5353 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5454 SECTION 1. A new section of the Air Quality Control Act
5555 is enacted to read:
5656 "[NEW MATERIAL] PROHIBITION ON THE CONSTRUCTION OF NEW
5757 SOURCES RELATING TO OIL AND GAS IN COUNTIES WHERE OZONE
5858 CONCENTRATIONS ARE IN EXCESS OF THE PRIMARY NATIONAL AMBIENT
5959 AIR QUALITY STANDARDS FOR OZONE.--Beginning July 1, 2025, the
6060 department and a local agency shall prohibit the construction
6161 of a new source relating to oil and gas production in a county
6262 where the environmental improvement board or the local agency
