49	49	RELATING TO CANNABIS REGULATION; REQUIRING CANNABIS
50	50	ESTABLISHMENTS TO ENTER INTO, MAINTAIN AND ABIDE BY THE TERMS
51	51	OF A LABOR PEACE AGREEMENT.
52	52	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
53	53	SECTION 1. A new section of the Cannabis Regulation Act,
54	54	Section 26-2C-34.1 NMSA 1978, is enacted to read:
55	55	"26-2C-34.1. [NEW MATERIAL ] LABOR PEACE AGREEMENTS.--
56	56	A. As used in this section, "labor organization"
57	57	means an association of workers recognized by the national
58	58	labor relations board as a bona fide labor organization.
59	59	B. Cannabis establishments with ten or more
60	60	employees shall enter into, maintain and abide by the terms of
61	61	a labor peace agreement with a labor organization. A labor
62	62	peace agreement requirement is an ongoing material condition of

90	90	a license, of which a violation may result in refusal to renew
91	91	a license or suspension or revocation of the license. A
92	92	cannabis establishment with fewer than ten employees that has
93	93	not entered into a labor peace agreement shall provide a
94	94	written attestation with the application indicating that the
95	95	cannabis establishment will enter into and abide by the terms
96	96	of a labor peace agreement within sixty days of employing the
97	97	tenth employee.
98	98	C. An initial applicant shall provide a written
99	99	attestation with the application indicating that the applicant
100	100	will enter into and abide by the terms of a labor peace
101	101	agreement within sixty days of employing the tenth employee.
102	102	D. A licensee shall submit the written agreement to
103	103	the division within six months of employing the tenth employee.
104	104	E. On and after September 1, 2025, the division
105	105	shall not renew a license for a cannabis establishment with ten
106	106	or more employees unless the cannabis establishment provides a
107	107	written attestation signed by a labor organization stating that
108	108	the cannabis establishment is maintaining and abiding by the
109	109	terms of a labor peace agreement.
110	110	F. The division shall promulgate rules to enforce
111	111	the provisions of this section. Upon review and findings of a
112	112	cannabis establishment's failure to meet the material condition
113	113	of maintaining and abiding by a labor peace agreement, the
114	114	division shall suspend the cannabis establishment's license.

143	143	G. The labor peace agreement shall specify:
144	144	(1) for the cannabis establishment, that it
145	145	shall not disrupt efforts by the labor organization to
146	146	communicate with and attempt to organize and represent the
147	147	cannabis establishment's employees and shall provide access at
148	148	reasonable times for the labor organization to meet with
149	149	employees to discuss their right to representation, employment
150	150	rights under state law and terms and conditions of employment;
151	151	and
152	152	(2) for the labor organization, that neither
153	153	the labor organization nor its members shall engage in
154	154	picketing, work stoppages, boycotts or any other economic
155	155	interference with the cannabis establishment's business."
