3333 RELATING TO CRIME; EXCLUDING FROM THE CRIME OF VOLUNTARY
3434 MANSLAUGHTER KILLINGS COMMITTED DURING THE ESCAPE FROM THE
3535 COMMISSION OF A FELONY AND WHILE RESISTING LAWFUL ARREST.
3636 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3737 SECTION 1. Section 30-2-3 NMSA 1978 (being Laws 1963,
3838 Chapter 303, Section 2-3, as amended) is amended to read:
3939 "30-2-3. MANSLAUGHTER.--Manslaughter is the unlawful
4040 killing of a human being without malice.
4141 A. Voluntary manslaughter consists of manslaughter
4242 committed upon a sudden quarrel or in the heat of passion,
4343 except that a sudden quarrel or heat of passion shall not
4444 include any conduct in the course of or during an escape from
4545 the commission of a felony offense or while resisting a lawful
4646 arrest by a law enforcement officer or another person .
