49	49	RELATING TO LIBRARIES; ENACTING THE LIBRARIAN PROTECTION ACT;
50	50	PROSCRIBING THE BANNING OF LIBRARY MATERIALS.
51	51	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
52	52	SECTION 1. [NEW MATERIAL] SHORT TITLE.--This act may be
53	53	cited as the "Librarian Protection Act".
54	54	SECTION 2. [NEW MATERIAL] DEFINITIONS.--As used in the
55	55	Librarian Protection Act:
56	56	A. "ban" means the act of removing or prohibiting
57	57	the addition of materials from a public library not in
58	58	accordance with an established and approved collection
59	59	development policy;
60	60	B. "challenge" means an attempt to remove or
61	61	restrict materials from a public library; and
62	62	C. "public library" means a New Mexico organization

91	91	general public.
92	92	SECTION 3. [NEW MATERIAL] PUBLIC LIBRARIES--PROHIBITING
93	93	BOOK BANNING.--
94	94	A. A public library shall not be eligible to
95	95	receive state funds unless the library:
96	96	(1) adopts a written policy that complies with
97	97	the American library association's library bill of rights, as
98	98	adopted in 2019, including the requirement that library
99	99	materials not be proscribed or removed because of partisan or
100	100	doctrinal disapproval of the material's content or based on the
101	101	author's race, nationality, gender identity, sexual orientation
102	102	or political or religious views; or
103	103	(2) adopts a written policy prohibiting the
104	104	practice of banning books or other library materials within the
105	105	library or library system on the basis of partisan or doctrinal
106	106	disapproval of the material's content or based on the author's
107	107	race, nationality, gender identity, sexual orientation or
108	108	political or religious views pursuant to rules promulgated by
109	109	the state librarian.
110	110	B. A political subdivision of the state shall not
111	111	reduce funding for a public library due to the library's
112	112	compliance with the provisions of Subsection A of this section.
113	113	C. The provisions of Subsection A of this section
114	114	are not intended to curtail the right of individuals to
