3434 RELATING TO CRIME; MAKING THE TRAFFICKING OF FENTANYL A FIRST
3535 DEGREE FELONY WITH A SENTENCE OF LIFE IN PRISON.
3636 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3737 SECTION 1. Section 30-31-20 NMSA 1978 (being Laws 1972,
3838 Chapter 84, Section 20, as amended) is amended to read:
3939 "30-31-20. TRAFFICKING CONTROLLED SUBSTANCES--
4040 VIOLATION.--
4141 A. As used in the Controlled Substances Act,
4242 "traffic" means the:
4343 (1) manufacture of a controlled substance
4444 enumerated in Schedules I through V or a controlled substance
4545 analog [as defined in Subsection W of Section 30-31-2 NMSA
4646 1978];
4747 (2) distribution, sale, barter or giving away

7777 Schedule I or II that is a narcotic drug;
7878 (b) a controlled substance analog of a
7979 controlled substance enumerated in Schedule I or II that is a
8080 narcotic drug; or
8181 (c) methamphetamine, its salts, isomers
8282 and salts of isomers; or
8383 (3) possession with intent to distribute:
8484 (a) a controlled substance enumerated in
8585 Schedule I or II that is a narcotic drug;
8686 (b) a controlled substance analog of a
8787 controlled substance enumerated in Schedule I or II that is a
8888 narcotic drug; or
8989 (c) methamphetamine, its salts, isomers
9090 and salts of isomers.
9191 B. Except as authorized by the Controlled
9292 Substances Act, it is unlawful for a person to intentionally
9393 traffic. A person who violates this subsection shall be
9494 sentenced pursuant to Section 31-18-15 NMSA 1978 and is:
9595 (1) for the first and subsequent offenses when
9696 the controlled substance is fentanyl, guilty of a first degree
9797 felony for trafficking fentanyl;
9898 [(1)] (2) for [the first offense ] all other
9999 first offenses, guilty of a second degree felony [and shall be

134134 C. A person who knowingly violates Subsection B of
135135 this section within a drug-free school zone excluding private
136136 property residentially zoned or used primarily as a residence
137137 is guilty of a first degree felony and shall be sentenced
138138 pursuant to the provisions of Section 31-18-15 NMSA 1978."
139139 SECTION 2. Section 31-18-15 NMSA 1978 (being Laws 1977,
140140 Chapter 216, Section 4, as amended) is amended to read:
141141 "31-18-15. SENTENCING AUTHORITY--NONCAPITAL FELONIES--
142142 BASIC SENTENCES AND FINES--PAROLE AUTHORITY--MERITORIOUS

144144 A. As used in a statute that establishes a
145145 noncapital felony, the following defined felony classifications

235235 B. The appropriate basic sentence of imprisonment
236236 shall be imposed upon a person convicted and sentenced pursuant
237237 to Subsection A of this section, unless the court alters the
238238 sentence pursuant to the provisions of the Criminal Sentencing
239239 Act.
240240 C. A period of parole shall be imposed only for
241241 felony convictions wherein a person is sentenced to
242242 imprisonment of more than one year, unless the parties to a
243243 proceeding agree that a period of parole should be imposed. If
244244 a period of parole is imposed, the court shall include in the
245245 judgment and sentence of each person convicted and sentenced to
246246 imprisonment in a corrections facility designated by the
247247 corrections department authority for a period of parole to be
248248 served in accordance with the provisions of Section 31-21-10
249249 NMSA 1978 after the completion of any actual time of
250250 imprisonment and authority to require, as a condition of
251251 parole, the payment of the costs of parole services and
252252 reimbursement to a law enforcement agency or local crime
253253 stopper program in accordance with the provisions of that
254254 section. If imposed, the period of parole shall be deemed to
255255 be part of the sentence of the convicted person in addition to
256256 the basic sentence imposed pursuant to Subsection A of this
257257 section together with alterations, if any, pursuant to the
258258 provisions of the Criminal Sentencing Act.

287287 D. When a court imposes a sentence of imprisonment
288288 pursuant to the provisions of Section 31-18-15.1, 31-18-16 or
289289 31-18-17 NMSA 1978 and suspends or defers the basic sentence of
290290 imprisonment provided pursuant to the provisions of Subsection
291291 A of this section, the period of parole shall be served in
292292 accordance with the provisions of Section 31-21-10 NMSA 1978
293293 for the degree of felony for the basic sentence for which the
294294 inmate was convicted. For the purpose of designating a period
295295 of parole, a court shall not consider that the basic sentence
296296 of imprisonment was suspended or deferred and that the inmate
297297 served a period of imprisonment pursuant to the provisions of
298298 the Criminal Sentencing Act.
299299 E. The court may, in addition to the imposition of
300300 a basic sentence of imprisonment, impose a fine not to exceed:
301301 (1) for a first degree felony resulting in the
302302 death of a child, seventeen thousand five hundred dollars
303303 ($17,500);
304304 (2) for a first degree felony for aggravated
305305 criminal sexual penetration, seventeen thousand five hundred
306306 dollars ($17,500);
307307 (3) for a first degree felony, fifteen
308308 thousand dollars ($15,000);
309309 (4) for a second degree felony resulting in
310310 the death of a human being, twelve thousand five hundred
311311 dollars ($12,500);

347347 (8) for a third degree felony resulting in the
348348 death of a human being, five thousand dollars ($5,000);
349349 (9) for a third degree felony for a sexual
350350 offense against a child, five thousand dollars ($5,000);
351351 (10) for a third degree felony for sexual
352352 exploitation of children, five thousand dollars ($5,000);
353353 (11) for a third or fourth degree felony, five
354354 thousand dollars ($5,000); or
355355 (12) for a fourth degree felony for sexual
356356 exploitation of children, five thousand dollars ($5,000).
357357 F. When the court imposes a sentence of
358358 imprisonment for a felony offense, the court shall indicate
359359 whether or not the offense is a serious violent offense as
360360 defined in Section 33-2-34 NMSA 1978. The court shall inform
361361 an offender that the offender's sentence of imprisonment is
362362 subject to the provisions of Sections 33-2-34, 33-2-36, 33-2-37
363363 and 33-2-38 NMSA 1978. If the court fails to inform an
364364 offender that the offender's sentence is subject to those

393393 provisions or if the court provides the offender with erroneous
394394 information regarding those provisions, the failure to inform
395395 or the error shall not provide a basis for a writ of habeas
396396 corpus.
397397 G. No later than October 31 of each year, the
398398 New Mexico sentencing commission shall provide a written report
399399 to the secretary of corrections, all New Mexico criminal court
400400 judges, the administrative office of the district attorneys and
401401 the chief public defender. The report shall specify the
402402 average reduction in the sentence of imprisonment for serious
403403 violent offenses and nonviolent offenses, as defined in Section
404404 33-2-34 NMSA 1978, due to meritorious deductions earned by
405405 prisoners during the previous fiscal year pursuant to the
406406 provisions of Sections 33-2-34, 33-2-36, 33-2-37 and 33-2-38
407407 NMSA 1978. The corrections department shall allow the
408408 commission access to documents used by the department to
409409 determine earned meritorious deductions for prisoners."
