3333 RELATING TO PUBLIC CONTRACTS; REQUIRING THAT PUBLIC CONTRACTS
3434 PROVIDE FOR INCREASED CONTRACTOR AND SUBCONTRACTOR
3535 REIMBURSEMENT AND WORKER WAGE INCREASES IN ACCORDANCE WITH AND
3636 CONCURRENT WITH STATE MINIMUM WAGE INCREASES OR INCREASED COSTS
3737 AS MANDATED BY LAW.
3838 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3939 SECTION 1. A new section of the Minimum Wage Act is
4040 enacted to read:
4141 "[NEW MATERIAL] PUBLIC CONTRACTS--SERVICES--MINIMUM WAGE
4242 INCREASES--INCREASES IN COST MANDATED BY LAW.--
4343 A. Beginning July 1, 2025, a state agency that
4444 contracts for services shall include in the terms of that
4545 contract:
4646 (1) a provision for increasing reimbursement

7474 so that the contractor and any subcontractor to that contract
7575 are held harmless for any wage increase resulting from an
7676 increase in the state minimum wage or cost increase resulting
7777 from a change to statutory benefits; and
7878 (2) a requirement that individuals employed
7979 pursuant to that contract or a subcontract of that contract who
8080 are paid the state minimum wage shall receive wage increases in
8181 accordance with and concurrent with increases in the state
8282 minimum wage.
8383 B. As used in this section:
8484 (1) "contract" means any agreement for the
8585 procurement of services;
8686 (2) "services" means the furnishing of labor,
8787 time or effort by a contractor or subcontractor not involving
8888 the delivery of a specific end product other than reports and
8989 other materials that are merely incidental to the required
9090 performance;
9191 (3) "statutory benefits" means any benefit
9292 that an employer is required by state law to provide to the
9393 employer's employees; and
9494 (4) "subcontract" means a contract subordinate
9595 to another superordinate contract, which subcontract is to
9696 procure in whole or in part services to be procured under the
9797 terms of the superordinate contract."
