3232 AN ACT
3333 RELATING TO EDUCATION; ENACTING THE TRADE EDUCATION ASSISTANCE
3434 ACT; CREATING THE TRADE EDUCATION ASSISTANCE FUND; MAKING AN
3535 APPROPRIATION.
3636 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3737 SECTION 1. [NEW MATERIAL] SHORT TITLE.--This act may be
3838 cited as the "Trade Education Assistance Act".
3939 SECTION 2. [NEW MATERIAL] DEFINITIONS.--As used in the
4040 Trade Education Assistance Act:
4141 A. "department" means the higher education
4242 department; and
4343 B. "trade education program" means a program
4444 approved by the department to train individuals to qualify for
4545 licenses or certificates of competence issued pursuant to the
4646 Construction Industries Licensing Act.

7474 SECTION 3. [NEW MATERIAL] STIPENDS--ELIGIBILITY--
7575 AMOUNTS.--
7676 A. An individual may be awarded a stipend pursuant
7777 to the Trade Education Assistance Act if the individual:
7878 (1) is a resident of New Mexico;
7979 (2) has earned at least a high school diploma
8080 or its equivalent at least two years prior to being awarded a
8181 stipend but has not earned a baccalaureate degree;
8282 (3) is participating in a trade education
8383 program;
8484 (4) claims at least one dependent on the
8585 individual's federal or state income tax return and is not
8686 claimed as a dependent on another individual's federal or state
8787 income tax return; and
8888 (5) has complied with other rules promulgated
8989 by the department to carry out the provisions of the Trade
9090 Education Assistance Act.
9191 B. Stipends shall be awarded for periods no longer
9292 than six months. Stipends may be renewed for not longer than a
9393 total of two years.
9494 C. A stipend may be terminated if a recipient fails
9595 to satisfactorily participate in a trade education program
9696 approved by the department.
9797 D. Stipends may be used by recipients for living
9898 expenses incurred while participating in a trade education

128128 E. Stipends shall not exceed thirty thousand
129129 dollars ($30,000) per calendar year.
130130 SECTION 4. [NEW MATERIAL] DEPARTMENT DUTIES--RULEMAKING
131131 AUTHORITY--REPORTING.--
132132 A. The department shall administer the Trade
133133 Education Assistance Act and shall award stipends to
134134 individuals the department certifies as participating in a
135135 trade education program as approved by the department.
136136 B. The department shall promulgate rules as
137137 necessary to implement the Trade Education Assistance Act.
138138 C. The department shall report by November 1 of
139139 each year to the legislative finance committee and the
140140 department of finance and administration on the:
141141 (1) status of the trade education assistance
142142 fund;
143143 (2) number of individuals who received
144144 stipends in the prior fiscal year and the amount of stipends
145145 received; and
146146 (3) types of trade education programs approved
147147 by the department and the number of stipend recipients
148148 participating in each type of program in the prior calendar
149149 year.
150150 SECTION 5. [NEW MATERIAL] TRADE EDUCATION ASSISTANCE
151151 FUND.--The "trade education assistance fund" is created as a

180180 nonreverting fund in the state treasury. The fund consists of
181181 appropriations, gifts, grants, donations to the fund and income
182182 from investment of the fund. The department shall administer
183183 the fund, and money in the fund is appropriated to the
184184 department to implement the provisions of the Trade Education
185185 Assistance Act. Disbursements from the fund shall be made by
186186 warrant of the secretary of finance and administration pursuant
187187 to vouchers signed by the secretary of higher education or the
188188 secretary's authorized representative.
189189 SECTION 6. APPROPRIATION.--One hundred million dollars
190190 ($100,000,000) is appropriated from the general fund to the
191191 trade education assistance fund for expenditure in fiscal year
192192 2026 and subsequent fiscal years for the purpose of
193193 implementing the provisions of the Trade Education Assistance
194194 Act. Any unexpended or unencumbered balance remaining at the
195195 end of a fiscal year shall not revert to the general fund.
196196 SECTION 7. EFFECTIVE DATE.--The effective date of the
197197 provisions of this act is July 1, 2025.
