33	33	RELATING TO CONSUMER PROTECTION; ENACTING THE DIGITAL AGE
34	34	VERIFICATION ACT; DEFINING TERMS; PROVIDING ENFORCEMENT.
35	35	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
36	36	SECTION 1. [NEW MATERIAL] SHORT TITLE.--This act may be
37	37	cited as the "Digital Age Verification Act".
38	38	SECTION 2. [NEW MATERIAL] DEFINITIONS.--As used in the
39	39	Digital Age Verification Act:
40	40	A. "application store" means a publicly available
41	41	website, software application or online service that
42	42	distributes the software applications of third-party platforms
43	43	to a computer, mobile device or other computing device;
44	44	B. "covered manufacturer" means a manufacturer of a
45	45	device, an operating system for a device or an application
46	46	store;

74	74	C. "department" means the state department of
75	75	justice; and
76	76	D. "device" means a device or a portion of a device
77	77	that communicates across a network with computers or other
78	78	devices to transmit, receive or store data and includes a
79	79	desktop, laptop, cellular telephone, tablet or other device
80	80	that communicates with or across a network.
81	81	SECTION 3. [NEW MATERIAL] AGE VERIFICATION REQUIRED.--
82	82	A. A covered manufacturer shall take commercially
83	83	reasonable and technically feasible steps to:
84	84	(1) equip each device to determine or estimate
85	85	the age of the device's user or users upon initial activation;
86	86	(2) provide websites, applications and online
87	87	services with a digital signal indicating whether a person is
88	88	under the age of thirteen, thirteen years of age to fifteen
89	89	years of age, sixteen years of age to seventeen years of age or
90	90	eighteen years of age or older through a real-time application
91	91	programming interface; and
92	92	(3) if the covered manufacturer is an
93	93	application store, obtain parental or guardian consent prior to
94	94	allowing a person under sixteen years of age to download an
95	95	application from the application store and connect the
96	96	developer of the application with the approving parent or
97	97	guardian to facilitate supervision tools.
98	98	B. For devices sold prior to January 1, 2026,

127	127	covered manufacturers shall ensure that the requirements of
128	128	Subsection A of this section are included in the device's
129	129	operating system and application store versions and updates by
130	130	default ninety days after the effective date of the Digital Age
131	131	Verification Act.
132	132	C. The department may promulgate rules in
133	133	accordance with the Digital Age Verification Act to implement
134	134	the provisions of that act.
135	135	SECTION 4. [NEW MATERIAL] ENFORCEMENT.--A violation of
136	136	the Digital Age Verification Act is an unfair and deceptive
137	137	trade practice actionable under the Unfair Practices Act.
138	138	SECTION 5. EFFECTIVE DATE.--The effective date of the
139	139	provisions of this act is January 1, 2026.
