9595 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
9696 SECTION 1. Section 14-2A-1 NMSA 1978 (being Laws 1993,
9797 Chapter 123, Section 1) is recompiled as Section 14-2-1.3 NMSA
9898 1978 and is amended to read:
9999 "14-2-1.3. PROTECTION OF VICTIMS OF CRIMES OR ACCIDENTS--
100100 [POLICE REPORTS] LAW ENFORCEMENT RECORDS --COMMERCIAL
101101 SOLICITATION PROHIBITED--PENALTIES .--
102102 A. No [attorney, health care provider or their
103103 agents] person shall inspect, copy or use [police reports ] law
104104 enforcement records or information obtained from [police
105105 reports] law enforcement records for [the purpose of] the
106106 solicitation of victims or the solicitation of the relatives of
107107 victims of reported crimes or accidents.
108108 B. A person that requests law enforcement records
109109 shall certify in the written request that the requested law
110110 enforcement records shall not be used for soliciting victims or
111111 the relatives of victims of reported crimes or accidents. "
112112 SECTION 2. Section 14-2-6 NMSA 1978 (being Laws 1993,

143143 Public Records Act:
144144 A. "commercial purpose" means the direct or
145145 indirect use of any part of a public record in any form for
146146 sale, resale, solicitation, rent or lease of a service or any
147147 use by which the user expects a profit through commission,
148148 salary or fee; and does not include the use of a public record:
149149 (1) by a newspaper or periodical or by a
150150 website or social media account associated with the newspaper
151151 or periodical;
152152 (2) by a radio or television station in its
153153 news or other informational programs or by a website or social
154154 media account associated with the radio or television station;
155155 (3) by a social media account that
156156 disseminates news and information to the general public; or
157157 (4) in the preparation for prosecution or
158158 defense of litigation or claims settlement by the parties to
159159 such action or the attorneys representing the parties;
160160 [A.] B. "custodian" means any person responsible
161161 for the maintenance, care or keeping of a public body's public
162162 records, regardless of whether the records are in that person's
163163 actual physical custody and control;
164164 [B.] C. "file format" means the internal structure
165165 of an electronic file that defines the way it is stored and
166166 used;
167167 [C.] D. "information technology systems" means

213213 [E.] F. "person" means any individual, corporation,
214214 partnership, firm, association or entity;
215215 [F.] G. "protected personal identifier information"

217217 (1) all but the last four digits of a:
218218 (a) taxpayer identification number;
219219 (b) financial account number;
220220 (c) credit or debit card number; or

253253 (4) with regard to a nonelected employee of a
254254 public body in the context of the person's employment, the
255255 employee's nonbusiness home street address, but not the city,
256256 state or zip code;
257257 [G.] H. "public body" means the executive,
258258 legislative and judicial branches of state and local
259259 governments and all advisory boards, commissions, committees,
260260 agencies or entities created by the constitution or any branch
261261 of government that receives any public funding, including
262262 political subdivisions, special taxing districts, school
263263 districts and institutions of higher education;
264264 [H.] I. "public records" means all documents,
265265 papers, letters, books, maps, tapes, photographs, recordings
266266 and other materials, regardless of physical form or
267267 characteristics, that are used, created, received, maintained
268268 or held by or on behalf of any public body and relate to public
269269 business, whether or not the records are required by law to be
270270 created or maintained; and
271271 [I.] J. "trade secret" means trade secret as
272272 defined in Subsection D of Section 57-3A-2 NMSA 1978."

303303 "14-2-8. PROCEDURE FOR REQUESTING RECORDS.--
304304 A. Any person wishing to inspect public records may
305305 submit an oral or written request to the custodian. However,
306306 the procedures set forth in this section shall be in response
307307 to a written request. The failure to respond to an oral
308308 request shall not subject the custodian to any penalty.
309309 B. Nothing in the Inspection of Public Records Act
310310 shall be construed to require a public body to create a public
311311 record.
312312 C. A written request shall provide the name,
313313 address and telephone number of the person seeking access to
314314 the records and shall identify the records sought with
315315 reasonable particularity. The written request shall also
316316 include certification from the person:
317317 (1) that the record shall not be used for
318318 soliciting victims or the relatives of victims of reported
319319 crimes or accidents;
320320 (2) confirming or denying that the requested
321321 record is intended to be used for a commercial purpose; and
322322 (3) acknowledging that a fee may be charged by
323323 the public body for a record that is intended to be used for a
324324 commercial purpose, if the person intends to use the record for
325325 a commercial purpose.

359359 E. No person requesting records shall be required
360360 to state the reason for inspecting the records, except as
361361 otherwise provided in the Inspection of Public Records Act .
362362 [D.] F. A custodian receiving a written request
363363 shall permit the inspection immediately or as soon as is
364364 practicable under the circumstances, but not later than fifteen
365365 calendar days after receiving a written request. If the
366366 inspection is not permitted within three business days, the
367367 custodian shall explain in writing when the records will be
368368 available for inspection or when the public body will respond
369369 to the request. The three-day period shall not begin until the
370370 written request is delivered to the office of the custodian.
371371 [E.] G. In the event that a written request is not
372372 made to the custodian having possession of or responsibility
373373 for the public records requested, the person receiving the
374374 request shall promptly forward the request to the custodian of
375375 the requested public records, if known, and notify the
376376 requester. The notification to the requester shall state the
377377 reason for the absence of the records from that person's
378378 custody or control, the records' location and the name and
379379 address of the custodian.

411411 requirements of Subsection C of this section."
412412 SECTION 4. Section 14-2-9 NMSA 1978 (being Laws 1993,
413413 Chapter 258, Section 6, as amended) is amended to read:
414414 "14-2-9. PROCEDURE FOR INSPECTION.--
415415 A. Requested public records containing information
416416 that is exempt and nonexempt from disclosure shall be separated
417417 by the custodian prior to inspection, and the nonexempt
418418 information shall be made available for inspection. If
419419 necessary to preserve the integrity of computer data or the
420420 confidentiality of exempt information contained in a database,
421421 a partial printout of data containing public records or
422422 information may be furnished in lieu of an entire database.
423423 Exempt information in an electronic document shall be removed
424424 along with the corresponding metadata prior to disclosure by
425425 utilizing methods or redaction tools that prevent the recovery
426426 of exempt information from a redacted electronic document.
427427 B. A custodian shall provide a copy of a public
428428 record in electronic format if the public record is available
429429 in electronic format and an electronic copy is specifically
430430 requested. However, a custodian is only required to provide
431431 the electronic record in the file format in which it exists at
432432 the time of the request.

462462 (1) may charge reasonable fees for copying the
463463 public records, unless a different fee is otherwise prescribed
464464 by law;
465465 (2) may charge a fee for records that are
466466 intended to be used for a commercial purpose as provided in
467467 Section 5 of this 2025 act;
468468 [(2)] (3) shall not charge fees in excess of
469469 one dollar ($1.00) per printed page for documents eleven inches
470470 by seventeen inches in size or smaller;
471471 [(3)] (4) may charge the actual costs
472472 associated with downloading copies of public records to a
473473 computer disk or storage device, including the actual cost of
474474 the computer disk or storage device;
475475 [(4)] (5) may charge the actual costs
476476 associated with transmitting copies of public records by mail,
477477 electronic mail or facsimile;
478478 [(5)] (6) may require advance payment of the
479479 fees before making copies of public records;
480480 [(6)] (7) shall not charge a fee for the cost
481481 of determining whether any public record is subject to
482482 disclosure; and
483483 [(7)] (8) shall provide a receipt, upon
484484 request.
485485 D. A public body may waive any fee.

519519 database and the payment of a royalty or other consideration."
520520 SECTION 5. A new section of the Inspection of Public
521521 Records Act is enacted to read:
522522 "[NEW MATERIAL] COMMERCIAL USE OF PUBLIC RECORDS OBTAINED
523523 THROUGH REQUEST FOR INSPECTION.--
524524 A. A requester of a public record who intends to
525525 use the public record for a commercial purpose:
526526 (1) shall certify in the written request that:
527527 (a) the requested public record is to be
528528 used for a commercial purpose; and
529529 (b) the requester acknowledges that a
530530 fee may be charged by a public body for the cost of personnel
531531 time expended to review and prepare the public record; and
532532 (2) may be charged a fee by a public body not
533533 to exceed thirty dollars ($30.00) per hour for any amount of
534534 time beyond the initial hour that was spent reviewing and
535535 preparing a public record.
536536 B. After receiving certification in a written
537537 request that a requester will use a public record for a
538538 commercial purpose, a public body that intends to charge the

576576 SECTION 6. Section 14-2-11 NMSA 1978 (being Laws 1993,
577577 Chapter 258, Section 8) is amended to read:
578578 "14-2-11. PROCEDURE FOR DENIED REQUESTS.--
579579 A. Unless a written request has been determined to
580580 be excessively burdensome or broad, a written request for
581581 inspection of public records that has not been [permitted ]
582582 acted upon within fifteen calendar days of receipt by the
583583 office of the custodian may be deemed denied. The person
584584 requesting the public records may pursue the remedies provided
585585 in the Inspection of Public Records Act after providing the
586586 public body from which the public record was requested with
587587 written notice of the claimed violation. Once the public body
588588 has received the written notice, the public body shall have
589589 fifteen calendar days to respond to the written notice and
590590 fifteen calendar days to remedy the violation. After the two
591591 fifteen-calendar-day periods have elapsed, the public body

622622 B. If a written request has been denied, the
623623 custodian shall provide the requester with a written
624624 explanation of the denial. The written denial shall:
625625 (1) describe the records sought;
626626 (2) set forth the names and titles or
627627 positions of each person responsible for the denial; and
628628 (3) be delivered or mailed to the person
629629 requesting the records within fifteen calendar days after the
630630 request for inspection was received.
631631 C. A custodian who does not deliver or mail a
632632 written explanation of denial within fifteen calendar days
633633 after receipt of a written request for inspection is subject to
634634 an action to enforce the provisions of the Inspection of Public
635635 Records Act and the requester may be awarded damages. Damages
636636 shall:
637637 (1) be awarded if the failure to provide a
638638 timely explanation of denial is determined to be unreasonable;
639639 (2) not exceed one hundred dollars ($100) per
640640 day;
641641 (3) accrue from the fifteenth calendar day
642642 following the day the public body [is in noncompliance ]
643643 received the written notice of a claimed violation until a
644644 written denial is issued; and

675675 SECTION 7. Section 14-2-12 NMSA 1978 (being Laws 1993,
676676 Chapter 258, Section 9) is amended to read:
677677 "14-2-12. ENFORCEMENT.--
678678 A. After a public body has received written notice
679679 of a claimed violation of the Inspection of Public Records Act
680680 and has failed to respond within fifteen calendar days , an
681681 action to enforce the Inspection of Public Records Act may be
682682 brought by:
683683 (1) the attorney general or the district
684684 attorney in the county of jurisdiction; or
685685 (2) a person whose written request has been
686686 denied.
687687 B. An action to enforce the Inspection of Public
688688 Records Act shall be commenced within two years of the date
689689 that the written notice of the claimed violation was provided
690690 to the public body.
691691 [B.] C. A district court may issue a writ of
692692 mandamus or order an injunction or other appropriate remedy to
693693 enforce the provisions of the Inspection of Public Records Act.
694694 [C.] D. Except for the written notice of a claimed
695695 violation as provided in Section 14-2-11 NMSA 1978 , the
696696 exhaustion of administrative remedies shall not be required
697697 prior to bringing any action to enforce the procedures of the

730730 court action to enforce the provisions of the Inspection of
731731 Public Records Act; provided that damages shall not be assessed
732732 for any period of time prior to the person providing the
733733 written notice of the claimed violation ."
734734 SECTION 8. TEMPORARY PROVISION--INSPECTION OF PUBLIC
735735 RECORDS TASK FORCE--MEMBERSHIP--DUTIES.--
736736 A. The "inspection of public records task force" is
737737 created and consists of the following eleven members:
738738 (1) the attorney general or the attorney
739739 general's designee;
740740 (2) the director of the legislative council
741741 service or the director's designee;
742742 (3) a representative of the New Mexico
743743 association of counties;
744744 (4) a representative of the New Mexico
745745 municipal league;
746746 (5) a representative of a public school;
747747 (6) a representative of a state institution of
748748 higher education or public post-secondary educational
749749 institution;
750750 (7) a representative of a news media

780780 (8) a representative of an organization formed
781781 to promote an open government;

787787 B. The chair of the task force shall be the
788788 attorney general or the attorney general's designee. The task
789789 force shall meet at the call of the chair. The task force
790790 shall exist from July 1, 2025 until January 1, 2026.
791791 C. The attorney general shall convene the task
792792 force and provide for staff.
793793 D. The task force shall:
794794 (1) consider and make recommendations on
795795 alternative enforcement options of claimed violations of the
796796 Inspection of Public Records Act before court action is
797797 commenced;
798798 (2) consider and make recommendations on the
799799 use of ombuds to assist public record requesters and public
800800 bodies;
801801 (3) consider and make recommendations on
802802 procedures to standardize the inspection of public records
803803 process;

838838 to the governor and the legislature by December 15, 2025."
