82 | 82 | | sending end-of-life batteries for recycling; |

83 | 83 | | D. "battery provider" means: |
---|
84 | 84 | | (1) a person that initially sells, offers for |
---|
85 | 85 | | sale or distributes a propulsion battery or a vehicle |
---|
86 | 86 | | containing a propulsion battery in or into New Mexico, |
---|
87 | 87 | | including vehicle manufacturers licensed pursuant to applicable |
---|
88 | 88 | | state codes or propulsion battery manufacturers that distribute |
---|
89 | 89 | | propulsion batteries under their own name or brand; |
---|
90 | 90 | | (2) the owner or licensee of a brand or |
---|
91 | 91 | | trademark under which a propulsion battery is sold or |
---|
92 | 92 | | distributed in or into New Mexico, including a licensee with |
---|
93 | 93 | | the exclusive right to use the trademark or brand in connection |
---|
94 | 94 | | with the distribution or sale of propulsion batteries; |
---|
95 | 95 | | (3) if no person meets the criteria set forth |
---|
96 | 96 | | in Paragraph (1) or (2) of this subsection, a battery provider |
---|
97 | 97 | | is the person that imports the propulsion battery into the |
---|
98 | 98 | | state for sale, distribution or installation; and |

136 | 136 | | merit, measured in kilowatt-hours or percentage of remaining |

137 | 137 | | kilowatt-hours as compared to its initial capacity, comparing |
---|
138 | 138 | | the propulsion battery's remaining energy retention capacity to |
---|
139 | 139 | | its original specifications when it was new; |
---|
140 | 140 | | F. "commercial hauler" means a person transporting |
---|
141 | 141 | | solid waste for hire by whatever means for the purpose of |
---|
142 | 142 | | transferring, processing, storing or disposing of the solid |
---|
143 | 143 | | waste in a solid waste facility, except that "commercial |
---|
144 | 144 | | hauler" does not include a person transporting solid waste |
---|
145 | 145 | | generated on the person's residential or business premises for |
---|
146 | 146 | | the purpose of disposing of it in a solid waste facility; |
---|
147 | 147 | | G. "department" means the department of |
---|
148 | 148 | | environment; |
---|
149 | 149 | | H. "end-of-life" means the stage at which a |
---|
150 | 150 | | propulsion battery is no longer suitable for powering a vehicle |

---|
191 | 191 | | propulsion battery to store and supply electricity in a manner |
---|
192 | 192 | | other than its primary intended purpose; |
---|
193 | 193 | | L. "reuse" means the use of a propulsion battery in |
---|
194 | 194 | | another vehicle from the same manufacturer, which does not |
---|
195 | 195 | | require modification to the battery; |
---|
196 | 196 | | M. "secondary handler" means an entity that takes |
---|
197 | 197 | | possession of a propulsion battery: |
---|
198 | 198 | | (1) to sort, reuse, repair or remanufacture; |
---|
199 | 199 | | or |
---|
200 | 200 | | (2) to prepare the battery for: |
---|
201 | 201 | | (a) repurposing by a secondary user; or |
---|
202 | 202 | | (b) end-of-life management by a |

242 | 242 | | compounds, cobalt, nickel, copper, aluminum, iron, manganese |
---|
243 | 243 | | and graphite, and send the material for further processing or |
---|
244 | 244 | | refining prior to sending them to another specialized battery |
---|
245 | 245 | | recycler; or |
---|
246 | 246 | | (2) refine end-of-life propulsion batteries or |
---|
247 | 247 | | the materials listed in Paragraph (1) of this subsection to |
---|
248 | 248 | | useable battery materials; |
---|
249 | 249 | | P. "Specialized battery recycler" does not include |
---|
250 | 250 | | entities that are only engaged in the collection or logistics |
---|
251 | 251 | | of moving materials for recycling or whose primary method of |
---|
252 | 252 | | battery recycling is done by smelting; and |
---|
253 | 253 | | Q. "spent battery" means a propulsion battery for |
---|
254 | 254 | | which costs associated with reuse, repurposing, remanufacturing |
---|
255 | 255 | | or recycling the battery present a burden for the secondary |
---|
256 | 256 | | handler or secondary user that has removed the battery from the |
---|
257 | 257 | | vehicle. |

289 | 289 | | battery management hierarchy. Disposal of propulsion batteries |
---|
290 | 290 | | through landfilling is prohibited. |

291 | 291 | | B. A commercial hauler shall not knowingly collect |

292 | 292 | | a propulsion battery, or any module or cell of a propulsion |
---|
293 | 293 | | battery, placed for collection and disposal as solid waste. A |
---|
294 | 294 | | commercial hauler may refuse to collect a solid waste container |
---|
295 | 295 | | containing a propulsion battery or any components of a |
---|
296 | 296 | | propulsion battery. |
---|
297 | 297 | | C. No solid waste facility in this state shall |
---|
298 | 298 | | knowingly accept for disposal a propulsion battery or any |
---|
299 | 299 | | components of a propulsion battery or a truckload or roll-off |
---|
300 | 300 | | container of solid waste containing a propulsion battery or any |
---|
301 | 301 | | components of a propulsion battery. The owner or operator of a |
---|
302 | 302 | | solid waste facility may refuse to accept for disposal a |
---|
303 | 303 | | propulsion battery or any module or cell of a propulsion |

346 | 346 | | A. Upon repurposing or remanufacturing a propulsion |

347 | 347 | | battery, secondary users and secondary handlers are responsible |
---|
348 | 348 | | for end-of-life battery management of spent batteries. |
---|
349 | 349 | | B. If a secondary handler or a secondary user |
---|
350 | 350 | | identifies a propulsion battery as a spent battery upon taking |
---|
351 | 351 | | initial possession of the battery, the secondary handler or |
---|
352 | 352 | | secondary user shall use the labeling to identify the |
---|
353 | 353 | | responsible entity for that spent battery, which shall be |
---|
354 | 354 | | either the battery provider or the last entity to have modified |
---|
355 | 355 | | the battery. The secondary handler or secondary user shall |
---|
356 | 356 | | notify the responsible entity, who shall collect the spent |
---|
357 | 357 | | battery. |

358 | 358 | | C. For propulsion batteries that are unable to be |
---|
359 | 359 | | further reused, repurposed or remanufactured, secondary |
---|
360 | 360 | | handlers and secondary users shall coordinate with a |
---|
361 | 361 | | specialized battery recycler for end-of-life management to |

362 | 362 | | ensure compliance with the Promoting Responsible End-of-Life |

401 | 401 | | supplied back to market. Secondary handlers and secondary |

402 | 402 | | users become responsible for ensuring spent batteries are |

403 | 403 | | handled in accordance with the Promoting Responsible End-of- |

404 | 404 | | Life Management of Electric Vehicle Batteries Act when the |
---|
405 | 405 | | secondary handlers or secondary users modify a propulsion |
---|

407 | 407 | | E. On or before April 1, 2027 and by April 1 of |

408 | 408 | | each year thereafter, secondary users and secondary handlers |

668 | 668 | | C. revise applicable administrative rules to ensure |
---|
669 | 669 | | compliance with federal standards and achieve greater |
---|
670 | 670 | | efficiency and feasibility; and |
---|
671 | 671 | | D. determine and enforce violations, administrative |
---|
672 | 672 | | compliance cost recovery and penalties for battery providers, |
---|
673 | 673 | | specialized battery recyclers, secondary handlers and secondary |
---|
674 | 674 | | users that violate the provisions of the Promoting Responsible |
---|
675 | 675 | | End-of-Life Management of Electric Vehicle Batteries Act or |

676 | 676 | | fail to meet the requirements outlined in that act, in |
