3333 RELATING TO MOTOR VEHICLES; ENACTING THE PROMOTING RESPONSIBLE
3434 END-OF-LIFE MANAGEMENT OF ELECTRIC VEHICLE BATTERIES ACT.
3535 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3636 SECTION 1. [NEW MATERIAL] SHORT TITLE.--This act may be
3737 cited as the "Promoting Responsible End-of-Life Management of
3838 Electric Vehicle Batteries Act".
3939 SECTION 2. [NEW MATERIAL] DEFINITIONS.--As used in the
4040 Promoting Responsible End-of-Life Management of Electric
4141 Vehicle Batteries Act:
4242 A. "auto recycler" means a person engaged in New
4343 Mexico in an established business that includes acquiring
4444 vehicles that are required to be registered pursuant to the
4545 Motor Vehicle Code for the purpose of dismantling, wrecking,
4646 shredding, compacting, crushing or otherwise destroying

7474 vehicles for reclaimable parts or scrap material to sell;
7575 B. "battery" means a device consisting of one or
7676 more electrically connected electrochemical cells that is
7777 designed to receive, store and deliver electric energy;
7878 C. "battery management hierarchy" means the
7979 preference for auto recyclers, secondary handlers, secondary
8080 users or battery providers to first strive to reuse, repair or
8181 remanufacture batteries when possible and cost-effective before
8282 sending end-of-life batteries for recycling;
8383 D. "battery provider" means:
8484 (1) a person that initially sells, offers for
8585 sale or distributes a propulsion battery or a vehicle
8686 containing a propulsion battery in or into New Mexico,
8787 including vehicle manufacturers licensed pursuant to applicable
8888 state codes or propulsion battery manufacturers that distribute
8989 propulsion batteries under their own name or brand;
9090 (2) the owner or licensee of a brand or
9191 trademark under which a propulsion battery is sold or
9292 distributed in or into New Mexico, including a licensee with
9393 the exclusive right to use the trademark or brand in connection
9494 with the distribution or sale of propulsion batteries;
9595 (3) if no person meets the criteria set forth
9696 in Paragraph (1) or (2) of this subsection, a battery provider
9797 is the person that imports the propulsion battery into the
9898 state for sale, distribution or installation; and

127127 (4) if no other person meets the criteria set
128128 forth in Paragraph (1), (2) or (3) of this subsection, the
129129 distributor, retailer, dealer or wholesaler that sells or
130130 distributes the propulsion battery in or into New Mexico.
131131 The sale of a propulsion battery is considered to occur in
132132 New Mexico if the battery, or the vehicle containing the
133133 battery, is delivered to a licensed dealer or directly to the
134134 consumer in New Mexico;
135135 E. "battery state of health" means a figure of
136136 merit, measured in kilowatt-hours or percentage of remaining
137137 kilowatt-hours as compared to its initial capacity, comparing
138138 the propulsion battery's remaining energy retention capacity to
139139 its original specifications when it was new;
140140 F. "commercial hauler" means a person transporting
141141 solid waste for hire by whatever means for the purpose of
142142 transferring, processing, storing or disposing of the solid
143143 waste in a solid waste facility, except that "commercial
144144 hauler" does not include a person transporting solid waste
145145 generated on the person's residential or business premises for
146146 the purpose of disposing of it in a solid waste facility;
147147 G. "department" means the department of
148148 environment;
149149 H. "end-of-life" means the stage at which a
150150 propulsion battery is no longer suitable for powering a vehicle
151151 and will be evaluated by a secondary handler or secondary user

180180 for reuse, remanufacture, repair, repurpose or recycling;
181181 I. "propulsion battery" means a battery with the
182182 primary intended purpose of supplying power to propel an
183183 electric or hybrid vehicle;
184184 J. "remanufacture" means a repair or modification
185185 to a propulsion battery that results in the complete battery,
186186 or any battery modules or battery cells in the propulsion
187187 battery, being used for the same purpose or application for
188188 which the battery was originally designed;
189189 K. "repurpose" means the use of a propulsion
190190 battery or any battery modules or battery cells in the
191191 propulsion battery to store and supply electricity in a manner
192192 other than its primary intended purpose;
193193 L. "reuse" means the use of a propulsion battery in
194194 another vehicle from the same manufacturer, which does not
195195 require modification to the battery;
196196 M. "secondary handler" means an entity that takes
197197 possession of a propulsion battery:
198198 (1) to sort, reuse, repair or remanufacture;
199199 or
200200 (2) to prepare the battery for:
201201 (a) repurposing by a secondary user; or
202202 (b) end-of-life management by a
203203 specialized battery recycler;
204204 N. "secondary user" means an entity that repurposes

233233 a propulsion battery;
234234 O. "specialized battery recycler" means an entity
235235 or facility that is authorized by the department or an
236236 equivalent agency in another state to:
237237 (1) extract and separate end-of-life
238238 propulsion battery elements that include:
239239 (a) intermediate fraction from the
240240 thermal or mechanical treatment of waste batteries; and
241241 (b) components, including lithium
242242 compounds, cobalt, nickel, copper, aluminum, iron, manganese
243243 and graphite, and send the material for further processing or
244244 refining prior to sending them to another specialized battery
245245 recycler; or
246246 (2) refine end-of-life propulsion batteries or
247247 the materials listed in Paragraph (1) of this subsection to
248248 useable battery materials;
249249 P. "Specialized battery recycler" does not include
250250 entities that are only engaged in the collection or logistics
251251 of moving materials for recycling or whose primary method of
252252 battery recycling is done by smelting; and
253253 Q. "spent battery" means a propulsion battery for
254254 which costs associated with reuse, repurposing, remanufacturing
255255 or recycling the battery present a burden for the secondary
256256 handler or secondary user that has removed the battery from the
257257 vehicle.

286286 SECTION 3. [NEW MATERIAL] PROHIBITION ON LANDFILLING.--
287287 A. All propulsion batteries in the state shall be
288288 managed responsibly at end-of-life in accordance with the
289289 battery management hierarchy. Disposal of propulsion batteries
290290 through landfilling is prohibited.
291291 B. A commercial hauler shall not knowingly collect
292292 a propulsion battery, or any module or cell of a propulsion
293293 battery, placed for collection and disposal as solid waste. A
294294 commercial hauler may refuse to collect a solid waste container
295295 containing a propulsion battery or any components of a
296296 propulsion battery.
297297 C. No solid waste facility in this state shall
298298 knowingly accept for disposal a propulsion battery or any
299299 components of a propulsion battery or a truckload or roll-off
300300 container of solid waste containing a propulsion battery or any
301301 components of a propulsion battery. The owner or operator of a
302302 solid waste facility may refuse to accept for disposal a
303303 propulsion battery or any module or cell of a propulsion
304304 battery or any truckload or roll-off container of solid waste
305305 containing a propulsion battery or any components of a
306306 propulsion battery.
307307 SECTION 4. [NEW MATERIAL] RESPONSIBLE ENTITY FOR SPENT
308308 BATTERIES.--The responsible entity for a spent battery shall be
309309 the battery provider, unless a secondary handler or secondary
310310 user has modified the battery. In that case, the responsible

339339 entity shall be the last party that modified the battery. The
340340 responsible entity shall be responsible for end-of-life
341341 treatment for a spent battery consistent with the provisions of
342342 the Promoting Responsible End-of-Life Management of Electric
343343 Vehicle Batteries Act.
344344 SECTION 5. [NEW MATERIAL] RESPONSIBILITIES OF SECONDARY
345345 HANDLERS AND SECONDARY USERS.--
346346 A. Upon repurposing or remanufacturing a propulsion
347347 battery, secondary users and secondary handlers are responsible
348348 for end-of-life battery management of spent batteries.
349349 B. If a secondary handler or a secondary user
350350 identifies a propulsion battery as a spent battery upon taking
351351 initial possession of the battery, the secondary handler or
352352 secondary user shall use the labeling to identify the
353353 responsible entity for that spent battery, which shall be
354354 either the battery provider or the last entity to have modified
355355 the battery. The secondary handler or secondary user shall
356356 notify the responsible entity, who shall collect the spent
357357 battery.
358358 C. For propulsion batteries that are unable to be
359359 further reused, repurposed or remanufactured, secondary
360360 handlers and secondary users shall coordinate with a
361361 specialized battery recycler for end-of-life management to
362362 ensure compliance with the Promoting Responsible End-of-Life
363363 Management of Electric Vehicle Batteries Act. When a battery

392392 provider acts as a secondary handler or secondary user, the
393393 battery provider shall be subject to the responsibilities of
394394 secondary handlers and secondary users pursuant to this
395395 section.
396396 D. If a secondary handler or secondary user
397397 modifies a propulsion battery, the secondary handler or
398398 secondary user shall provide updated labeling that identifies
399399 the secondary handler or secondary user as the responsible
400400 entity for the modified battery before the battery can be
401401 supplied back to market. Secondary handlers and secondary
402402 users become responsible for ensuring spent batteries are
403403 handled in accordance with the Promoting Responsible End-of-
404404 Life Management of Electric Vehicle Batteries Act when the
405405 secondary handlers or secondary users modify a propulsion
406406 battery.
407407 E. On or before April 1, 2027 and by April 1 of
408408 each year thereafter, secondary users and secondary handlers
409409 shall submit annual reports to the department containing the
410410 following information for the prior calendar year, if
411411 applicable:
412412 (1) the total volume of propulsion batteries
413413 each secondary user procured;
414414 (2) identification of all auto recyclers
415415 involved in propulsion battery collections;
416416 (3) a brief overview of methods used to

446446 (4) the total volume of propulsion batteries
447447 reused;
448448 (5) a brief overview of processes used for
449449 reuse of propulsion batteries;
450450 (6) the total volume of propulsion batteries
451451 repurposed;
452452 (7) a brief overview of processes used to
453453 repurpose propulsion batteries;
454454 (8) the total volume of propulsion batteries
455455 remanufactured;
456456 (9) a brief overview of processes used to
457457 remanufacture propulsion batteries;
458458 (10) the total volume of propulsion batteries
459459 sent to a specialized battery recycler; and
460460 (11) the volume of spent batteries that
461461 secondary handlers and secondary users contacted battery
462462 providers to pick up.
463463 F. Upon taking possession of a propulsion battery,
464464 secondary handlers and secondary users shall manage propulsion
465465 batteries in accordance with the battery management hierarchy.
466466 SECTION 6. [NEW MATERIAL] RESPONSIBILITIES OF BATTERY
467467 PROVIDERS.--
468468 A. A battery provider shall:

498498 recycler regarding a spent battery, be responsible for
499499 retrieving the battery in a timely and safe manner;
500500 (2) ensure the responsible end-of-life
501501 management of a propulsion battery that is:
502502 (a) removed from a vehicle still in
503503 service while under warranty, in accordance with state and
504504 federal laws; or
505505 (b) returned directly to the battery
506506 provider; and
507507 (3) coordinate with specialized battery
508508 recyclers for the end-of-life management of propulsion
509509 batteries if recycling is the only viable second-life
510510 application available for a propulsion battery, to ensure
511511 compliance with the Promoting Responsible End-of-Life
512512 Management of Electric Vehicle Batteries Act.
513513 B. A battery provider shall ensure that a
514514 propulsion battery sold in New Mexico while embedded in a
515515 vehicle shall have easily interpretable and accessible battery
516516 state of health data:
517517 (1) while the battery is inside the vehicle;
518518 and
519519 (2) when the battery has been removed from the
520520 vehicle for the purpose of facilitating the potential reuse,
521521 repurposing or remanufacture of the battery.
522522 C. A battery provider ceases to be the responsible

552552 unless the battery provider has performed the remanufacturing
553553 or repurposing or has agreed to accept responsibility for such
554554 liability by contract.
555555 D. If a vehicle containing a propulsion battery
556556 originally sold in New Mexico is retired out of state, it is
557557 not subject to the provisions of the Promoting Responsible
558558 End-of-Life Management of Electric Vehicle Batteries Act.
559559 E. On or before April 1, 2027 and by April 1 of
560560 each year thereafter, battery providers shall submit an annual
561561 report to the department containing the following information
562562 for the prior calendar year:
563563 (1) the total volume of propulsion batteries
564564 managed at end-of-life;
565565 (2) the total volume of propulsion batteries
566566 managed by specialized battery recyclers in accordance with the
567567 Promoting Responsible End-of-Life Management of Electric
568568 Vehicle Batteries Act; and
569569 (3) the total volume of propulsion batteries
570570 procured in the following categories:
571571 (a) batteries acquired from auto
572572 recyclers; and
573573 (b) batteries procured from other
574574 sources.
575575 SECTION 7. [NEW MATERIAL] RESPONSIBILITIES OF SPECIALIZED

604604 BATTERY RECYCLERS.--On or before April 1, 2027 and by April 1
605605 of each year thereafter, specialized battery recyclers shall
606606 submit an annual report to the department containing the
607607 following information for the prior calendar year:
608608 A. the total volume of propulsion batteries the
609609 specialized battery recycler has procured;
610610 B. the total volume of propulsion batteries
611611 recycled; and
612612 C. the recovery rates of lithium, nickel, cobalt,
613613 copper, aluminum and graphite, as applicable.
614614 SECTION 8. [NEW MATERIAL] RESPONSIBILITIES OF OTHER
615615 PERSONS.--A person that is not a battery provider, secondary
616616 handler or secondary user seeking to discard a vehicle
617617 propulsion battery shall:
618618 A. return the vehicle propulsion battery or the
619619 vehicle containing the vehicle propulsion battery to the
620620 responsible entity or notify the responsible entity and
621621 coordinate timely and safe pickup of the battery to be done by
622622 the responsible entity; or
623623 B. sell or transfer the vehicle propulsion battery
624624 or the vehicle containing the vehicle propulsion battery to a
625625 secondary handler, secondary user or specialized battery
626626 recycler.
627627 SECTION 9. [NEW MATERIAL] RESPONSIBILITIES OF THE
628628 DEPARTMENT.--The department shall:

657657 A. notify secondary handlers, secondary users,
658658 commercial haulers and solid waste facilities of the
659659 prohibition on disposing of propulsion batteries in landfills
660660 and that auto recyclers can contact the responsible entity to
661661 take responsibility for spent batteries;
662662 B. determine how to proceed if the federal
663663 government passes laws or publishes regulations pertaining to
664664 propulsion batteries that may impact the requirements outlined
665665 in the Promoting Responsible End-of-Life Management of Electric
666666 Vehicle Batteries Act and review, evaluate and compare the
667667 federal requirements to those provided for in that act;
668668 C. revise applicable administrative rules to ensure
669669 compliance with federal standards and achieve greater
670670 efficiency and feasibility; and
671671 D. determine and enforce violations, administrative
672672 compliance cost recovery and penalties for battery providers,
673673 specialized battery recyclers, secondary handlers and secondary
674674 users that violate the provisions of the Promoting Responsible
675675 End-of-Life Management of Electric Vehicle Batteries Act or
676676 fail to meet the requirements outlined in that act, in
677677 alignment with those provisions of the New Mexico
678678 Administrative Code required by the federal Resource
679679 Conservation and Recovery Act.
680680 SECTION 10. EFFECTIVE DATE.--The effective date of the
681681 provisions of this act is January 1, 2026.
