3353 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3454 SECTION 1. Section 61-17A-2 NMSA 1978 (being Laws 1993,
3555 Chapter 171, Section 2, as amended) is amended to read:
3656 "61-17A-2. DEFINITIONS.--As used in the Barbers and
3757 Cosmetologists Act:
3858 A. "barber" means a person, other than a student,
3959 who for compensation engages in barbering;
4060 B. "board" means the board of barbers and
4161 cosmetologists;
4262 C. "cosmetologist" means a person, other than a
43-student, who for compensation engages in cosmetology;
44-D. "department" means the regulation and licensing
45-department;
46-E. "electrologist" means a person, other than a
47-student, who for compensation removes hair from or destroys
48-hair on the human body through the use of an electric current
49-applied to the body with a needle-shaped electrode or probe;
50-F. "enterprise" means a business venture, firm or

91+D. "department" means the regulation and licensing

93+E. "electrologist" means a person, other than a
94+student, who for compensation removes hair from or destroys
95+hair on the human body through the use of an electric current

7899 G. "establishment" means an immobile beauty shop,
79100 barber shop, electrology clinic, salon or similar place of
80101 business in which cosmetology, barbering, eyebrow threading,
81102 hairstyling or electrolysis is performed;
82103 H. "esthetician" means a person, other than a
83104 student, who for compensation:
84105 (1) uses cosmetic preparations, including
85106 makeup applications, antiseptics, powders, oils, clays or
86-creams, for the purpose of preserving the health and beauty
87-of the skin and body;
107+creams, for the purpose of preserving the health and beauty of
108+the skin and body;
88109 (2) massages, cleans, stimulates or
89110 manipulates the skin for the purpose of preserving the health
90111 and beauty of the skin and body; or
91112 (3) performs activities similar to the
92-activities described in Paragraph (1) or (2) of this
93-subsection on any part of the body of a person;
94-I. "eyebrow threading" means a method of hair
95-removal in which a thin thread is doubled, twisted and then
96-rolled over areas of unwanted hair, plucking the hair at the
97-follicle level;
98-J. "hair braiding" means twisting, wrapping,
99-weaving, extending, locking or braiding hair and incidental
100-use of topical agents and mechanical devices and includes use
101-of hair extensions, hair fibers, decorative beads and other
102-accessories incidental to hair braiding; HB 281/a

129-K. "hairstylist" means a person, other than a

136-M. "sanitation" means the maintenance of sanitary
137-conditions to promote hygiene and the prevention of disease
138-through the use of chemical agents or products;
139-N. "school" means a public or private

140163 instructional facility approved by the board that teaches

145-SECTION 2. Section 61-17A-4.1 NMSA 1978 (being Laws
146-2017, Chapter 112, Section 1) is amended to read:
147-"61-17A-4.1. HAIRSTYLING DEFINED.--Hairstyling includes
148-any one or any combination of the following practices when
149-done upon the upper part of the male or female human body for
150-cosmetic purposes for the public generally, using the hands
151-or manual, mechanical or electrical implements or appliances:

190215 SECTION 3. Section 61-17A-5 NMSA 1978 (being Laws 1993,
191216 Chapter 171, Section 5, as amended) is amended to read:
192217 "61-17A-5. LICENSE REQUIRED.--
193218 A. Unless licensed pursuant to the Barbers and
194-Cosmetologists Act or exempted from the provisions of that
195-act, no person shall practice barbering, hairstyling or
196-cosmetology for compensation either directly or indirectly.
197-B. Unless licensed pursuant to the Barbers and
198-Cosmetologists Act, no person shall operate a school or
199-establishment for compensation.
200-C. Unless licensed pursuant to the Barbers and
201-Cosmetologists Act or exempted from the provisions of that
202-act, no person shall teach barbering, hairstyling,
203-cosmetology or electrology for compensation.
204-D. Unless licensed by the board pursuant to the HB 281/a

253+C. Unless licensed pursuant to the Barbers and
254+Cosmetologists Act or exempted from the provisions of that act,
255+no person shall teach barbering, hairstyling, cosmetology or
256+electrology for compensation.
257+D. Unless licensed by the board pursuant to the
231258 Barbers and Cosmetologists Act, no person shall practice as a
232259 manicurist-pedicurist, esthetician or electrologist for
233260 compensation.
234261 E. A person who engages in eyebrow threading or
235-hair braiding shall not be required to have a license issued
236-by the board."
237-SECTION 4. Section 61-17A-21 NMSA 1978 (being Laws
238-1993, Chapter 171, Section 21, as amended) is amended to
239-read:
240-"61-17A-21. GROUNDS FOR REFUSAL TO ISSUE, RENEW,
241-SUSPEND OR REVOKE A LICENSE.--

243269 provisions of the Uniform Licensing Act, issue a fine or
244-penalty, restrict, refuse to issue or renew or shall suspend
245-or revoke a license for any one or more of the following
246-causes:
247-(1) the commission of any offense described
248-in the Barbers and Cosmetologists Act;
249-(2) the violation of any sanitary regulation
250-promulgated by the board;
251-(3) malpractice or incompetency;
252-(4) advertising by means of knowingly false
253-or deceptive statements;
254-(5) working in a capacity regulated pursuant
255-to the Barbers and Cosmetologists Act while under the HB 281/a

270+penalty, restrict, refuse to issue or renew or shall suspend or
271+revoke a license for any one or more of the following causes:
272+(1) the commission of any offense described in

302+(2) the violation of any sanitary regulation
303+promulgated by the board;
304+(3) malpractice or incompetency;
305+(4) advertising by means of knowingly false or
306+deceptive statements;
307+(5) working in a capacity regulated pursuant
308+to the Barbers and Cosmetologists Act while under the influence
309+of intoxicating liquor or drugs;
283310 (6) continuing to practice in or be employed
284311 by an establishment, an enterprise, a school or an electrology
285312 clinic in which the sanitary rules of the board, of the
286-department of health or of any other lawfully constituted
287-board or state agency, promulgated for the regulation of
313+department of health or of any other lawfully constituted board
314+or state agency, promulgated for the regulation of
288315 establishments, enterprises, schools or electrology clinics,
289316 are known by the licensee to be violated;
290317 (7) default of a licensee on a student loan;
291318 (8) gross continued negligence in observing
292319 the rules and regulations;
293320 (9) renting, loaning or allowing the use of
294321 the license to any person not licensed under the provisions of
295322 the Barbers and Cosmetologists Act;
296323 (10) dishonesty or unfair or deceptive
297324 practices;
298325 (11) sexual, racial or religious harassment;
299326 (12) conduct of illegal activities in an
300-establishment, enterprise, school or electrology clinic or by
301-a licensee; or
302-(13) aiding, abetting or conspiring to evade
303-or violate the provisions of the Barbers and Cosmetologists
304-Act.
305-B. A suspended or revoked license shall be
306-delivered to the department or an agent of the department upon HB 281/a

337-SECTION 5. Section 61-17A-22 NMSA 1978 (being Laws
338-1993, Chapter 171, Section 22, as amended) is amended to read:

358+or violate the provisions of the Barbers and Cosmetologists

360+B. [Any license] A suspended or revoked license

363+C. A license shall not be suspended, revoked or
364+denied for hair braiding without being licensed for barbering,
365+cosmetology or hairstyling prior to July 1, 2025. "
366+SECTION 5. Section 61-17A-22 NMSA 1978 (being Laws 1993,
367+Chapter 171, Section 22, as amended) is amended to read:
339368 "61-17A-22. EXEMPTIONS.--The following persons are
340369 exempt from the provisions of the Barbers and Cosmetologists
341370 Act while in the discharge of their professional duties:
342371 A. persons licensed by the law of this state to
343372 practice medicine and surgery or chiropractic;
344-B. commissioned medical or surgical officers of
345-the United States army, navy or marine hospital service;
373+B. commissioned medical or surgical officers of the
374+United States army, navy or marine hospital service;
346375 C. registered nurses; and
347-D. funeral service practitioners."
