4949 RELATING TO CONSUMER PROTECTION; MAKING IT AN UNFAIR OR
5050 DECEPTIVE TRADE PRACTICE TO USE DYNAMIC PRICING TO CHANGE THE
5151 PRICE OF A GOOD OR SERVICE SOLD BY A GROCERY OR RETAIL STORE IN
5252 CERTAIN CIRCUMSTANCES.
5353 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5454 SECTION 1. A new section of the Unfair Practices Act is
5555 enacted to read:
5656 "[NEW MATERIAL] DIGITAL PRICING IN GROCERY AND RETAIL
5757 STORES.--
5858 A. As used in this section:
5959 (1) "dynamic pricing" means a digital process
6060 that uses a software program to determine or change the price
6161 of a good or service displayed on an electronic shelving label
6262 in a store;

9090 (2) "electronic shelving label" means a
9191 digital label or price tag that displays the price of a good or
9292 service offered for sale by a store; and
9393 (3) "store" means a grocery or retail store.
9494 B. It is an unfair or deceptive trade practice to
9595 use dynamic pricing to change the price of a good or service
9696 sold by a store:
9797 (1) during holidays, weather events, natural
9898 disasters, supply chain disruptions or other events that can
9999 cause a sudden increased demand for goods and services; or
100100 (2) from personal data or purchasing patterns
101101 collected from customers or potential customers, whether by a
102102 facial recognition system or other digital or electronic
103103 process.
104104 C. A person that uses dynamic pricing to determine
105105 or change the price of goods and services sold in the person's
106106 store shall inform its customers by use of conspicuous signage
107107 inside the store:
108108 (1) of the dynamic pricing process;
109109 (2) of the factors used to change the price of
110110 the goods and services;
111111 (3) that it is an unfair or deceptive trade
112112 practice to use dynamic pricing to change the price of a good
113113 or service, as provided in Subsection B of this section;
114114 (4) if personal data or purchasing patterns of

143143 customers are being collected by the store, that a customer has
144144 the right to know how the customer's personal data is
145145 collected, if and how it is used to determine or change the
146146 price of goods and services sold by the store and with whom the
147147 information is shared; and
148148 (5) that a customer has the option to opt out
149149 of the collection of personal data or purchasing patterns."
