4949 RELATING TO HEALTH CARE; DISTINGUISHING HEALTH CARE SHARING
5050 MINISTRIES FROM INSURERS AS DEFINED BY THE NEW MEXICO INSURANCE

5252 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5353 SECTION 1. A new section of the New Mexico Insurance Code
5454 is enacted to read:
5555 "[NEW MATERIAL] HEALTH CARE SHARING MINISTRY.--
5656 A. For purposes of this section, "health care
5757 sharing ministry" means a faith-based, nonprofit organization
5858 that is tax-exempt under the federal Internal Revenue Code of
5959 1986 and that:
6060 (1) limits its participants to those who are
6161 of a similar faith;
6262 (2) meets the requirements of 26 USCA

9191 (3) provides for the financial and medical
9292 needs of a participant through the coordination of
9393 contributions from other participants.
9494 B. A health care sharing ministry shall:
9595 (1) suggest dollar amounts that participants
9696 may contribute with no assumption of risk or promise to pay
9797 among the participants and no assumption of risk or promise to
9898 pay by the health care sharing ministry to the participants;
9999 (2) provide a written monthly statement to all
100100 participants that lists the total dollar amount of qualified
101101 needs submitted to the health care sharing ministry and the
102102 amount actually published or assigned to participants for their
103103 contribution; and
104104 (3) provide a written disclaimer on or
105105 accompanying all applications and guideline materials
106106 distributed by or on behalf of the ministry that reads, in
107107 substance:
108108 "Notice: The organization facilitating the sharing of
109109 medical expenses is not an insurance company, and the health
110110 care sharing ministry's guidelines and plan of operation are
111111 not an insurance policy. Whether anyone chooses to assist you
112112 with your medical bills will be completely voluntary because
113113 participants are not compelled by law to contribute toward your
114114 medical bills. Therefore, participation in the ministry or a

144144 to be insurance. Regardless of whether you receive any payment
145145 for medical expenses or whether this organization continues to
146146 operate, you are always personally responsible for the payment
147147 of your own medical bills.".
148148 C. A health care sharing ministry shall not be
149149 considered an insurer as defined by the Insurance Code."
