3252 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3353 SECTION 1. A new section of the Health Care Code is
3454 enacted to read:
35-"OPEN ELECTRONIC VISIT VERIFICATION SYSTEM.--
55+"[NEW MATERIAL] OPEN ELECTRONIC VISIT VERIFICATION
56+SYSTEM.--
3657 A. For the purposes of this section:
3758 (1) "aggregator system" means a centralized,
38-state-approved system designed to collect and store
39-electronic visit verification data from various service
40-providers that is compatible with each provider's chosen
41-electronic visit verification system;
42-(2) "electronic visit verification system"
43-means a system that verifies the provision of personal care
44-and home health services and includes, at a minimum, the
45-following information as required under the federal 21st
46-Century Cures Act:
47-(a) the type of service performed;
48-(b) the person receiving the service;
49-(c) the date of the service;
50-(d) the location of service delivery;

90+(2) "electronic visit verification system"
91+means a system that verifies the provision of personal care and
92+home health services and includes, at a minimum, the following
93+information as required under the federal 21st Century Cures
94+Act:
95+(a) the type of service performed;
96+(b) the person receiving the service;
97+(c) the date of the service;
98+(d) the location of service delivery;
99+(e) the person providing the service;

79101 (f) the time the service begins and
80102 ends;
81103 (3) "medicaid recipient" means a person whom
82104 the authority has determined to be eligible to receive
83105 medicaid-related services in the state; and
84-(4) "provider" means a person or any legal
85-or commercial entity licensed or certified to provide home
86-health care or personal care services to medicaid recipients.

87109 B. The authority shall adopt an open electronic

89111 (1) allows providers to choose to use any

92114 (2) uses a centralized aggregator system to
93-collect and report electronic visit verification data from
94-all provider systems for submission to the federal centers
95-for medicare and medicaid services. The aggregator system
96-shall be:
97-(a) interoperable with all electronic
98-visit verification systems used by providers in the state;
99-and
100-(b) capable of collecting and storing
101-all data required by the federal 21st Century Cures Act.

129-the authority shall:

145+medicare and medicaid services. The aggregator system shall
146+be:
147+(a) interoperable with all electronic
148+visit verification systems used by providers in the state; and
149+(b) capable of collecting and storing
150+all data required by the federal 21st Century Cures Act.
151+C. To implement the provisions of this section, the
152+authority shall:
130153 (1) adopt an aggregator system that is in
131154 compliance with state and federal law;
132155 (2) provide guidance to providers on
133156 acceptable electronic visit verification systems and how to
134157 interface with the aggregator system; and
135158 (3) adopt rules necessary for administration
136159 of this section, including:
137160 (a) specific standards for the
138161 aggregator system;
139162 (b) procedures for ongoing monitoring,
140-auditing and reporting of electronic visit verification data
141-to ensure compliance with federal law;
163+auditing and reporting of electronic visit verification data to
164+ensure compliance with federal law;
142165 (c) data privacy protections; and
143166 (d) requirements for providers."
144-SECTION 2. EFFECTIVE DATE.--The effective date of the
145-provisions of this act is January 1, 2026.
