49	49	RELATING TO HEALTH CARE; DISTINGUISHING HEALTH CARE SHARING
50	50	MINISTRIES FROM INSURERS AS DEFINED BY THE NEW MEXICO INSURANCE

52	52	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
53	53	SECTION 1. A new section of the New Mexico Insurance Code
54	54	is enacted to read:
55	55	"[NEW MATERIAL] HEALTH CARE SHARING MINISTRY.--
56	56	A. For purposes of this section, "health care
57	57	sharing ministry" means a faith-based, nonprofit organization
58	58	that is tax-exempt under the federal Internal Revenue Code of
59	59	1986 and that:
60	60	(1) limits its participants to those who are
61	61	of a similar faith;
62	62	(2) meets the requirements of 26 USCA

91	91	(3) provides for the financial and medical
92	92	needs of a participant through the coordination of
93	93	contributions from other participants.
94	94	B. A health care sharing ministry shall:
95	95	(1) suggest dollar amounts that participants
96	96	may contribute with no assumption of risk or promise to pay
97	97	among the participants and no assumption of risk or promise to
98	98	pay by the health care sharing ministry to the participants;
99	99	(2) provide a written monthly statement to all
100	100	participants that lists the total dollar amount of qualified
101	101	needs submitted to the health care sharing ministry and the
102	102	amount actually published or assigned to participants for their
103	103	contribution; and
104	104	(3) provide a written disclaimer on or
105	105	accompanying all applications and guideline materials
106	106	distributed by or on behalf of the ministry that reads, in
107	107	substance:
108	108	"Notice: The organization facilitating the sharing of
109	109	medical expenses is not an insurance company, and the health
110	110	care sharing ministry's guidelines and plan of operation are
111	111	not an insurance policy. Whether anyone chooses to assist you
112	112	with your medical bills will be completely voluntary because
113	113	participants are not compelled by law to contribute toward your
114	114	medical bills. Therefore, participation in the ministry or a

144	144	to be insurance. Regardless of whether you receive any payment
145	145	for medical expenses or whether this organization continues to
146	146	operate, you are always personally responsible for the payment
147	147	of your own medical bills.".
148	148	C. A health care sharing ministry shall not be
149	149	considered an insurer as defined by the Insurance Code."
