49	49	RELATING TO THE ENVIRONMENT; PROHIBITING THE ADOPTION OF
50	50	CERTAIN RULES RELATING TO THE PRODUCTION AND DELIVERY FOR SALE
51	51	OF ZERO-EMISSION VEHICLES.
52	52	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
53	53	SECTION 1. A new section of the Air Quality Control Act
54	54	is enacted to read:
55	55	"[NEW MATERIAL] RESTRICTING PROVISIONS OF LAW RELATING TO
56	56	THE PRODUCTION AND DELIVERY FOR SALE OF ZERO-EMISSION
57	57	VEHICLES.--A provision of the Air Quality Control Act shall not
58	58	be interpreted to provide a state agency, the department, the
59	59	environmental improvement board, a local board, a local agency
60	60	or a county or municipality that has assumed jurisdiction for
61	61	local administration and enforcement of the Air Quality Control
62	62	Act pursuant to Section 74-2-4 NMSA 1978 with the authority to

90	90	adopt or continue in effect a rule that:
91	91	A. restricts, limits or prohibits the delivery,
92	92	use, lease, sale or purchase of a vehicle by a business,
93	93	corporation or person based on the energy source used to power
94	94	the vehicle, including the energy source used for propulsion or
95	95	use of powering other functions of the vehicle;
96	96	B. restricts, limits or prohibits the delivery,
97	97	use, lease, sale or purchase of a new vehicle with an internal
98	98	combustion engine by a business, corporation or person; or
99	99	C. establishes a percentage or proportion of
100	100	vehicles that must be delivered, used, leased, sold or
101	101	purchased by a business, corporation or person based on the
102	102	energy source used to power the vehicle."
