49	49	RELATING TO CRIME; MAKING THE OFFENSE OF MAKING A SHOOTING
50	50	THREAT A FOURTH DEGREE FELONY.
51	51	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
52	52	SECTION 1. Section 30-20-16 NMSA 1978 (being Laws 1975,
53	53	Chapter 285, Section 1, as amended) is amended to read:
54	54	"30-20-16. BOMB SCARES AND SHOOTING THREATS UNLAWFUL.--
55	55	A. Making a bomb scare consists of falsely and
56	56	maliciously stating to another person that a bomb or other
57	57	explosive has been placed in such a position that property or
58	58	persons are likely to be injured or destroyed.
59	59	B. Making a shooting threat consists of
60	60	intentionally communicating to another person an intent to
61	61	bring a firearm to a property or use the firearm with the
62	62	intent to:

90	90	(1) place a person or group of persons in fear
91	91	of great bodily harm;
92	92	(2) prevent or interrupt the occupation or use
93	93	of a public building; or
94	94	(3) cause a response to the threat by a law
95	95	enforcement official or volunteer agency organized to deal with
96	96	emergencies.
97	97	C. Whoever commits making a bomb scare is guilty of
98	98	a fourth degree felony.
99	99	D. Whoever commits making a shooting threat is
100	100	guilty of a [misdemeanor ] fourth degree felony .
101	101	E. A court may order a person convicted for the
102	102	offense of making a bomb scare or shooting threat to reimburse
103	103	the victim of the offense for economic harm caused by that
104	104	offense.
105	105	F. As used in this section, "economic harm" means
106	106	all direct, incidental and consequential financial harm
107	107	suffered by a victim of the offense of making a bomb scare or
108	108	shooting threat. "Economic harm" includes:
109	109	(1) wages, salaries or other compensation lost
110	110	as a result of the commission of the offense of making a bomb
111	111	scare or shooting threat;
112	112	(2) the cost of all wages, salaries or other
113	113	compensation paid to employees for time that those employees
114	114	are prevented from working as a result of the commission of the

145	145	time that a business is shut down as a result of the commission
