4949 RELATING TO LIBRARIES; ENACTING THE LIBRARIAN PROTECTION ACT;
5050 PROSCRIBING THE BANNING OF LIBRARY MATERIALS.
5151 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5252 SECTION 1. [NEW MATERIAL] SHORT TITLE.--This act may be
5353 cited as the "Librarian Protection Act".
5454 SECTION 2. [NEW MATERIAL] DEFINITIONS.--As used in the
5555 Librarian Protection Act:
5656 A. "ban" means the act of removing or prohibiting
5757 the addition of materials from a public library not in
5858 accordance with an established and approved collection
5959 development policy;
6060 B. "challenge" means an attempt to remove or
6161 restrict materials from a public library; and
6262 C. "public library" means a New Mexico organization

9292 SECTION 3. [NEW MATERIAL] PUBLIC LIBRARIES--PROHIBITING
9393 BOOK BANNING.--
9494 A. A public library shall not be eligible to
9595 receive state funds unless the library:
9696 (1) adopts a written policy that complies with
9797 the American library association's library bill of rights, as
9898 adopted in 2019, including the requirement that library
9999 materials not be proscribed or removed because of partisan or
100100 doctrinal disapproval of the material's content or based on the
101101 author's race, nationality, gender identity, sexual orientation
102102 or political or religious views; or
103103 (2) adopts a written policy prohibiting the
104104 practice of banning books or other library materials within the
105105 library or library system on the basis of partisan or doctrinal
106106 disapproval of the material's content or based on the author's
107107 race, nationality, gender identity, sexual orientation or
108108 political or religious views pursuant to rules promulgated by
109109 the state librarian.
110110 B. A political subdivision of the state shall not
111111 reduce funding for a public library due to the library's
112112 compliance with the provisions of Subsection A of this section.
113113 C. The provisions of Subsection A of this section
114114 are not intended to curtail the right of individuals to
