4949 RELATING TO CANNABIS REGULATION; REQUIRING CANNABIS
5050 ESTABLISHMENTS TO ENTER INTO, MAINTAIN AND ABIDE BY THE TERMS
5151 OF A LABOR PEACE AGREEMENT.
5252 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
5353 SECTION 1. A new section of the Cannabis Regulation Act,
5454 Section 26-2C-34.1 NMSA 1978, is enacted to read:
5555 "26-2C-34.1. [NEW MATERIAL ] LABOR PEACE AGREEMENTS.--
5656 A. As used in this section, "labor organization"
5757 means an association of workers recognized by the national
5858 labor relations board as a bona fide labor organization.
5959 B. Cannabis establishments with ten or more
6060 employees shall enter into, maintain and abide by the terms of
6161 a labor peace agreement with a labor organization. A labor
6262 peace agreement requirement is an ongoing material condition of

9090 a license, of which a violation may result in refusal to renew
9191 a license or suspension or revocation of the license. A
9292 cannabis establishment with fewer than ten employees that has
9393 not entered into a labor peace agreement shall provide a
9494 written attestation with the application indicating that the
9595 cannabis establishment will enter into and abide by the terms
9696 of a labor peace agreement within sixty days of employing the
9797 tenth employee.
9898 C. An initial applicant shall provide a written
9999 attestation with the application indicating that the applicant
100100 will enter into and abide by the terms of a labor peace
101101 agreement within sixty days of employing the tenth employee.
102102 D. A licensee shall submit the written agreement to
103103 the division within six months of employing the tenth employee.
104104 E. On and after September 1, 2025, the division
105105 shall not renew a license for a cannabis establishment with ten
106106 or more employees unless the cannabis establishment provides a
107107 written attestation signed by a labor organization stating that
108108 the cannabis establishment is maintaining and abiding by the
109109 terms of a labor peace agreement.
110110 F. The division shall promulgate rules to enforce
111111 the provisions of this section. Upon review and findings of a
112112 cannabis establishment's failure to meet the material condition
113113 of maintaining and abiding by a labor peace agreement, the
114114 division shall suspend the cannabis establishment's license.

143143 G. The labor peace agreement shall specify:
144144 (1) for the cannabis establishment, that it
145145 shall not disrupt efforts by the labor organization to
146146 communicate with and attempt to organize and represent the
147147 cannabis establishment's employees and shall provide access at
148148 reasonable times for the labor organization to meet with
149149 employees to discuss their right to representation, employment
150150 rights under state law and terms and conditions of employment;
151151 and
152152 (2) for the labor organization, that neither
153153 the labor organization nor its members shall engage in
154154 picketing, work stoppages, boycotts or any other economic
155155 interference with the cannabis establishment's business."
