO THE CLIENT FOR THE CIVIL
53	53	ACTION; PROVIDING FOR ENFORCEMENT; PROVIDING A PENALTY.
54	54	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
55	55	SECTION 1. A new section of Chapter 57 NMSA 1978 is
56	56	enacted to read:
57	57	"[NEW MATERIAL] ADVERTISING FOR LEGAL SERVICES--SETTLEMENT
58	58	AND JUDGMENT AMOUNTS--DISCLOSURE OF ATTORNEY FEES--CIVIL
59	59	PENALTY--ENFORCEMENT.--
60	60	A. When an advertisement by an attorney or law firm
61	61	for legal services includes a monetary amount awarded to a
62	62	client for a settlement or judgment of a civil action, the

90	90	advertisement shall also disclose the monetary amount that was
91	91	charged to the client for the services rendered for that civil
92	92	action.
93	93	B. The attorney general shall assess an attorney or
94	94	law firm that violates this section a civil penalty of five
95	95	hundred dollars ($500) for each violation.
96	96	C. The attorney general or, with the attorney
97	97	general's permission, a district attorney in a district in
98	98	which an advertisement in violation of this section is
99	99	broadcast or published may bring a civil action in district
100	100	court to recover a civil penalty assessed pursuant to this
101	101	section.
102	102	D. Civil penalties collected pursuant to this
103	103	section shall be deposited in the current school fund."
104	104	SECTION 2. EFFECTIVE DATE.--The effective date of the
105	105	provisions of this act is July 1, 2025.
