3333 RELATING TO CONSUMER PROTECTION; ENACTING THE DIGITAL AGE
3434 VERIFICATION ACT; DEFINING TERMS; PROVIDING ENFORCEMENT.
3535 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
3636 SECTION 1. [NEW MATERIAL] SHORT TITLE.--This act may be
3737 cited as the "Digital Age Verification Act".
3838 SECTION 2. [NEW MATERIAL] DEFINITIONS.--As used in the
3939 Digital Age Verification Act:
4040 A. "application store" means a publicly available
4141 website, software application or online service that
4242 distributes the software applications of third-party platforms
4343 to a computer, mobile device or other computing device;
4444 B. "covered manufacturer" means a manufacturer of a
4545 device, an operating system for a device or an application
4646 store;

7474 C. "department" means the state department of
7575 justice; and
7676 D. "device" means a device or a portion of a device
7777 that communicates across a network with computers or other
7878 devices to transmit, receive or store data and includes a
7979 desktop, laptop, cellular telephone, tablet or other device
8080 that communicates with or across a network.
8181 SECTION 3. [NEW MATERIAL] AGE VERIFICATION REQUIRED.--
8282 A. A covered manufacturer shall take commercially
8383 reasonable and technically feasible steps to:
8484 (1) equip each device to determine or estimate
8585 the age of the device's user or users upon initial activation;
8686 (2) provide websites, applications and online
8787 services with a digital signal indicating whether a person is
8888 under the age of thirteen, thirteen years of age to fifteen
8989 years of age, sixteen years of age to seventeen years of age or
9090 eighteen years of age or older through a real-time application
9191 programming interface; and
9292 (3) if the covered manufacturer is an
9393 application store, obtain parental or guardian consent prior to
9494 allowing a person under sixteen years of age to download an
9595 application from the application store and connect the
9696 developer of the application with the approving parent or
9797 guardian to facilitate supervision tools.
9898 B. For devices sold prior to January 1, 2026,

127127 covered manufacturers shall ensure that the requirements of
128128 Subsection A of this section are included in the device's
129129 operating system and application store versions and updates by
130130 default ninety days after the effective date of the Digital Age
131131 Verification Act.
132132 C. The department may promulgate rules in
133133 accordance with the Digital Age Verification Act to implement
134134 the provisions of that act.
135135 SECTION 4. [NEW MATERIAL] ENFORCEMENT.--A violation of
136136 the Digital Age Verification Act is an unfair and deceptive
137137 trade practice actionable under the Unfair Practices Act.
138138 SECTION 5. EFFECTIVE DATE.--The effective date of the
139139 provisions of this act is January 1, 2026.
